STATEMENT OF FACTS
X. Y and Z were illegally cutting Sal tree in a reserved forest. A, a female forest guard, went
to the reserved forest to check on the illegal falling of trees.
While patrolling A saw X, Y and Z cutting the trees, she demanded to see a permit or any
document from them. They rebuked and threatened A, who kept quiet and tried to retreat
Thereafter, they stopped cutting the trees and chased A with their axes in their hands. To stop
A, X gave a blow with the handle side of the axe on her leg, due to which she fell on the
ground.
When she tried to fight back, Y and Z tried to stop her by holding her down to the ground and
X hit her head with his axe's handle and then gave her a blow on her legs with his axe.
Y and Z tied her down and gave her a few punches. A died due to her head injury. They
removed her uniform and her belongings from her body.
Then X, Y and Z raped her. After this, they chopped her body with their axes to smaller
pieces and then buried her body parts in various different locations in the forest.
They smashed her face with a boulder so that she won't be recognised.
At last, they took her belongings along with her uniform and went back to Y's house. There
they lit her belongings and uniform.
They cleaned their axes with Hydrogen peroxide, which was brought to them by Z's brother
P. P took the chemical from the drugstore he used to work in without informing the store
owner.
X, Y and Z then left the area and went to their villages for a few months.
ISSUES
1. Discuss the criminal liability of all the person involved in the case according to the
provision of Indian penal code.
2. What will be the possible punishment given to the offender in these case according to the
Indian penal code?
