About Sinhgad Law College
Sinhgad Law College is situated in a spacious location at Ambegaon (BK), STES Ambegaon
Campus, Pune.

Sinhgad Law College was established in the year 2003, under the dynamic leadership of Prof.
M.N Navale. The college offers a career in legal studies through LL. B (3 years course) and
B.A.LL.B (5 years course). The college also runs other specialized courses like Diploma in
Labour Laws and Labour Welfare, Diploma in Taxation Law, and a Certificate course in
Forensic and Medical Jurisprudence. There is a well-qualified teaching staff, a well- equipped
library, a separate computer laboratory, and other infrastructure facilities conducive for
learning and development.

Our commitment is to impart quality legal education through highly qualified and
experienced lecturers along with clinical educational inputs through Moot Courts, Debates,
Legal Literacy camps & Research activities.

With a view to providing practical experience and inculcating lawyering skills among the

Welcome to the Smt. Kashibai Navale 10 National
Moot Court Competition, 2024 organized by the
Sinhgad Technical Education Society's Sinhgad Law
College's Moot Court Society, Pune (Maharashtra).

The Sinhgad Law College, Pune has a dedicated and


research-oriented Moot Court Society which carries
out its functions and academic activities with the help
and guidance of committed faculty Coordinators. The
sole purpose of the Society is to train students to
participate in the various Moot Court Competitions conducted at the International, National,
State and Institutional level. I believe that the moot court activity not only develops the legal
knowledge amongst the students but also enhances the communication, drafting, and
presentation and research skills amongst the students. The College students have taken part in
various National, State and University level Moot Court Competitions hosted by various Law
Colleges.

The Moot Court Society organises various regular activities to achieve these objectives. The
Society undertakes to educate and train the first year students by organising an orientation
programme on the basics of mooting. The environment of the College is conducive for
students to acquire requisite skills and professional abilities. The college has a privilege of
Hosting every year a very prestigious event Smt. Kashibai Navale National Moot Court
Competition. I wish all the participating teams, the best of luck!!!

RULES AND REGULATIONS

1)THE COMPETITION: The Competition shall be called “Smt. Kashibai Navale 10 National Moot
Court Competition, 2024” organized by Sinhgad Law College, Pune.

DATE & VENUE: The Esteemed Smt. Kashibai Navale 10 National Moot Court Competition, 2024, will be

held on the 27 and 28 of April 2024 (Saturday and Sunday) at STES's Sinhgad Law College Campus,
Ambegaon (Bk.), Pune, Maharashtra.

2)LANGUAGES: The official language of this competition shall be English, and all the participant’s oral and
written submissions for the competition shall be made in English only.

3)TEAM ELIGIBILITY & COMPOSITION:

a) The Competition is open to all the Law Colleges / Law Schools and Institutes / Universities,
Department of Law in India which are recognized by the Bar Council of India. Participation is open
for all the students pursuing LL.B. / B.A., LL.B. / B.B.A., LL.B. / B.Com., LL.B. / B.S.C., LL.B. /
B.L.S., LL.B., in the Three- year Course and Five-Year Courses respectively.

b) Each participating institution should send one team only. The teams must obtain prior permission
from their respective college authorities.

c) The team shall comprise three members wherein two members shall act as speakers and one member
will act as a researcher. Teams willing to participate with two members only shall appoint one of the
members as the Researcher for the Researcher's Test.

