TERMS & CONDITIONS
Glossary
 The “Dealer” means authorized centre for Sale and Service of the BMW Vehicles.
 The “Customer” means buyer who intends to purchase a BMW Vehicle and is requesting for a production slot / from stock available
with dealer or BMW India.
 “Order Acceptance Date” means the date of realization of the Demand Draft / Pay Order / Cheque given by the Customer with Booking
Order Form towards the booking of the BMW Vehicle.
 “Vehicle” means a BMW Vehicle produced by the manufacturer. Such Vehicle is purchased by the Customer from the Dealer.

Contract
 Particulars of Sales Contract should be filled out in duplicate in English language only. One copy thereof duly acknowledged and
stamped with the date and time or receipt shall be given by the Dealer to the Customer.
 An order for each BMW Vehicle should be made in a separate Sales Contract. The Sales Contract should clearly indicate the
specifications of the BMW Vehicle in case CBU order by the Customer.
 No order will be a binding until accepted in writing by the Customer.
 Orders in joint names or in the name of minors shall not be valid.
 For Customers who are seeking finance through any Finance Company/ Bank for the advance payment of the BMW Vehicle, the
Dealer shall send communications to and take all instructions including those relating to cancellation, directly from respective Finance
Company/ Bank only. The Dealer shall not be responsible or liable for any action taken pursuant to the instructions of the Finance
Company / Bank.
 Income Tax Permanent Account Number (PAN) is compulsory as per prevailing rules and regulations of Government of India for taking
Vehicle delivery.
 Sales Contract once signed under corporate policy is non-transferable.
 In an unfortunate event of the demise of the Customer, the order may be transferred to the nominee of the deceased or to the legal
representative upon satisfactory evidence being provided. The nominee designated in such case cannot be a minor.
 Any request for change in the Sales Contract from the Customer shall only be admissible within seven (07) days in case of CBU and
three (03) days in case of CKD of the date of Sales Contract and shall be valid only upon Dealer accepting the suggested change in
writing.

Price and payment details


 Ex-Showroom prices, taxes, duties, etc. at the time of physical delivery of the BMW Vehicle will be applicable. The prices may differ
from city to city based upon the local taxes and duties levied by the respective State Government.
 Prices of BMW Vehicles may differ depending on the place of delivery of the Vehicle and optional equipment included in the Vehicle (in
case of CBU).
 Booking amount of Rs.25,00,000/- for CBU and for rest of the vehicle Rs.3,00,000/- in favor of Kun Motoren Pvt Ltd.
 All other payments to be made before the delivery of the vehicle along with 1% TCS of Invoice value.
 The Customer should obtain his / her copy of the Sales Contract from the Dealer duly stamped after submitting the completed Sales
Contract and prescribed booking amount.
 All the payments must be made by the way of an Account Payee Cheque / Demand Draft /Pay Order payable locally in favour of the
Dealer with whom the Order is placed. Payment of cash will not be accepted without copy of PAN or Form 60 / 61. Date of realization
of Account Payee Cheque / Demand Draft / Pay Order shall be considered as the date of payment.
 Any delays in the payment shall attract a penal interest of 24% per annum calculated in daily basis.
 Any increase in the Price of Vehicle owing to but not limited to increase in the Import Duty / Excise Duty / Surcharge/ Central Sales Tax
/ Local Sales Tax / Value Added Tax / Transportation and / or any Governmental levies which comes into force before the of delivery of
the Vehicle shall be borne in full by the Customer.
 Delivery shall only be made against 100% advance payment including all the products and services availed by the Customer over and
above the Vehicle purchase including the penal interest. Part payment of any sort received as advance or otherwise against Vehicle
does not imply any obligation or agreement to deliver the Vehicle without full and final payment for the Vehicle.
 Wherever a Finance Companies / Bank is involved in retail funding the Vehicle, the Customer is required to present all the necessary
documents, including all requisite authorization letters duly attested the Finance Companies / Bank in their respective format.

Interest on advance payments


 All the payments made by the Customer to the Dealer towards securing a production slot and / or buying a BMW Vehicle shall not carry
any interest.

