The trial court in California dismissed the case due to the forum-selection
clause, but that decision was overturned by the Ninth Circuit Court of
Appeals because of the prior United States Supreme Court case, as well as
the prior California decisions holding that these clauses contravene strong
public policy. Because the clause was unenforceable, the parties were not
required to litigate the case in Virginia and the plaintiffs were able to
choose California as the location of the law suit.
