JOINT AFFIDAVIT OF ARRESTING/SEIZING OFFICERS


We, Pat Arianne Billy Liwanag and Pat Christan Josh Genessis U Doniego,
both of legal age, married and presently assigned with Philippine National Police - Drug
Enforcement Group (PNP-DEG), Special Operations Unit 4A with Office address at Camp
Vicente Lim, Brgy. Mayapa, Calamba City, Laguna, after having duly sworn to an oath in
accordance with law do hereby depose and state that:

1. On April 22, 2024 at about 8:00 A.M., while the undersigned together with PLT
ELISEO A MARTIREZ and other team members were rendering our duties and
responsibilities in our Office, one (1) of our Regular Confidential Informant (RCI for
brevity) called and requested to have a meet up in iMall, Canlubang, Calamba, Laguna to
disclose an important information regarding a drug syndicate who is offering him a drug
deal. Immediately after the receipt of said information, the undersigned together with
other personnel proceeded to iMall to personally meet the RCI;

2. At around 10:00 o’clock in the morning of said date, the RCI surfaced and
reported that AKA “Hector” and his group are engaged in the distribution of illegal drugs
particularly Marijuana in the areas of NCR, Region 3 and Region 4A. The RCI further
disclosed that the group had a conversation with him thru text messages and asked if he
can look for a prospect buyer for at least twenty (20) kilograms of Marijuana leaves and
fruiting tops in exchange for Two Million, four hundred thousand pesos (Php
2,400,000.00). Then and there since the RCI had already established trust with the
group, he conformed to the offer, thus, he will introduce one (1) of our personnel (Poseur
Buyer) as the buyer of marijuana to AKA “Hector”. Accordingly, the exchange of item and
payment will take place somewhere within BioSci Building, beside the library of University
of the Philippines, Los Baños and the mode of transaction is pick up delivery;

3. After evaluating the veracity of the information, since the confidential informant
has already given information to us on different occasions that yielded positive result,
PLT MARTIREZ, our Team Leader, relayed the information to PLTCOL JOHN REI
BERNARDINO, wherein the latter as OIC, SOU 4A instructed Pat Ariel L Reyes(PB) with
the help of the RCI to facilitate the transaction for possible buy-bust operation and
likewise instructed our team leader to contact three (3) mandatory witnesses prior to the
conduct of briefing for the said operation;

4. At that very moment, PLT MARTIREZ called the attention of other personnel
rendering duties in our Office in Camp Vicente Lim to make proper coordination with the
PDEA RO4A. After which, PLT MARTIREZ instructed the other personnel to summon
elected Barangay official and DOJ Representative while he contacted media
representative to witness the briefing. Our Team initiated earnest effort to coordinate with
the DOJ, Barangay authorities and Media. However, only the Barangay and media
representatives signified of their availability. Ms. Christy Ngaloy, media representative
from NEWS5 and an elected official from Barangay Batong Malake, Barangay Kagawad
Mark Masarate. They arrived to witness the briefing after the submission of our letter
request;

5. During the initial briefing, Pat Ariel L Reyes was tasked by the Team Leader
(PLT MARTIREZ) to act as police Poseur Buyer (PB) while the undersigned will act as his
immediate back-up/arresting officer. Pat Howard Cary B Ramos and Pat Royce Daryl P
Javiniar were likewise designated as photographer and videographer, respectively. The
rest of the team will act as perimeter security and perform other tasks as directed by the
Team Leader during the buy-bust operation. The pre-arranged signal that was agreed
upon as a sign that the drug deal was already consummated was that when the PB
activate the speed dial of his phone to connect with us, arresting officers in the instance
where he will be dealing inside the subject’s vehicle or any possible situation may occur;

6. After the initial briefing, due to the exigency of the forthcoming possible buy-bust
operation, the PB, the RC, the undersigned and other personnel returned to our Office in
Camp Vicente Lim to prepare all other documentary requirements to be used in the buy
bust operation. Two (2) pieces of genuine One Thousand (Php1,000.00) Peso bill with
serial numbers _______ and ________ were withdrawn from the Finance Section of this
Unit and subsequently marked with the PB’s signature. Thereafter, said marked money
was placed separately on top of two (2) bundles boodle money incorporated with another
________ bundles of boodle money to make it appear as the agreed amount piled inside
bag with label ______________. Likewise, Pre Operation Report and Authority to
Operate was submitted to PDEA wherein the PDEA RO4A sent a Certificate of
Coordination with control no. _____________ dated April 22, 2024 was issued by PDEA
RO-4A as proof that our office coordinated with them prior to the conduct of buy bust
operation;

7. Upon completion of the necessary documents, the PB then told us that they
already finalized the deal between them and the target of the operation, AKA “Hector”;

8. At about 1:00 P.M., a final briefing was conducted with the team together with
Ms. Ngaloy of NEWS5 and Barangay Kagawad Mark Masarate, the insulating witnesses;

9. Moments later, at about 01:30 PM, the RCI received a text message from AKA
“Hector” informing him that the latter was onboard a White Toyota Fortuner bearing plate
number _________ and will be waiting for them at the vicinity the BioSci Bldg., University
of the Philippines, Los Baños, Laguna around 2:30PM to 3:00 PM. AKA “Hector” further
instructed the RCI to immediately proceed to the said place; and once at the said area,
the PB and the RCI will have to inform him that they are already at area and will wait for
his instruction where to pick up the said illegal stuff(marijuana) that they ordered;

