commencement.

3. Definitions.
In exercise of the powers conferred by the proviso to article 309 of the
Constitution of India, the Governor is pleased hereby to make the
following rules, namely:~
Rul
(1) These Rules may be called the West Bengal Civil Service
(Executive) Officers’ (Pay) Rules, 2021
(2) It shall be deemed to have come into force with effect from 1%
January 2021
(1) Save as otherwise provided by or under these rules, these rules
shall apply to persons appointed to the West Bengal Civil Service
(Executive) cadre appointed in accordance with the Rule 4 of
the West Bengal Civil Service (Executive) Recruitment Rules,
1978.
(2) Unless specifically extended under express order of the
Government, these rules shall not apply to —
(a) a member of the service who has retired on or before the
afternoon of the 31" December, 2020, and
() a member of the service who has been re-employed after
retirement
In these rules, unless the context otherwise requires:
(2) “Basic pay’ means the pay drawn or liable to be drawn by an
officer in the revised pay structures as determined under the
West Bengal Services (Revision of Pay and Allowance)
Rules, 2019,
(b) “benchmark score of Seif Appraisal Report’ shall mean the
minimum numerical weighted mean score arrived at fromoverall grading of Self Appraisal Report of last five years from
the material point of time, scoring above which an officer shall
be regarded as fit for advancement or empanelment, as the
case may be, to the next higher grade;
(c) “cadre" herein shall mean the West Bengal Civil Service
(Executive) cadre:
(4) “Cadre Officer” means an officer of the West Bengal Civil
Service (Executive) cadre recruited under West Bengal Civil
Service (Executive) Recruitment Rules, 1978;
(e) ‘departmental examination’ means such examination
conducted under West Bengal Services (Training &
Examination) Rules, 1953 the passing of which under his
service rules is a precondition for confirmation in the service in
order to be eligible to be confirmed in the service;
(f) "Direct Recruit” means a member of the cadre appointed
directly through competitive examination conducted by the
West Bengal Public Service Commission in accordance with
the Rule 4(1)(a) of West Bengal Civil Service (Executive)
Recruitment Rules, 1978;
(g) ‘existing scale” means, ~
(in relation toa member of the cadre, the existing scale
applicable to the post held by the him or, as the case may
be, the personal scale applicable to him on the date of
Notification of this rule, on account of his advancement or
empanelment to a higher scale under specific or general
orders of the Government, whether in a substantive or
officiating or temporary capacity, and
(li) in the case of a member of the cadre, who was on the date
of notification of this rule, on deputation or on foreign
service or on leave or who would have on that date
officiated in one or more lower posts but for his officiating in
a higher post, the scale of pay applicable to the post which
he would have held;(h) “Existing Emoluments* means the sum of exi

(i) “Level in the pay matrix” shall mean the level corresponding to
the existing pay band and grade pay as specified in schedule
of the West Bengal services (revision of pay and allowances)
Rules, 2019,
@) “Promoted Officer’ means an officer appointed to the West
Bengal Civil Service (Executive) in accordance with the
methods stipulated in clause (b) or clause (c) of sub-rule (1) of
Tule 4 of the West Bengal Civil Service (Executive) Recruitment
Rules, 1978 as amended;
(k) “Pay matrix’ means matrix specified in schedule i and schedule
ji with levels of pay arranged in vertical cells as assigned to
corresponding existing pay band and grade pay as mentioned
in West Bengal services (revision of pay and
allowances)Rules 2019.
()) *Pay" in the level means pay drawn in the appropriate cell of
the level as specified in schedule-| and schedule-II_ as
mentioned in West Bengal services (revision of pay and
allowances)Rules,2019.
(m) "Member of the Service" means a member of the West Bengal
Civil Service (Executive) cadre;
(n) "Schedule" means a Schedule appended to these rules, which
‘would be considered to be an integral part of this rules;
(0) “Service” means the West Bengal Civil Service (Executive)
service;
(p) “Government” means the Government of West Bengal;
(q) “Special Pay" shall be as defined in the West Bengal Service
Rule Part | and as amended time to time.Note 1- terms and expressions not defined in these rules shall
have the same meaning as respectively assigned to them in the
West Bengal Services (Revision of Pay and Allowance) Rules,
2019, West Bengal Service Rule Part |, West Bengal Service
Rule Part Il, West Bengal Services (Training & Examination)
Rules, 1953, West Bengal Civil Service (Executive) Recruitment
Rules, 1978 and such other relevant rules or order or as
amended time to time.
Note 2- The benchmark score applicable to the members of the
service for advancement to a higher grade shall be such
numerical value as noted against respective grade mentioned in
‘Schedule |.
4. Scales of payon —_The scales of pay admissible to a member of the Service under the
appointment and — West Bengal Services (Revision of Pay and Allowance) Rules, 2019,
subsequent shall be as follows:

