TENANCY AGREEMENT

THIS DEED OF AGREEMENT is entered into at ………………. on 17th


Sep 2023.

BETWEEN
Mr., ………, (Here in after called the OWNER) which expression shall, unless repugnant to
the context and meaning include his heirs, successors, administrators and assigns) of the
ONE PART .

AND

Mr……………., (Here in after called the TENENT), which expression shall, unless
repugnant to the context and meaning, include its successors and assigns) of the OTHER
PART.
NOW THIS DEED OF RENTAL AGREEMENT WITNESSETH as follows,

1. The Owner has this day, let out to the tenant, Second Floor of the Flat No S2-North
Facing more fully described in the schedule hereunder and the tenancy shall be computed
according to the English Calendar month on a monthly basis, and the rent payable by the
tenant to the Owner is The monthly rent is Rs.7,000/-(Rupees Seven Thousands only) and
an amenity charges for the flat is Rs.5,000/- (Rupees Five Thousand only) totally
Rs.12,000/Month and Maintenance Charges will be Initially Rs.500/Month fixed (this may
vary when full Maintenance will takes place) payable on or before the Fifth of every
succeeding English Calendar month. Maintenance Charges will be paid directly to the
association of Flats as actual.

2. This tenancy shall come in to effect from 17 th day of Sep 2023, and shall be in force for a
period of ELEVEN months only.(17.09.2023 to 17.08.2024), Period will extendable up to a
period of one more calendar year based on the mutual understanding with the following
conditions.

3. The tenant has paid this day to the House Owner a sum of Rs.60000/- (Rupees SIXTY
THOUSAND ONLY) as ONLINE TRANSFER for advance Payment of non payable
interest as a Security deposit/Caution deposit and the receipt of which the owner hereby
admits and acknowledges.

4. The said rental advance of Rs.60000/- (Rupees SIXTY THOUSAND ONLY) is


refundable at the time, when the tenant hands over the vacant possession of the tenant
premises to the House Owner and the said amount shall not carry any interest. Under no
circumstances the rental advance shall be adjusted towards the monthly rent payable by the
tenant to the House Owner or any rental arrears. The tenant shall handover the house to
the owner in a good condition as he/she received while taking for rent.

5. The Tenant shall use the premises for residential purposes only.

6. The Tenant shall not sublet the tenanted premises either directly or indirectly.

7. The tenant shall not commit any acts of wastes etc, in the tenanted premises and shall
allow the House Owner or his authorized agents to inspect the premises at his intimation.

8. The Tenant shall also give one month advance notice, if the tenant desires to vacate.
However this clause does operate in the event, the House Owner requires the premises for his
own use and occupation during the subsistence of the period of lease.

9. The tenant and the House Owner hereby agree that this rental agreement shall be in force
and valid for a period of eleven months only and shall be renewable on mutual terms and
conditions, to be agreed up on.

10. The tenant shall be liable to pay the Electricity consumption charges as per the respective
meter and the Maintenance of cleaning the common areas will be the tenant responsibility
and also these areas should be neat and clean at all the times.
11. The tenant shall also be liable to maintain the building common areas such as car park,
staircase with neat and clean at their own cost. The services so extended by the association of
six units tenant to clean both water sumps at their own cost to be shared among yourself.

12. The tenant shall also be effecting payment of Telephone Bills regularly on demand, if you
get the govt. telephone connection.

13. The tenant shall not make any additions, alterations or changes in the tenanted premises
without the prior permission of the House Owner or his legal representative.

14. The tenant also hereby agrees not to create nuisance or misuse the common places of the
said premises.

15. The tenant also hereby agrees to adhere to the stipulation set out by the Association in
respect of common places.

16. The tenant shall give 30 day’s notice prior to the expiry of this agreement, in writing to
the House Owner of his intention to extend the tenancy for a further period and the House
Owner reserves the rights to either extend the tenancy for a further period or reject the request
of the Tenant. However if the House Owner agrees to renew the agreement, the tenant in such
event hereby agrees to pay the monthly rents at an enhanced rate of 10% to 20% over and
above the existing rates. The period of extension if any shall be decided by way of mutual
agreement. In case the tenant is vacating he/she is entitled to pay the painting and cleaning
charges of Rs.10000/-.If he/she stays more than two calendar years, this amount will not
arise.

17. The Tenant agrees not to do or permit anything to be done in or upon the premises or any
part thereof which may be or become a nuisance, annoyance or damage to the building if they
keep domestic animals like Dogs/Cat.

18. In the event of breach of any one or more of the conditions of this agreement by the
tenant the House Owner shall be entitled to terminate this tenancy by issuing the tenant a
notice to quit and thereafter initiate suitable proceedings for loss/damage or compensation.

19. The tenant by paying the rent regularly and on observing and performing on his part the
several covenants and stipulations contained herein shall peacefully hold and enjoy the
tenanted premises without any interruption by the House Owner or persons or agents acting
through the House Owner.

20. The tenant also hereby agrees that the payment covered under item 10, 11, & 12 is
governed under the meaning of Rent any default or arrears shall be considered as default.

1 The tenant also hereby agrees that any replacements of light bulbs or minor repairs for the
components on usage shall be carried out by him at his charge.

22. The House Owner and the Tenant hereby agree that any other item of liability arise in
course of time may be settled mutually as required

Bedroom-Ward robe in Each Flat).
