1. That the Petitioners are law abiding citizens of India and are filing

the present petition under section 482 of Criminal Procedure Code

seeking to invoke the inherent powers of the Hon’ble High Court

and praying inter-alia for quashing of the F.I.R. No.: 97/2016, P.S.:

Civil Lines, Allahabad (Prayagraj), Uttar Pradesh, U/S: 498A/

420/406/313/504/506 IPC & 3/4 Dowry Protection Act and the

consequential proceedings/investigation arising out of the said

F.I.R. The facts leading to the filing of this writ petition are

presented in brief in the succeeding paragraphs.

2. That the marriage between Petitioner no. 3 and Respondent no. 3,

was solemnized according to Hindu rites and rituals on 28.06.2012

and marriage was registered on 30.06.2012 and there is no issue

out of the wedlock.

3. That certain matrimonial differences arose between Petitioner no. 3

and Respondent no. 3. Pursuant whereto Respondent no. 2 lodged a

F.I.R. No 97/2016 dated 18.02.2016 under Section 498A, 323, 504,

313, 406, 420 506 IPC and Section 3/4 Dowry Prohibition Act,

1961 at Police Station Civil Lines, Allahabad against the Petitioners.

The true copy of the F.I.R. along with its true typed translated copy

is annexed herewith as ANNEXURE A

4. That the F.I.R. No. 97/2016, Police Station Civil Lines, Allahabad

and all proceedings emanating out of it were transferred to the

courts of Delhi vide order dated 18.07.2017 passed by the Hon’ble

Supreme Court of India and the said proceedings were registered

before Chief Metropolitan Magistrate, Tis Hazari Courts as

5. That the marriage between Petitioner no. 3 and Respondent no. 3

has been dissolved vide judgment and decree dated 03.06.2016

passed by the Family Court at Bury St. Edmunds in BV15D16530

titled as “Chandan Sharma Vs. Aprajita Tripathi” and further been

dissolved vide the judgment and decree dated 07.05.2019 passed

by the Hon’ble Court of the Addl. Principle Judge, Family Court,

Allahabad in HMA No. 718/2016 titled as “Mrs. Aprajita Tripathi

Vs. Mr. Chandan Sharma”.

6. That the Petitioner no. 1 and no. 2 have been charged for offence

under section 406 IPC and the Petitioner no. 3 and no. 4 have been

discharged by the Ld. Trial Court, Central, Tis Hazari Courts, Delhi

vide order dated 25.09.2019.

7. That all the Petitioners are related and are in-laws of the

Respondent no. 3, as mentioned in the memo of parties and as

such are known to each other. With the assistance of the Mediator

and proactive participation of the counsels for the Parties have

voluntarily arrived at an amicable solution resolving the all their

disputes and differences and also with regards to Stridhan,

maintenance (past, present and future), permanent alimony and

compromised with each other vide a Mediation Settlement,

Samadhan, Delhi High Court, dated 09.10.2023. The true copy of

the Mediation Settlement Tis Hazari Courts, Delhi dated

09.10.2023 is annexed herewith as ANNEXURE B. Furthermore,

the Respondent no. 3 has also given her affidavit that she has no

objection if the present F.I.R. against the Petitioners is quashed.

The affidavit of the Respondent no. 3 is annexed herewith

ANNEXURE C.

8. That as per the Mediation order dated 09.10.2023, it has been

agreed that Respondent no. 2 and Respondent no. 3 or any

member of the Respondent no. 3 shall not claim anything from the

Petitioners specially Petitioner no. 3 towards her maintenance

(past, present and future) or permanent Alimony.

9. That the Petitioners through this petition seeks to invoke the

inherent jurisdiction of this Hon’ble Court to quash the F.I.R. and

the consequential proceedings arising from the said F.I.R.

mentioned herein above on the following amongst other grounds:

GROUNDS:

A. BECAUSE the matter has already been amicably settled and

compromised between the parties.

B. BECAUSE no useful purpose will be served by allowing the present

criminal proceedings to continue indefinitely in view of the

amicable settlement and compromise. Allowing the criminal

proceedings to continue would be an abuse of the process of the

court and moreover the Petitioners has already suffered enough.

C. BECAUSE it is well-settled law, that if proceedings are allowed to

continue where the trial would result in the acquittal of the

Petitioners, then the Court can quash the said proceedings. In

such circumstances, continuance of the proceeding would result in

wastage of the precious time of the Court.

