Areas of law that applies in the case

This case discusses about a family man who died due to novel coronavirus at a nursing

home in Ontario and the family filed a lawsuit against them due to the medical

negligence. The case was filed in Ontario Superior Court against Southbridge Care

Homes and its 294 bed Orchard Villa Long-term care and retirement home, where the

new coronavirus has infected at least 96 employees and 225 residents, killing at least

72 individuals. Former resident Paul Parkes died on April 15 at the long-term care

home, according to his family, as a "direct result" of carelessness and violation of

contract. 39 serious allegations were made in the claim against Ontario home including

they failed to take proper precautions to protect the residents. The defendants in this

case were identified as Southbridge care homes and the plaintiff are Cathy parks and

other family members. (Mariam. k)

Legal issues that are outlined.

The family of Parks observed that he was not well while speaking to them and they

were later informed that another person tested positive. Even after the outbreak it was

claimed that the residents were still eating meals together. It reveals the care homes'

negligence as well as a breach of the Retirement Homes Act, resulting in a violation of

the health law. (Mariam. K)

In the claim, it is also proved that the home reportedly failed to hire "adequate" staff to

care for residents, to provide proper training and supervision for employees, and to

implement a code of conduct. It also claims that the home failed to create a sufficient
COVID-19 response plan, communicate with families about suspected positive cases of

the virus, and conduct proper visitor screening.

This proves that the patient at the Southbridge care homes were physically as well as

mentally tortured as Mr. Parks was not even allowed to talk with his family in his last

days.

Healthcare Practices that impact the case.

The healthcare practices that could impact the case include human resource, strategic

planning and operational.

 Human Resource: Around 75 people lost their lives due to the carelessness of

the care home. They failed to perform regular assessments to ensure that any

changes in the patient’s condition were observed, recorded, reported to other

staff/supervisors and/or the physician in charge.

 Strategic Planning: the claim proves that the long-term home did not took

adequate measures to handle the flu outbreak that affected the patients as well

as the staffs. It is also proved that the care home dd not provided adequate

personal protective equipment’s for the visitors, residents as well as the staffs.

 Operational: the care home was not well operated. The staff were irresponsible

and were not collaborative. The lawsuit claimed that the patients were not

allowed to talk with the family members, and they were endured pain and

suffering and lost their enjoyment in their last days.


My Perception

As a healthcare leader I will take adequate measure to implement the practice as it

affects the life of another individual. I will take this matter seriously and put in place a

few standardised practical methods for both staffs and patients. I will find out the root

cause of the prison crisis and intervene as quickly as possible. I will also put in place

some additional safety procedures for all employees and residents.
