APPLICATION AGAINST VOILATION OF COURT ORDERS UNDER ORDER XXXIX RULE 2 (3) CPC
AGAINST VIOLATION OF ORDER DATED 02-03-2024, PASSED BY THIS LEARNED COURT.
Respectfully Sheweth,

1. That through the instant contempt petition, the petitioner humbly seeks indulgence of this
Honorable Court for initiating contempt proceedings against the respondents for violating order
dated 25-03-2024, passed by this Honorable Court, in case titled as Hamza Ajmal Butt versus
Nasir Ali wherein next date of hearing is 08-05-2024 whereby this Honorable Court was pleased
to grant interim relief to the petitioner in the following words:
“…. Learned Counsel of the petitioner annexed title documents which is also supported by
affidavit. therefore, in the interest of justice as per request of petitioner parties are directed
to maintain status quo regarding possession of suit property till next date ….”.
Copies of plaint and order dated 25-03-2024 passed by this Honorable Court are appended
herewith as Annex-A & B.
2. That the respondent no.01 is fully aware of the aforesaid restraining order passed by this
Honorable Court. Notices and summons have also been served upon them; moreover, the
petitioner also handed over aforesaid order to the respondents by hand.
3. That in spite of stay order in favor of the petitioner which is still intact, the respondent no 1 is
threatening the petitioner to disposes him from the suit property the help of ghoonda elements
and to materialize their evil designs, the respondent with connivance of ghoonda elements tried
to disposes the petitioner from the suit property and have stolen valuable items including LED,
Laptop Printer, inventor worth 1200,000.00 and around 130,000.00 in cash on 12-04-2024 at
about 2:00 pm illegally and unlawfully but timely intervention of people of the vicinity including
waqas butt s/o khalid mehmood and Imran Ramzan s/o Muhammad Ramzan resistance shown
by the petitioner, the respondents could not succeed in their evil designs.
4. That the respondents are continuously threatening the petitioner that they would dispose
him from the suit property and alienate the suit land to someone else.
5. That the attempt of the respondents to dispossess the petitioner from the suit property
amounts to contempt and violation of order passed by this Honorable Court and their acts show
sheer disobedience towards the sanctity of the orders of this Honorable Court.
6. That the order passed by this Court is very much in the knowledge of the respondents and
they are disobeying the orders of this Honorable Court willfully and intentionally just to
frustrate the process of the law.
9. That such a disobedient and willful attitude of the respondent has forced the petitioner to file
instant petition so that he might get justice from this Honorable Court as no other remedy is
available to him for the redressal of his grievance.
10. That the respondent has no respect for the courts and they did not take into account order
of the Honorable Court.
11. That the plaintiff has also submitted an application to defendant no 02 regarding the
criminal and illegal attempt to dispossess the petitioner from the suit property but no
proceeding has taken place till date.
12. That if contempt proceedings are not initiated against the respondent is not punished as
such, they will get encouraged and will keep on violating order of this Honorable Court.
PRAYER

In the aforementioned circumstances, it is humbly prayed that the instant petition may
be accepted and the respondents may be summoned and punished for violating the
order passed by this Honorable Court.

1. That I am the plaintiff in the above noted case and am well versed with the facts of the case, and as
such, am competent to depose to the same.

2. That the accompanying application under Order 39 Rules 1 & 2 read with section 151 CPC has been
drafted under my instructions. The contents stated therein are true and correct to my knowledge, and
the same may be read as part and parcel of this affidavit.