4) REGISTRATION:

a) There will be a process for Online Registration that each team is required to adhere to. Teams will be
provided with a team code within 2 Days of Registration. Teams should not disclose the identity of
their institution during written or oral submissions; such disclosure shall invite penalties including
disqualification. The decision for the same shall be at the discretion of the Organizers of this
competition.

b) The substitution of any Team Member by another member is not allowed after the registration
deadline is over, except in special circumstances with the permission of the Organizers.

c) Participating teams are required to submit the Google form on or before 15th April 2024 along with
payment receipt and consent letter from their respective college authorities.

d) Participating Teams are required to submit hard copies of the registration form and receipt of
payment on the day of the competition.

e) While filling out the Registration Form, the teams have to choose a primary contact person from the

team members. All communications concerning the Competition will be sent by e-mail to this
primary contact person nominated by the team. The nominated primary contact person shall be
responsible to convey all the information regarding this competition to the team.

f) After the completion of the Registration process, a mail confirming the registration and payment will
be sent to the primary contact person.

g) In case organizers receive more than 32 teams, then a memorial selection round shall take place, and
the 32 teams scoring the highest marks will be selected for the Oral rounds. After the selection round
of memorial, the 32 teams scoring the highest marks. will qualify for oral rounds.

i) Payment of Registration Fee Details

I) The participating team shall be required to make a payment of total amount of Rs. 4000/- (Rupees
Four Thousand Only) as a Registration fee via Online/UPI/Net Banking. Details of the same must be
filled in the registration form.

5) DRESS CODE:

Participants shall be appropriately attired for the rounds of the competition. The Dress Code for the
Inauguration, Oral Rounds, and Valedictory Function shall strictly be:

a) For Gentlemen - Western Formals (White formal shirt with formal black pants and a black blazer)

b) For Ladies - Western Formals (White formal shirt with black formal pants/black formal skirt and a
black blazer) or black and white Indian Formals.

6)MEMORIAL SUBMISSION:

a) Each team shall prepare memorials for both sides (Petitioner and Respondent).

b) The soft copy of the Memorials for the Petitioner and the Respondent should be mailed to
mcsslc2020@gmail.com on or before 18th April, 2024 (11:59 P.M. IST). Under no circumstances,
shall the date for submission of memorials be extended.

c) The Hard Copy of the Memorials, 6 Copies each of Petitioner and Respondent shall be sent to the
Following Address via Speed Post on or before 20th April 2024.

d) Team Code: The team code must be ascribed on the top right corner of the cover page. The code must
be succeeded by the side for which the memorial submission is prepared.

The teams must use “P” for Petitioner, and R for “Respondent.” For example, if the Team Code is
TC20, the team must write “TC20P” in case of memorial submission for Petitioner and “TC20R” in
case of memorial submission for Respondent.

e) Cover Page: The cover page of Petitioner's memorial shall be Blue in Colour and the cover page of
Respondent's memorial shall be Red in Colour. The cover page shall contain the case title, side of the
memorial submission, year of competition, name of the forum, and team code in the top right corner.

f) Margin: The memorial submission must maintain an equal margin of 1 inch on all sides.
Noncompliance will result in a deduction of 1 mark.

g) Compulsory contents of Memorial:

Non-compliance will result in a deduction of 1 mark per exceeded page


NOTE: A total of (30-35 Pages) is allowed.

h) Font Size, and Line Spacing: The text font should be Times New Roman, Size 12, and must be in
1.5 Line Spacing. Non-compliance will result in a deduction of 0.5 marks per the incorrect format of
the font size, and line spacing with a maximum deduction of 2 marks per page of the Memorial
Submission.

i) Footnotes: The footnotes must be in font Times New Roman, size 10, and singly spaced.
The Bluebook: A Uniform System of Citation (21st Edition) should be followed throughout the
memorial submission. Non-compliance will result in a deduction of 1 mark per page.
Substantive/Speaking footnotes are strictly prohibited. Noncompliance will result in a deduction of 1
mark per substantive citation.

j) Header and Footer: The font used for the header/footer, if any, shall be Times New Roman, size 10,
with single spacing.
Non-compliance will result in a deduction of 1 mark per page of the Memorial Submission.

k) Page Limit: The maximum page limit on the Memorial Submission including the Arguments
Advanced shall be a maximum of 30-35 pages. No annexure should be added to the memorial
submission.