higher levels. _(1)(a) Entry level / Junior Scale On being appointed as a member of

the Cadre, his pay will be fixed at level 16 in the Pay Matrix in
‘accordance with the method and schedule as specified in West
Bengal Services (Revision of Pay and Allowance) Rules, 2019
‘or any other Rules or Notification issued by the Government
from time to time.
Senior Time Scale- An officer, confirmed in the service under
the provisions contained in The West Bengal Services
(Appointment, Probation and Confirmation) Rules, 1979 and
after satisfactory completion of eight years of service shall
move to the level 17 in the Pay Matrix of West Bengal Services
(Revision of Pay and Allowance) Rules, 2019 as career
advancement provided he has achieved the prescribed
benchmark score of Self Appraisal Report.
On such advancement, his Pay in this level shall be fixed in
accordance with the method and schedule specified in West
Bengal Services (Revision of Pay and Allowance) Rules, 2019,awarding him two adcitional increments in the higher level, in
‘addition to the normal increment admissible in the lower level to
the officer as per West Bengal Service Rule Part |
Having appointed in this level, the cadre officer shall be
designated as Deputy Secretary when posted at the Secretariat
and equivalent to the rank of Deputy Secretary when posted
outside the secretariat and will get all the entitlements, rank and
status, applicable with this designation.
(c) Junior Administrative Grade - An officer, after satisfactory
completion of Sixteen years of service, shall move to the level 19
in the Pay Matrix of West Bengal Services (Revision of Pay and
Allowance) Rules, 2019 as career advancement provided he has
achieved the benchmark score of Self Appraisal Report,
On such advancement, his Pay in this level shall be fixed in
accordance with the method and schedule specified in West
Bengal Services (Revision of Pay and Allowance) Rules, 2019
awarding him two additional increments in the higher level, in
Addition to the normal increment in the lower level admissible to
the officer as per West Bengal Service Rule Part |
Having appointed in this level, the cadre officer shall be
designated as Senior Deputy Secretary when posted at the
Secretariat and equivalent to the rank of Senior Deputy Secretary
when posted outside the secretariat and will get all the
entitlements, rank and status, applicable with this designation.
(2) Subject to the availability of vacant posts in the relevant Levels,
eligible officers of the cadre shall be appointed to the next higher
Levels in the Pay Matrix, as given below, in the following manner
(i) Selection Grade- Level 21 in the Pay Matrix
(i) Senior Selection Grade- Level 22 in the Pay Matrix
(i) Super Time Scale- Level 24 in the Pay Matrix
Provided that appointment of a member of the cadre to a higher5. Administrative
Special
level shall be made-
(@) with due regards to seniority of the officers in the cadre as per
civil list published and updated from time to time by the cadre
controlling authority,
(b) Achieving required benchmark score of Self Appraisal Report
and clearance of the officer from vigilance's angle.
Provided further that an officer of the cadre, even s/he is
otherwise eligible, shall not be promoted to next higher level if he
has not completed satisfactory service of 2 (two) years in his level
of Pay Matrix.
Provided also that, If the State Government in the Department of
Personnel and Administrative Reforms considers it expedient to
do so in the public interest, it would be empowered to relax the
mandatory condition of minimum service mentioned in the First
Proviso above.
(3)(@) An officer of the Cadre, on being appointed to the Levels
mentioned in Rule-(4)(2) by progression, and posted in the State
Secretariat shall enjoy the following designations:-
(i) At Level 21 in the Pay Matrix- Joint Secretary
(i) At Level 22 in the Pay Matrix- Additional Secretary
(ili) At Level 24 in the Pay Matrix- Special Secretary
Provided that when an officer is posted outside the secretariat he
will enjoy same rank and status and all the entitlements enjoyed
by an officer of respective level, who may be posted in the State
Secretariat.
Pay of an officer who is appointed to any of the levels mentioned
in Rule-(4)(2) by advancement, shall be fixed in each level in
accordance with the method and schedule specified in West
Bengal Services (Revision of Pay and Allowance) Rules, 2019
and awarding him two additional increments in the higher levels,
in addition to the normal increment admissible in the respective
lower levels to the officer as per West Bengal Service Rule Part |
An officer of this cadre shall be eligible to draw Leave

