SUBJECT : SERIOUS PHYSICAL INJURY resulted to the ELBOW

FRACTURED AND SERIOUS HEAD TRAUMA of APRIL NILLOS

I. AUTHORITY:

Complaint Sheet of 2024-11 dated March 28 , 2024; and

Memo from City Director dated March 29 ,2024.

II. MATTERS INVESTIGATED:

A wrestled and boxing incident happened at the neighbor’s house of both victim
and suspect particularly at Mr. Aladin house in Purok Tagumpay 1 Barangay
Sagasa Esperanza Sultan Kudarat..

To determine the criminal liabilities of the suspect and to know the premises
surrounding this particular incident.

III. FACTS OF THE CASE:

On or about March 28, 2024 4:00 PM there was wrestled and boxing incident in
the Purok Tagumpay 1 Barangay Sagasa Esperanza Sultan Kudarat and the
victim was APRIL NILLOS 15 yrs. Old, High School student of Esperanza
National High School of Esperanza, resident of Purok Tagumpay 1 Barangay
Sagasa. As a consequence thereof, she sustained elbow fractured and serious
head trauma. The Police Investigator found out the location of the suspect and
with the coordination of Mr. MARK LOPEZ the friend of the suspect. The Police
Investigator locate the known suspect JOBE SEREÑAGA where she was hiding.

On April 3, 2024 a case of Serious Physical Injury against the known suspect
was referred to the Office of the City Prosecutor, Sultan Kudarat and docket
under I.S Number 12-0071 for final disposition. Commitment Order was issued
by the court and the suspect was subsequently transferred to the BJMP District
Jail, Kalawag , Sultan Kudarat.

IV. DISCUSSION:

At on that case the victim was at the neighbor’s house Mr. Aladin when he was
having a confrontation to the suspect about jealousy then suddenly the suspect
 wrestled and boxed the victim that resulted to a Elbow fractured and serious
head trauma herein the suspect violated the Article 263 of the Revise Penal
Code of the Philippines states that the any person who shall wound, beat, or
assault another shall be guilty of the crime Serious Physical Injury.

V. CONCLUSION:

The investigator concluded that the suspect violated the law as prescribed in the
recent discussion. Therefore, it is necessary to file a Serious Physical Injury case
against her.

VI. RECOMMENDATION:

WHEREFORE, in view of the foregoing, the undersigned respectfully

recommends that this case be considered solve and close.