7) SCORING OF MEMORIALS:
Evaluation of the memorial will be based on the following criteria

8)RESEARCHER'S TEST:

a) Researcher's Test shall be conducted on 27th April 2024.


b) The test shall comprise Multiple Choice Questions. (Details regarding the same shall be given on the
day of the test.)
c) The questions in the Test shall be related to the Moot Proposition and the relevant laws connected
there with.

Note: Researcher's Test is being conducted independently from the other rounds, it is at the discretion of
the participating teams to give the researcher's test

9)STRUCTURE OF ORAL ROUNDS:

a) The Oral Rounds of the Competition shall be conducted in four phases:


1) Preliminary Round
2) Quarter-Finals
3) Semi-Finals
4) Finals.

b) During each of the abovementioned rounds, the order in which the teams shall present their arguments
is as follows:
• Petitioner Speaker 1
• Petitioner Speaker 2
• Respondent Speaker 1
• Respondent Speaker 2
• Rebuttal: Petitioner - Any one of the two Speakers
• Sur-rebuttal: Respondent - Any one of the two Speakers (Sur-rebuttal shall be permitted only at
the discretion of the Judges).

c) The Researcher shall not be permitted to address the Court during the Oral Rounds.

d) Teams are not permitted to raise issues in the Oral Rounds that have not been submitted in the
Memorial Submission.

e) Participants Shall use their own bare acts, printouts, and commentaries.

f) The decision of the Judges as to the marks allotted to each team shall be final and binding.

10) Rounds:

A) Preliminary Rounds:
i. Draw of Lots: The teams representing petitioners and respondents in Preliminary Rounds shall be
determined on the basis of the draw of lots. The draw of lots shall take place on April, 2024.
ii. Each team will get a total of 20 minutes to present their case. This time includes rebuttal & sur-
rebuttal time.
iii. The division of time is at the discretion of the team members; division of time shall be informed to the
court officer before arguments begin.
iv. The total score of the Preliminary Rounds shall be decided by adding the total score of Memorial to
the score of the Preliminary round.

B) Quarter Final:
i. Out of the total number of teams, the best team in each courtroom shall qualify for the Quarter- final
round: The teams that proceed to the Quarter-Final Round, as determined by the Rules above, shall
each argue for the side allotted by a draw of lots. The teams representing petitioners and respondents
in the Quarter-Final Round shall be decided through a draw of lots.
ii. Each team will get a total of 30 minutes to present their case. This time includes rebuttal and sur-
rebuttal time.
iii. The top 6 teams with the highest scores in the oral round shall qualify for the Semi-Final Round.
However, in case of a tie, the team having a higher score in the memorials will qualify for the next
round.

C) Semi-nals:
i. The Six (6) teams that proceed to the Semi-Final Rounds, as determined by the Rules above, shall
each argue for the side allotted by a draw of lots.
ii. Each side shall get a maximum time of 40 minutes to present their arguments. This time includes
rebuttal and sur-rebuttal time.
iii. The top two (2) teams with the highest scores in the oral round shall qualify for the Final Round.
However, in case of a tie, the team having a higher score in memorials will qualify for the next round.

D) Finals:
i. The two (2) teams that proceed to the Final Round, as determined by the Rules above, shall each
argue for the side allotted by a draw of lots.
ii. Each side shall get a maximum time of 50 minutes to present their arguments, this time includes
rebuttal and sur-rebuttal time.
iii. The team with the highest score, will win the round. However, in case of a tie, the team having a
higher score in memorials will win the round.
iv. The team which wins the Final Round shall be declared as the ‘Winners’. The other team shall be
declared as the 'Runner-Up'.

11) SCORING OF ORAL ARGUMENTS:

12)SCOUTING:

Teams will not be allowed to observe the Preliminary orals rounds. Scouting by any of the team members
shall result in disqualification. Scouting is permitted from the Quarter Final rounds.

