SUBJECT: ERRONEOUS ENCODING OF APPREHENSIONS

DATE: 25 APRIL 2024

It has come to the attention of the undersigned that there are several cases of double
encoding of traffic violation and encoding of apprehension which is not cited in the
Temporary Operator’s Permit. This has provoked the ire of the transacting public.

In this regard, the staff of TAS is ordered to be mindful of their encoding process to
avoid committing mistakes in encoding traffic apprehensions. More importantly,
everyone must be mindful that only apprehensions reflected in the Temporary
Operator’s Permit should be encoded except in the case of Memorandum Circular VPT
2010-1417. The Temporary Operator’s Permit is the only accountable form of the Land
Transportation Office for the citation of traffic apprehension and everything outside of it
should be treated as a mere scrap of paper.

This circumstance, at its first instance, shall be treated as the employees’ honest mistake
and failure to exercise due diligence in the performance of their duties. However, the
repetition of such shall be considered as a misconduct, neglect of duty, and
incompetence which may warrant an administrative action.

Therefore, this Memorandum serves as a poignant reminder to the staff to carry out
their functions with responsibility, integrity, efficiency, and zeal to avoid committing
flagrant and wanton violation of our existing rules and procedures.

Regular reporting to the undersigned is indispensable. This Memorandum is a


preventive and corrective action to the complaints of the public regarding the erroneous
encoding of apprehensions. All acts that are outside the knowledge and order by the
undersigned, including those deeds committed in violation of the instructions of the
undersigned, do not fall under her accountability and command responsibility, in
accordance to Executive Order No. 226.

In view of the foregoing, it is recommended that a basic training and seminar be


afforded to the staff of LETAS.
