WAIVER and/or ASSIGNMENT OF RIGHTS OF A RESIDENTIAL LOT

KNOW ALL MEN BY THESE PRESENTS:


Whereas I, DIALODIN ASI GUIAMBANGAN, of legal age, married, Filipino, and a resident of
Barangay Sta. Clara, Kalamansig, Sultan Kudarat, known here a FIRST PARTY, is the lawful owner and legal
possessor of a lot being a portion of Lot No. 1534, Pls-504, situated at Barangay Pag-asa, Kalamansig, Sultan
Kudarat, with an area of 1,800 sq. meter, more or less and bounded as follows: on the North by Road; on the
South by Shoreline; on the East by Lot ______; on the West by Lot _________;
Whereas the FIRST PARTY derived her rights and interest form his late father Datu Samad
Guiambangan and Dialodin Asi Guiambangan being his predecessor-in-interest who had declared for tax
purposes and covered by Original Certificate of Title No. _________of the Register of Deeds for the Province
of Cotabato, now Sultan Kudarat;
Whereas I, ANNABIL PELARE SAIDIMAN, of legal age, married, resident of Pag-asa, Kalamansig,
Sultan Kudarat, hereinafter designated as SECOND PARTY, is desirous of having a residence in Barangay
Pag-asa, Kalamansig, Sultan Kudarat;
Whereas the FIRST PARTY has offered his right and interest over the above indicated property to the
SECOND PARTY way of waiver and/or assignment of right in the area being part of an area even without the
corresponding approved survey plan;
Whereas both parties are s aware about the on-going case in Court for Reversion Proceeding filed by
the Republic of the Philippines against the Sumangumbra and Guiambangan heirs over a 42 hectares land
which include the property subject to this Waiver;
That for and in consideration of PESOS: NINE HUNDRED THOUSAND PESOS [P900, 000.00]
Philippines Currency, receipt to which is hereby acknowledged for my satisfaction, I DIALODIN ASI
GUIAMBANGAN, the FIRST PARTY hereby WAIVES, ASSIGNS, CONVEYS and TRANSFERS my rights to,
participation in and interest thereto unto ANNABIL PELARE SAIDIMAN, hereinafter designated as SECOND
PARTY, to his heirs, successors and assigns the a portion situated at Barangay Pag-asa, Kalamansig, Sultan
Kudarat, with an area of 1,800 sq. meter, more or less and bounded as follows: on the North by Road; on the
South by Seashore; on the East by Lot ______; on the West by Lot _________; whose area and location has
been mutually identified by the parties; with a dimension of 20 meter by 90 meter;
The FIRST PARTY hereby warrants and represents that the execution, delivery and performance of
this Waiver and/or Assignment of Rights on the land do not and will not violate any provisions of law,
regulations of governmental directives applicable to the FIRST PARTY and do not and will not violate any
agreement to which the property is bound, if any;
That upon the signing of this document, the SECOND PARTY his/her heirs and assigned shall now
take possession over the property waived or assigned which the area and location was mutually identified by
the parties free form liens and encumbrances;
The parties hereto respectfully warrants that their authorities to enter into this Deed/Waiver/Assignment
is valid and binding and that they have been fully informed, have thoroughly understood, and have consented
to, without reservation, to the terms and conditions in this Assignment and/or Waiver of a portion of land.

IN WITNESS WHEREOF, the parties have hereunto set their hands on April 8, 2024.
