Beginning of the Legal Process. The court session commences with the court
bailiff – an official who assists the judge. Everyone is asked to rise when the judge
enters, and then to be seated when the judge takes their place. The judge announces
the case aloud (e.g., Brown v. Green; State v. Blue) and asks the attorneys for each
side if they are ready to commence proceedings. If the case involves a jury trial,
the process begins with the selection of the jury.
Opening Statements. After the jury is selected and sworn in, attorneys for
both sides make what are called opening statements. The attorney for the plaintiff
(or the prosecutor in a criminal case) goes first. An opening statement is a
presentation of the facts of the case that the party intends to prove, and the
evidence they hope to prove it with.
