I hereby certify that all information supplied by me prior to the execution of this employment contract is accurate

Dear Mr. Azonwu,

SEAFARERS EMPLOYMENT AGREEMENT


We hereby renew our contract with you for the position of an Able Seaman on board Ava J. McCall, a vessel
owned and managed by Strickland Services Limited on the following terms and conditions of employment,
recognizing Akuned Inventive Business Solutions Limited as Employer/Company, and you as Employee.

This Agreement is made on this 17th of December 2023, between

Akuned Inventive Business Solutions, No: 18 Fatai Kaffo Street By Agungi Lekki Phase 2, Lagos Nigeria, (hereinafter
referred to as the “Company’’)
and
Azonwu Emmanuel Chukwunonye, No 47 Emekuku Street, D/line Port Harcourt. Rivers State, Nigeria (hereinafter
referred to as the “Employee”) (date of birth 25th December, 1983).
• Place of Engagement and Disengagement: Port Harcourt or Lagos
• The company engages the employee to serve on board vessels to which it shall designate.
• The work rotation shall be two months on/one month off duty. However, in extenuating circumstances,
the period of stay on board may be reduced or extended beyond the period.
• Employee undertakes to serve the Company in the capacity of AB commencing from the 19th of December
2023 or at a later date. This contract is valid for two months but payments are only made when on duty
except those who receives part payment when on time off.

1. REMUNERATION & BENEFITS


The Employee shall be entitled to receive from the Company for performing his duties under the terms of this
agreement a monthly net pay of N220,000, but when not up to 30 days, we would apply a daily rate of N7,333.33.

Your monthly pension, when on board is N15,749.10. This is a function of the number of days worked.

Remuneration becomes payable from deployment date to vessel. If your resident is within the port of embarkation, you
are expected to be on board before 9am otherwise no payment for that day. Contract is for Two-months period.

a. Employee shall be entitled to 100% of monthly net salary prorated to 30 days, whenever on duty.
b. Employee shall be entitled to 25% (this is not automatic as your performance on board will
determine if you are qualified for this or not) of monthly net salary when Off Duty and vessel is on
contract. Though, the off time payment ceases to be effective immediately contract is terminated.
Within these two months off time/standby all mandatory certificates has to be valid.
c. Employee shall be entitled to a crew change (sign on/sign off) allowance of N15,000.00 (depending
port of boarding)
d. No overtime work shall be considered for any work performed in case of emergency affecting the safety
of the vessel, passengers, crew or cargo of which the Master shall be the sole judge or for fire boat or
emergency drill work required to give assistance to other vessels or persons in immediate peril.
e. Employer shall provide Employee all needed Personal Protective Equipment (PPE) suitable for its work
(once a year). In the event that PPE gets missing, Employee will be charged for such replacement by
Employer.
f. Employee shall be provided with adequate accommodation free of charge by vessel owner while serving
on-board the vessel.
g. Employee shall be provided with ------------ daily as feeding allowance as vessel operations shall determine.
h. Employee shall obey lawful orders given by the Master and shall not engage in any other business.
i. In the event of illness or injury to the Employee arising out of and in course of his employment not due to
his wilful misconduct and occurring while on duty or in the course of duty, the Company will provide
Employee with free medical attention including hospital treatment. In above case but provided that illness
or injury was not due to in part or whole to his wilful fault, misconduct or negligence, compensation
benefits s h a l l b e paid to the Employee in accordance with the limitations of the Workmen’s
Compensation Act.
j. In the event that Employee becomes injured on board and has to disembark as a result of it, Employee
will be paid remuneration until repatriated.

2. MEDICALS

Employee shall be provided Medical Cover covering Employee, spouse and up to four (4) children below the age
of 18 years, at Company designated hospitals. This medical cover is exclusive of Eye glasses, Tooth extration and
Child delivery.

3. HOURS OF WORK:

Your hours of work will be arranged such as to ensure that you receive a minimum of 10 hours available for rest in
each 24-hour period and a minimum of 77 hours rest in each seven-day period. This minimum period of rest may
not be reduced below 10 hours except in an emergency.

You may be required, at the absolute discretion of the Master, to work additional hours during an emergency
affecting the safety of the ship, its passengers, crew or cargo or the marine environment or to give assistance to
other ship or persons peril. You may also be required to work additional hours for safety drills such as musters,
fire-fighting and lifeboat drills. In such circumstances you will be provided subsequently with (a) compensatory
rest period(s).

4. DURATION AND END OF CONTRACT

This contract is durable for six (6) months and shall terminate thereafter on the eve of the anniversary of the
commencement date, first above written.

5. TERMINATION OF EMPLOYMENT

a. Either party may terminate the agreement by giving a minimum of two weeks written notice or one-week
salary in lieu of notice, except where employment may be terminated forthwith without notice in
accordance with clause (5b)

b. The Company may terminate the employment of a Seafarer without any notice and without further
liability on our part, for:

I endangering the safety of the Vessel or himself or of his colleagues.


ii. exhibiting lack of competence that is inconsistent with his qualifications.
iii. breaching of the Company’s or Vessel owner’s Health, Safety, Environment
System or Drug & Alcohol Policy.
iv. gross negligence or misconduct.
v. suppression or misrepresentation of any materials and/or particulars at the
time of appointment including production of false documents or certificates;
vi. theft or any act causing financial loss to the company
vi. persistent breach of contract for which he/she has been given prior written
notice.
6. REPATRIATION

The Seafarer shall be entitled to repatriation at the company’s expense under the following circumstances while
abroad:

a) After the completion of the number of days of continuous service on board;


b) When signing off in the event of sickness, injury or other medical condition;
c) When signing off due to discharge by the Vessel’s owner;
d) Upon loss, laying-up or sale of the Vessel unless the Company decides to transfer the Seafarer to another
Vessel on comparable terms and conditions for the remaining Contract Term;
e) If the Vessel has been arrested and has remained under arrest for more than 21 days;
f) If the Seafarer validly terminates his employment hereunder.
g) In the event of a ship being bound for a war zone to which the seafarer does not consent to go.
h) In the event of termination or interruption of employment in accordance with an industrial award or
termination of employment for another reason.

i) The repatriation destination may be the Seafarer’s home country, place of original engagement, or such
other place as mutually agreed.

6.1 Where repatriation has taken place as a result of a seafarer being found, in accordance with national
regulations, to be in serious default of his/her employment obligations, the Company shall have the right of
recovery from the seafarer of repatriation costs or part thereof.

7. APPRAISALS
Employee shall be appraised at the end of each work period on the Vessel. Employee shall be evaluated by the
Captain or other designated officer on board. Employee shall be entitled to a copy of the evaluation.

8. MISCELLANEOUS
Entirety. This agreement constitutes the entire agreement between Employee and Company.

9. GOVERNING LAW
This Agreement shall be governed by, construed and enforced in accordance with the laws of the Federal Republic
of Nigeria.

I confirm that the Employee has been informed of his right and duties under this agreement prior to or in the
process of the Employees engagement onto the vessel;