Vehicle Delivery
 The Dealer shall keep the Customer informed of the production slot allocated to his / her / it’s BMW Vehicle after the information is
received by the Dealer from the online system.
 Allocation of Vehicle by the Dealer to the Customer will depend upon the supplies / production slots of the BMW Vehicles allotted by
the BMW India to the Dealer.
 Availability of optional equipment, color, model required by the Customer is subject to availability.
 The dealer does not guarantee the date and time of delivery of the Vehicle. The Customer shall not be entitled to claim any damages or
losses of any kind for delay in the delivery or non-delivery of the BMW Vehicle due to unforeseen situations including but not limited to
natural calamities, civil unrest, strikes, shipment delays, etc.
 The specification and price of the BMW Vehicle are subject to change from time to time without prior notice and the price prevailing at
the time of delivery will be applicable.
 The Dealer will not be responsible for any damage or shortage reported after the delivery is affected and the signature of the customer
or his/her/ it’s authorized representative (including transport contractor through whom the Vehicle is transported) is obtained on the
delivery receipt.
 In case the registered owner is not coming or in case of company, one must bring an authority letter to take physical delivery and to
sign all documents pertaining delivery.
Cancellation
 Cancellation for CBU can only be done within seven (07) days after signing the Sales Contract. Cancellation for CKD can only be done
within three (03) days after signing the Sales Contract. A cancellation notice will only be accepted by the Dealer if it is duly signed by
the Customer who has signed the Sales Contract, such notice being in writing.
 Cancellation charges : In case the cancellation of booking, as the dealer, Kun Motoren Pvt Ltd, has agreed to hold the sale of the car
for a period mentioned in page 1 and in case the purchaser backs out from the bargain ie fails to buy the car in question, in that
eventuality the amount paid by me (purchaser) as booking amount will be forfeited in favor of Kun Motoren Pvt Ltd. This amount will
compensate Kun Motoren Pvt Ltd of the loss it has suffered on account of non-sale of the car.
 In case the booking amount is funded by a Finance Company / Bank, the cancellation notice must be send via the same Finance
Company / Bank, such notice being in writing. The dealer will send the refund (if applicable) through the concerned Finance Company/
Bank.
 In an unfortunate event that the Customer or his company becomes bankrupt or insolvent or makes an arrangement with his creditors
or goes into liquidation or passes into the hands of a receiver, the Dealer may at his discretion cancel the Sales Contract and is free to
sell the Vehicle to a new buyer. In this case the Dealer also reserves the right to fully retain the advance paid by the Customer towards
booking of the Vehicle and the Customer, agrees/accepts to forfeit the same, without any demur to/on the Dealer

General
 The Dealer will not be responsible for delay, loss or rejection of the Sales Contract, or for safe custody or transmission of any Demand
Draft/Pay Order or any other payment or document sent to the dealer by post/courier.
 BMW Vehicle including the optional equipment once sold will not be taken back or exchanged.
 The supply against order will be governed by any statutory orders, rules and regulations imposed by Central and State Government
from time to time.
 The Dealer shall not permit or countenance in relation to any contracts or intended contracts, any acts constituting attempts of
inducements to favour or bribe, and reserves to itself the right to cancel or refuse to deal with any persons so attempting and also to
report the same to the appropriate authorities.
 Any notice given hereunder must be in writing and sent by either Registered Post with acknowledge due or by hand delivery with
acknowledge due to the Dealer at the place of business of the Dealer.
 Failure by the Dealer to enforce at any time or for any period any one or more of the conditions shall not be a waiver of them or of the
right at any time subsequent to enforce all of them.
 Customer will have to deposit the road tax to the Dealer who will deposit it with the local State Transport Authorities. With an exception
to the fees charged by the local State Transport Authority / RTO, the Dealer shall charge additional service fee towards the registration
of the vehicle. A receipt issued by the local State Transport Authority / RTO shall be provided by the Dealer to the Customer.
 All legal matters pertaining to this Sales Contract shall be pursued exclusively before the Honorable Courts of the city in which the car
is booked.

Customer Data
 By signing the Sales Contract the customer agrees that his/her contact details will be shared with BMW India, and / or its Group
companies for the purpose of conducting surveys for improving the quality of services provided to the Customer. The Customer hereby
gives his / her consent for such data sharing and has no objection whatsoever for such data sharing.

LIST OF DOCUMENTS REQUIRED FROM PURCHASER BEFORE DELIVERY

In case of Individual:
1. Self attested copy of PAN card ; 2. Self attested copy of Billing Address Proof ; 3.Self attested copy of Driving License

In case the purchaser is not available for delivery, signed authority letter to sign all the documents pertaining purchase and take the physical
delivery of the car along with ID proof of authorized person.

In case of Company:
1. Self attested copy of PAN card with stamp ; 2. Self attested copy of Billing Address Proof with stamp ; 3.Self attested
copy of Driving License with stamp; 4.Self attested copy of GST with stamp

In case the purchaser is not available for delivery, signed & stamped authority letter on letter head to sign all the documents pertaining
purchase and take the physical delivery of the car along with ID proof of authorized person.

Customer / Authorized person must carry stamp during delivery process to stamp all the documents pertaining to the delivery of the vehicle.

NOTE:
Please make all the payments through Demand Draft / Account Payee Cheque / RTGS / NEFT in favor of Kun Motoren Pvt Ltd.

Please do not handover any amount through Cash or Bearer Cheque to any representative of Kun Motoren Pvt Ltd.