Schedule Il or any other Notification issued by the Government
time to time modifying the entitlement or the Schedule II as the
case may be.
‘An existing officer of the cadre shall continue to enjoy all the
existing emoluments as he/she has been enjoying immediately
before the date of effect of these Rules.
The initial pay of a direct recruit shall be fixed at the minimum of
the Entry Level officers in such manner as has been described in
Rule 42 of the West Bengal Service Rules (Part-!) in the
appropriate level of the Pay Matrix under in the West Bengal
Services (Revision of Pay and Allowance) Rules, 2019.
In cases of fixation of pay of an officer who has been appointed
(on Promotion to the West Bengal Civil Service (Executive) cadre,
his pay would be fixed in the manner described in rule 42A of the
West Bengal Service Rules (Part).
A direct recruit member of the service, during the period of his
Probation shall be eligible to draw his increments as per rule 13 of
the West Bengal Services (Training & Examination) Rules, 1953.
Provided that, rule 14 of the said rules shall govern the manner of
increment of a member of the service promoted in the cadre in
accordance with the methods stipulated in clause (b) or clause (c)
Of sub-rule (1) of rule 4 of the West Bengal Ci
(Executive) Recruitment Rules, 1978,
The rate of increment shall be regulated in accordance with the
‘West Bengal Services (Revision of Pay and Allowance) Rules,
2019 or any other Rules for the time being in force or in such
manner as specified by the Government time to time.
‘The number of additional increments for the officers of the cadre
shall be regulated as per the provisions mentioned in Rule 4.10. Overriding effect
of these Rules.
11. Power to amend
schedule,

difficult
13. Power to give
relaxations.
The provisions of these Rules shall have effect notwithstanding
anything to the contrary contained in any other Rules, Schemes,
Orders or Notifications for the time being in force and all such
Rules, Orders or Notifications governing the service conditions of
this cadre.
Government in the Department of Personnel and Administrative
Reforms would be empowered to amend any of the schedules or
Part thereof, in the public interest with the approval of appropriate
authority
If any difficulty arises in giving effect to the provisions of these
rules, the State Government may, by Notifications, remove such
difficulty with a view to clarify the provision of the rules.
If the State Government is satisfied that the operation of any of
the provisions of these rules causes undue hardship to any
member of the service, it may, by order, dispense with or relax
the requirement of any of these rules to such extent and subject
to such conditions may be consider necessarySchedule -I

The following procedure will be adopted for calculation of five years’ average rating
including SAR 2017-18 onwards:
SARs with overall grading outstanding (8.01 to 10 ) will be given a score of 9
SARs with overall grading very good (6.01 to 8 ) will be given a score of 7
SARs with overall grading good (4.01 to 6 ) will be given a score of 5
SARs with overall grading average/below average (2.01 to 4/0 to 2 ) will be
given a score of 0Schedule — 1

1, Cash Compensation to all the Block Development Officers of the State which will
be equivalent to 30 (thirty) days of their Pay and Dearness Allowances for every
completed year of service as on 30th June of every year or on pro-rata basis for the
completed months of service.