13) AWARDS

The following awards shall be awarded in the Competition:

I) Winning Team: Cash Prize of Rs. 21,000/-, Trophy & Certificate of Merit.
II) Runner Up: Cash Prize of Rs.15,000/-, Trophy & Certificate of Merit.
III) Best Memorial: Cash Prize of Rs. 5,000/-, Trophy & Certificate of Merit.
IV) Best Speaker: Cash Prize of Rs. 5,000/-, Trophy & Certificate of Merit.
V) Best Researcher: Cash Prize of Rs.5,000/-, Trophy & Certificate of Merit.
All the participants will be provided with a Certificate of Participation.

14) FOOD AND ACCOMMODATION

The team of three participants shall be provided accommodation by the college for the duration of the
competition. Option for food & accommodation will be provided in Registration Form. Under no
circumstance organizers shall provide accommodation to any coach or any other person accompanying the
team.

15) CONSENT LETTER

Participating teams are hereby informed to carry a hard copy of the Consent Letter from their respective
college authorities while coming for the competition. Format of the consent letter is given below:

The organizers reserve the right to change/alter/amend any of the rules and regulations and the structure of
the competition at any time without any prior intimation.

MOOT PROPOSITION
Maurya is a sovereign republic, which has been facing with various terrorist activities. Maurya enacted a special
law to prevent terrorism and to punish terrorists in 1967 known as ‘The Unlawful Activities (Prevention) Act,
1967’ (hereinafter referred to as ‘UAPA’). Maurya followed the Mauryan Penal Code since 1860, (hereinafter
referred to as ‘MPC’) till the end of 2023 for all general offences.

In 2023 Maurya decided to repeal MPC as it continued as relict of Pre- Independence British era which had
outdated provisions that did not align with the evolving modern social changes and hence enacted a new penal
code named as ‘Mauryan Nyaya Sanhita, 2023’(hereinafter referred to as ‘MNS’) which came into force with
effect from 1st January, 2024.

On 1st February 2024, there was a bomb blast in the park near Municipal Corporation in Taigo City in Maurya.
In the said incident 15 persons died and 35 persons were severely injured. During the investigation, police
apprehended two accused Ramesh and Rekha in connection with the said bomb blast.

The police registered a case against Ramesh under the section 15 of UAPA. However, the case was registered
against Rekha under section 113 of MNS by using the powers given under section 113 of MNS. Being aggrieved
by this, Ramesh filed a Writ Petition before the Hon’ble Supreme Court of Maurya, stating that his apprehension
under UAPA is arbitrary and violative to the fundamental rights under the Constitution of Maurya.

Aadishakti is an NGO who fights for the prisoner’s rights and has previously filed various petitions pertaining to
various matters, such as, illegal detention of under trial prisoners, police brutality and discrimination amongst
the prisoners, etc. Ramesh approached the said NGO regarding the charges levelled against him. Considering
the arbitrary apprehension of Ramesh and in the interest of rights of under trial prisoners, Aadishakti filed a
petition in the public interest before the Hon’ble Supreme Court of Maurya. In a said petition Aadishakti
challenged the constitutional validity of the excessive powers given to the Superintendent of Police under
Section 113 of MNS.

Both petitions are listed together before the Hon’ble Supreme Court for final hearing.

Issues :
1. Whether the Petitions filed by Ramesh and Aadishakti are maintainable?
2. Whether the powers given to the Police Officers under Section 113 of MNS are arbitrary and
violative of the fundamental rights under the Constitution of Maurya?
Note :
1. Laws of Maurya are in pari materia with the Laws of India. Participants will have to argue by
presuming that the provisions of the Bharatiya Nyaya Sanhita, 2023(which is in pari materia with the
MNS ) came into force with effect from 1st January, 2024 and Indian Penal Code, 1860 (which is in
pari materia with MPC, 1860)

2. Participants have discretion to frame any other issues without changing the above given issues.