10. Due to this information that we acquired, we strategically planned that there
must be an advanced party of police operatives in the area where the transaction will take
place to observe the area and to see who is in possession of the illegal drugs and who
will be the one to drop them at the agreed location;

11. Thereafter, the advanced party coordinated with the UP Police (University
Police Force) for our operation(attached herewith is the letter request for coordination to
UPF), our request was approved and in which was agreed upon by both parties (PNP
and UPF) for as long as they will be witnessing and be included in the operation;

12. After which, at about 03:00 PM, we, the operating team immediately
proceeded to instructed location. At about 3:45 PM, we arrived at the place of transaction,
we then saw the vehicle described by the AKA ”Hector”, we parked strategically far from
their vehicle and observe the surroundings as we wait for the cue of the PB when to rush
up to the scene and arrest the subject individual who perpetrated the crime. As we were
observing the surroundings, and based on the information from the advance party, they
already noticed that there was a vehicle that matched the description that was given by
the subject so they already focused on it and so as we;

13. As we are scouting and observing the area, we saw that AKA “Hector” called a
man sitting on the bench near the trash can using his phone in front of the BioSci
Building, he then approached the White Toyota Fortuner with plate number bearing
________, took the box containing suspected marijuana from the car of AKA “Hector” and
put it inside the trash can and took the bag containing money and give it to AKA “Hector”
wherein the latter gave him cash after that instance;

14. At this instance, I (Pat Christan Josh Genessis U Doniego) received a call from
the PB, which signifies that the drug deal has already been consummated which
prompted us to rush at the scene wherein I (Christan Josh Genessis U Doniego) arrested
Poco Reyes, who alleged that the box of marijuana came from the vehicle parked near
the library beside the BioSci Bldg. and that he was just called by the man from the
passenger seat to place the box of marijuana inside the trash can and get the money
inside it and bring it to them with a consideration of cash money, while I (Pat Arianne Billy
Liwanag) arrested the driver of the White Toyota Fortuner, Tomas Morato and Pat Ariel L
Reyes arrested AKA “Hector” who was later identified as Henry Tordesillas. ;

15. During the arrest, we together with the PB again introduced ourselves as
police officers and subsequently informed the suspects (in Filipino language) of their
rights to remain silent, to have a competent and independent counsel preferably of their
own choice and asked if they understood those rights to which they responded in the
affirmative;

16. The Illegal Drug Item Subject of Buy-Bust which AKA “Hector” sold to the PB
was seized, photographed, marked and inventoried. (Receipt/Inventory of Property
Seized is hereto appended as reference);

17. Due to clear and apparent presence of other illicit items in the course of the
search incidental to the arrest and within the immediate possession and control of AKA
“Hector” and Tomas Morato, I, Pat Arianne Billy Liwanag was able to recover/seize
another five (5) packs of suspected marijuana at the back passenger seat of the vehicle
that signifies the immediate possession of the suspects. Said illegal drug items were
likewise seized, photographed, marked and correspondingly inventoried.

18. With respect to said five packs of “marijuana” recovered and seized from the
possession of both subjects that was found in plain view at the back passenger seat of
the subject’s vehicle, we personally marked the same, to wit:

19. The other non-drug items seized which were not submitted for any
examination, remains in the custody of the arresting/seizing officer for safekeeping prior
presentation to the court if evidence warrants;

20. In compliance with the requirements of Sec. 21 of R.A 9165 as amended and
in accordance with the doctrine laid down in the case of People of the Philippines vs. LIM,
our team initiated earnest effort to coordinate with the DOJ, Barangay authorities and
Media before the conduct of buy-bust operation, but due to the immense distance of the
target place from our office, only Ms. Christy Ngaloy, Media Representative and
Barangay Kagawad Mark Masarate managed to join our briefing. The DOJ
Representative was contacted but was not able to witness the operation due to some
unexplained circumstances. The seized contrabands were then photographed, marked
and inventoried where the buy-bust took place and in the presence of the suspect and the
following witnesses:

a. Brgy. Kagawad Mark Masarate of Barangay Batong Malake,


Los Baños, Laguna; and
b. Ms. Christy N Ngaloy, Media Representative from NEWS5.

21. After the termination of the conduct of photograph, marking and inventory of
both drug evidence and non-drug evidence, we immediately returned to our office for the
preparation of the appropriate documents, including the request for laboratory
examination of the drug evidence;

22. After the preparation of the necessary requests,on April 22, 2024, at about
08:00 P.M., we together with PCpl Mariel P Salvatierra, Investigator on Case, Pat Ariel
Reyes, the poseur buyer and other members of this unit delivered the arrested suspect
for Drug Test and Physical Test before the PNP Regional Forensic Unit 4A, Camp
Vicente Lim, Calamba City, Laguna,. Likewise, the abovementioned confiscated/seized
illegal drug items were submitted for laboratory examination to the same Office which
was received by PMAJ RUZZEL GAVE FERNANDEZ, RCh, Duty Chemist;

23. Chemistry Report No. D-148-22-RFU4A dated April 23, 2024 revealed that the
evidence submitted had overall weight of _______ grams gave POSITIVE RESULTS for
the presence of Tetrahydrocannabinol, a dangerous drug;

24. We are executing this affidavit to attest the truthfulness of the forgoing
statement and to support the filing of criminal complaints for violation of Section 5 in
relation to Section 26 (b) and 11, Art. II of RA 9165 otherwise known as “The
Comprehensive Dangerous Drugs Act of 2002” as amended by RA10640 against
respondents Henry Tordesillas, Tomas Morato while Section 5 in relation to Section
26 (b), Art. II, RA 9165 for Poco Reyes.