D. BECAUSE the Respondent No. 2 and no. 3 and Petitioners have

withdrawn all allegations, which were levelled against each other

and settled their dispute. The Respondent No. 2 and no. 3 do not

want to pursue the criminal proceedings or any proceedings any

longer against the Petitioners.

E. BECAUSE the offences mentioned in the F.I.R. are non-

compoundable, however in view of the compromise and amicable

settlement of the matter/dispute between the parties, continuance

of the criminal proceedings would tantamount to infringement of

the liberty and the Fundamental right of the Petitioners if the relief

sought is not granted to the Petitioners.

F. BECAUSE in such situations when the Petitioners and Respondent

no. 2 and no. 3 have come to a mutual settlement, it is in the

interest of the both the parties and also for society as a whole that

the criminal proceedings be quashed.

G. BECAUSE if proceedings are allowed to be continued then there

cannot be any doubt that it will be an abuse of the process of the

court.

H. BECAUSE it has been time and again held by the Apex court that

where, in opinion of the court chances of ultimate conviction are

bleak and therefore no useful purpose is likely to be served by

allowing a criminal prosecution to continue. The Court may, taking

into consideration the special facts of the case, can quash the

proceedings, where it is expedient and in the interest of justice.

The Hon’ble Supreme Court has held in GIAN SINGH VS. STATE

OF PUNJAB (2012) 10 SCC 303 held that:-

“61. In other words, the High Court must consider

whether it would be unfair or contrary to the interest of

justice to continue with the criminal proceedings or

continuation of criminal proceedings would tantamount

to abuse of process of law despite settlement and

compromise between the victim and the wrongdoer and

whether to secure the ends of justice, it is appropriate

that criminal case is put to an end and if the answer to

the above question(s) is in affirmative, the High Court

shall be well within its jurisdiction to quash the

criminal proceedings.”

It was also held in MAHINDER SINGH V/S STATE OF PUNJAB

1993(2) CHANDIGARH CRIMINAL CASES , 444

“From the compromise deed and the affidavit

furnished by the Respondent it is made out that the

parties are no longer daggers drawn and what ever

dispute was there which resulted in the incident has

been settled amicably. The compromise is arrived at

without any threat or coercion by either side. It is

correct that some of the offences mentioned in the FIR

are non compoundable yet the court always lean in

the favour of compromise even in cases which are non

compoundable. This fact is not denied that non of the

injured suffered any grievous injury and remained as

indoor patient although the occurrence took place long

back yet challan has not been presented against the

parties the chances of conviction are bleak- Interest of

justice call for quashing – Petition allowed ”.

8. That the identity proof of the Petitioners and the Respondent no. 2

and Respondent no. 3 as well as their photographs have been

annexed here with as ANNEXURE D (COLLY).

9. That the Petitioners have no alternative remedy but to invoke the

inherent jurisdiction of this Hon’ble Court.

10. That the Petitioners reserves their right to argue any other point if

required, at the time of arguments.

11. That no such, similar or other petition is pending before the

Hon’ble Supreme Court or before this Hon’ble Court.

PRAYER

In the light of the above facts and circumstances, it is most respectfully

prayed that this Hon’ble Court may graciously be pleased to:

I. Quash the F.I.R. No 97/2016 dated 18.02.2016 under Section

498A, 323, 504, 313, 406, 420 506 IPC and Section 3/4 Dowry

Prohibition Act, 1961 at Police Station Civil Lines, Allahabad (Now

Prayagraj) and the consequential proceedings arising out of the

said F.I.R against the Petitioners,

II. Pass any Order(s), which this Hon’ble Court may deem fit and

WHEREAS the marriage between Aprajita Tripathi, daughter of the First


Party and Chandan Sharma S/o Sh. Ram Chand Sharma was solemnized
according to Hindu rites and rituals on 28.06.2012 and marriage was
registered on 30.06.2012 and there is no issue out of the wedlock.

AND WHEREAS certain matrimonial differences arose between Aprajita


Tripathiand Chandan Sharma pursuant whereto Sh. Satya Prakash (Party
1()) lodged a FIR No. 97/2016 dated 18.02.20 16 under Section 498A,
323, 504, 313, 406, 420 506 IPC and Section 3 /4 Dowry Prohibition Act,
1961 at Police Station Civil Lines, Allahabad against Chandan Sharma
(Husband), Ram Chand Sharma (Father in Law), Prem Lata Sharma
(Mother In law), Rajan Sharma (Brother In Law) and Arpna Sharma
(Sister In Law).

