MEMORANDUM OF UNDERSTANDING

This Memorandum of Understanding, made and entered into this 4TH day of March
2022 in the City of Gingoog, by and between:

The PHILIPPINE NATIONAL POLICE GINGOOG CITY POLICE

STATION, a government agency created and organized in accordance with law, with office
and postal address at Dugenio Street, Brgy. 22-A, Gingoog City, represented herein by its
Chief of Police, PLTCOL CECELIO QUEVEDO ORCULLIO here in after referred to as
the FIRST PARTY;

The Sangguniang Barangay of , Gingoog,

represented herein by its Punong Barangay, HON.
, of legal age, Filipino and a resident of Brgy.
, Gingoog City, hereinafter referred to as the
SECOND PARTY.

W I T N E S S E T H,

WHEREAS, the SECOND PARTY is the basic political unit, the Barangay
serves as the primary planning and implementing unit of government policies, plans,
programs, projects, and activities in the community, and as a forum wherein the collective
views of the people may be expressed, crystallized and considered, and where disputes may
be amicably settled.

WHEREAS, the FIRST PARTY is an office created under Republic Act No.
8551 enacted on February 17, 1998 known as the "PNP Reform and
Reorganization Act of 1998". It is vested with the power to effectively perform its
mandate -to enforce the law, prevent and control crimes, maintain peace and order, and
ensure public safety and internal security with the active support of the community.

WHEREAS, the FIRST PARTY welcomes the SECOND PARTY as a volunteer

group that is willing to assist the FIRST PARTY specifically on the civilian volunteer
support on crime prevention and information networking, expresses that this Memorandum
of Understanding is executed based on the element of trust that the FIRST PARTY has
over the SECOND PARTY as an organization in general, and its officers in particular, and
on the element of accountability with which the SECOND PARTY hereby binds itself
unconditionally.
 NOW, THEREFORE, for and in consideration of the mutual understanding of
the parties hereto, the FIRST PARTY and SECOND PARTY. hereby set forth the
following terms and conditions of understanding, as follows:

1. The FIRST PARTY shall accredit and deputize the SECOND PARTY as CIVILIAN
VOLUNTEER to assist the former in the enforcement and implementation of mandated
laws, rules and regulations, including but not limited to Republic Act No. 8551 that are
applicable within the jurisdiction of Region 10, provided that deputation of volunteers
shall be specific to qualified members of the SECOND PARTY., and such deputation
shall not be transferrable to any other person or persons.

2. The SECOND PARTY or any of its volunteer-members shall receive no

compensation, financial or vehicular support, or any emolument whatsoever by virtue
of this accreditation and deputation, or as may be brought about by this Memorandum
of Understanding, and shall hold the FIRST PARTY free from any liability,
damage, loss or injury incurred upon the PUBLIC by the SECOND PARTY or any of
its members, or upon any property for any reason at all.

3. This Memorandum of Understanding shall not preclude the FIRST PARTY from
accrediting or deputizing any other volunteer group that it may find fit to assist the
GINGOOG CITY POLICE STATION in the enforcement and implementation of
mandated laws, rules and regulations in the City of Gingoog.

4. The FIRST PARTY and SECOND PARTY shall undertake joint undertakings or
programs that will enhance Police Community Relations in the City of Gingoog.

5. The FIRST PARTY and SECOND PARTY upon mutual agreement shall have the
power to cancel, modify, revoke, or otherwise alter this Memorandum of
Understanding;

6. The SECOND PARTY., guided by the existing laws, rules and regulations, and by the
generally accepted principles of customer service and customer relations, shall:

a. Abide by the rules and regulations promulgated by the FIRST PARTY and of
the national governmental agencies or offices whose functions deal with the
promulgation, enforcement and implementation of mandated laws, rules and
regulations.
 b. Document its operations especially in the undertaking of prescribed and
committed programs and projects.

c. Not commit any act of harassment against any individuals in the conduct of its
activities pursuant to this Memorandum of Understanding.

d. The SECOND PARTY members must, in the conduct any police community
relations assistance operation, must wear their prescribed uniform as barangay
officials and bring Identification Cards to identify themselves as an accredited
and deputized volunteers.

7. The FIRST PARTY shall:

a. Recognize the SECOND PARTY as an accredited deputized volunteer group in

the enforcement and implementation of mandated laws, rules and regulations
within the territorial jurisdiction THE City of Gingoog.

b. Provide, subject to the availability of the FIRST PARTY personnel in support

of the operations that may be conducted by the SECOND PARTY within the
regular working hours of any day of the week.

c. Issue the necessary accreditation or deputation Identification Card which shall

be designed and produced by the SECOND PARTY, subject to the approval of
the FIRST PARTY, provided that such ID cards shall be used for the
purpose of identifying the SECOND PARTY members/volunteers only when
conducting operations as herein contemplated.

8. Any amendment to this Memorandum of Understanding shall be valid only when

mutually agreed upon by the parties hereto and when formally done, unless specifically
stipulated elsewhere herein.