AND WHEREASthe FIR No 97/2016 and all proceedings emanating out


of it were transferred to the courts of Delhi vide order dated 18.07.2017
passed by the Hon'ble Supreme Court of India and the said proceedings
were registered before Chief Metropolitan Magistrate, Tis Hazari Courts as

video conferencing to record their statements before the Hon'ble High
Court of Delhi at New Delhi as and when the matter is listed for the
disposal of the aforesaid petitions in termns of this Hon'ble Court.

AND WHEREAS Ms. Aprajita Tripathi (Party No. 1(ii)) being a resident
of London, United Kingdom has joined the mediation sessions through

Agreement on her behalf which will be binding upon her vide Power of

AND WHEREAS Mr. Rajan Sharma (Party No. 2(iv)) and Ms. Arpna
Sharma (Party No. 2(v)) have through their Special Power of Attorney
dated 07.10.2023 authorized Mr. Ram Chand Sharma, (Party No. 2(i)) to
enter into and execute this Settlement Agreement on their behalf

(ANNEXURE-C).

AND WHEREAS mediation sessions were held with the parties and their
respective counsels on various dates physically and through video
conferencing.

The parties, with the assistance of the Mediator and proactive participation
of the counsels for the Parties have voluntarily arrived at an amicable
solution resolving the above mentioned disputes and differences on the
following terms and conditions:

a. That all the parties to the present Settlement Agreement have agreed to
settle all their disputes without any monetary consideration and
without any further litigation towards fu!! and final settlement of all
the disputes and claims of the First and Second Party:

b. That the parties agree that the First Party shall give no objection for

c. That Aprajita Tripathi, daughter of the First Party has agreed and
undertaken by way of her affidavit dated 22.09.2023 that she accepts
and affirms the terms and conditions of this Settlement Agreement,
that her family members have mutually and amicably settled all the
disputes and differences fully and finally, and without any
consideration and that no other or further disputes or claims survive
between her, Chandan Sharma and their respective families. She has
further stated in her affidavit that she has no objections to the quashing
of the FIR No. 97/2016 and any other consequential proceedings
arising out of the above said FIR before any authorityl Court in India
or abroad. She has further undertaken to abide by all the terms and
conditions of this Settlement Agreement. The said affidavit of Ms.
Aprajita Tripathiis annexed herewith as ANNEXURE-D.

d. That Sh. Ram Chand Sharma (Party No. 2(i1) for himself and on
behalf of his son Chandan Sharma has agreed and undertakes to not
dispute or challenge the judgment and decree dated 07.05.2019 passed
by the Hon'ble Court of the Addl. Principal Judge, Family Court,
Allahabad in HMANo. 718/2016 titled as Mrs. Aprajita Tripathi Vs.
Mr. Chandan Sharma wherein the marriage between him and Aprajita
Tripathi has been dissolved permanently.

e. That it is agreed between the parties that the parties shall request the
Hon'ble High Court of Delhi to dispose of all the matters CRL.M.C.
Nos. 1491/2018, 1618/2018, 1623/2018, 2578/2018, 2648/2018,

Agreement.

f. That the parties agree that they shall appear before the Hon'ble High
Court of Delhi physically or through virtual hearing to make their
statements in terms of the present Settlement Agreement. Further it is
agreed between the parties that Aprajita Tripathi and Chandan Sharma
will appear through VC before the High Court of Delhi at the time of
hearing for giving / recording their consent in terms of this Settlement
Agreement.

g. That it is agreed between the parties that if any of the party defaults
any of the terms and conditions mentioned in the present Settlement
Agreement, he/ she shall be liable for Contempt of Court in terms of
the Contempt of Courts Act, 1971.

h. That the parties herein confirm that there are no other litigations/
complaints pending other than the cases mentioned in this Settlement
Agreement.

i. That the parties agree that after execution of this Settlement


Agreement, both the parties shall be left with no claims or disputes
against each other and / or qua their family members.

j. That the Parties agree that they have arrived at the present Settlement
Agreement with their own free will and desire and without any
