Subject: Appointment Letter

Dear Mr. Santosh,

With reference to your application and subsequent interview, we are pleased to appoint you for the position of
Faculty –Biology with Motion Education Pvt. Ltd.
The terms and conditions of the employment would be as follows:
1. Date of Joining: You have joined us on 29/08/2021
2. Salary: Your gross salary shall be Rs. 4,80,000/- PA from your date of joining.
3. Place of Work: You will be posted at our SIP Centre- Betul.
4. Probation/Confirmation: There is a company policy of keeping all its new employees on a probation period of 6
months.
5. Office Timings
• An employee shall be required to work for 9 hours a day on a normal working day. This
excludes time given for traveling and includes lunch timings.
• Faculty members can adjust their office timings according to their lecture timings.
• There is an ‘Attendance Recording Machine’ installed at the entrance wherein the personnel have to
punch while coming and leaving the institute.
• The working days shall be 6 days a week with Sunday as the weekly holiday for employees who are part
of the Management Team.
• There will be no leave for employees who are part of Academic Team on days on which
Motion Tests are conducted.
6. Leave Rules:
• The employees of the organization are eligible for benefits such as casual leave, sick leave etc. subject to
the terms & conditions laid out in Employees service rules and the latest amendment circulars issued from
time to time.
• No leaves will be allowed during the probation period. Leaves taken during this period will be deducted
from your salary.
Casual leave:
• Every employee is entitled to one day casual leave per month subject to a maximum of 12 days in an
academic year.
• The leave itself is of a casual nature. Hence employees are expected to avail of such leave judiciously.
• Every employee availing of leave has to obtain the sanction of the competent authority by applying in the
prescribed form.
• Unless warranted by extra-ordinary circumstances, no employee shall be granted more than seven days of
leave for more than 10 days together with holidays.
• In case, there is any balance of leave available by an employee as on December 31st of the year, it will lapse
and there will not be any kind of right on the part of the employee to claim it.
• Casual leave cannot be combined with any other kind of leave
Sick / Casualty Leave:
• Every employee is entitled to 10 days of sick leaves in an entire year starting from 1st January every year.
Every employee availing leave has to obtain the sanction of the competent authority by applying in the
prescribed form or either by e-mail except in an emergency situation (that too shall be informed via
telephone).
• Every employee intending to avail of sick leave has to apply in the form pre scribed and enclose documentary
evidence with it.
7. Appraisal Policy: The Appraisals are done on a yearly basis. The Appraisal % depends on an Employee’s
Performance Review done on basis of work done over the previous 12 Months. The
Raise is done on a relative basis with the base % being dependent upon Market Scenario and
Performance of Organization as a whole.
8. Important Employment Terms:
• You will be entitled to receive salary / reimbursement / allowances as per the terms attached herewith and
other benefits as per existing policies of the Institute.
• Confidentiality: In the performance of your duties, you will come to possess information (written or
unwritten) on the Institute’s operations, processes and plans. All such information shall be held by you in the
strictest of confidence and shall not be divulged to any person during your service with the Institute or
thereafter the Institute will be at liberty to initiate appropriate legal proceedings against you.
• Non Disclosure: You shall not communicate, or attempt to communicate to the public, media bodies,
journals, academic institutions etc. or cause to disclosure at any time, any information or documents, official
or otherwise relating to the institute or its customers, except with the prior written approval of the Directors
of the institute.
• Intellectual Property Rights: Any material development, discovery, plan, specification, program, design,
process, adaptation or improvement in procedure or other matters of work which can be the subject matter
of protection granted to any intellectual property right (including without limitation patents, designs and
copyrights), made, developed or discovered by you alone or jointly with any other person or person while in
the employment of the Institute in connection with or in any way affecting or relating to the business of the
Institute or capable of being used or adapted for use therein or in connection there with shall forthwith be
disclosed to the Institute and shall belong to and be a part of “works made for hire” under applicable law.
Pursuant to its exclusive proprietary rights, the Institute shall have the sole and exclusive right, inter alia, to
use, modify or adapt the intellectual property that you have developed during the course of your
employment.
• Notice Period: Your employment with the Institute can be terminated by either yourself or the Institute by
provision of 45 days notice in writing or payment of one month’s in lieu of notice by either yourself or the
Institute. The institute reserves its right to its sole discretion, accept your resignation and relieve you
immediately by waiving the necessity for such notice. You will be governed by Code of Conduct laid down by
the Institute and if there is any breach of the same or non performance of contractual obligations or non
performance of contractual obligations of the terms and conditions laid down in this letter, your service could
be terminated without any notice period whatsoever not withstanding any other terms and conditions
stipulated herein.
9. Other Terms & Conditions:
• You will be in full-time employment with the Institute. You will be based at SIP Centre- Betul and you are
liable to be transferred anywhere in India to any facility or establishment forming part of Organization of
associate/ affiliate companies without any extra remuneration, and you will abide by the working of such
department, office or establishment.
• As per the policies of the Institute we expect all our full-time employees to devote their full-time attention
and efforts to the business of the Institute. We clearly disapprove of any employee directly or indirectly
engaging himself / herself in or devoting any time or attention to any part- time employment or business or
monetary position other than that of the Institute. In specific cases, e.g. writing for magazine / journal,
speaking at various forums, etc. explicit permission from the Institute has to be taken prior to your engaging
in such activity. At any time, if it is found that there is any breach of this condition on your part, your services
are liable to be immediately terminated at the sole discretion of the Institute.
• You will be governed by the rules and regulations of employment established by the Institute and general
work practices, which will be in force from time to time.
• You will be responsible for the safe keeping and the return in good condition and order, of all property of
the Institute such as equipment, computers, books, etc., which may be in your use, custody, care or charge.
The Institute shall have the right to deduct the monetary value of all such things from any final monetary
settlement due to you, and take such other action as the Institute deems proper in the event of your failure
to account for such property to the satisfaction of the Institute.
• Upon termination of your employment with the Institute, you shall forth with return to the Institute all
assets and property of the Institute including all documents, files, books, memos, software or any other
property of the Institute in your possession or under your control.
• The Security Cheques that have been collected from you at the time of employment would be returned
back to you at the time of your relieving the services, after serving of 45 days notice period.
• You will keep the Institute informed of any change in your residential address or in your civil status.
• It must be specifically understood that this employment relationship is on the basis of your proficiency in
the technical / professional skills you have declared to possess as per your application for employment with
the Institute, and on your ability to handle any assignment / job independently anywhere in India or overseas.
In the event, at a later date, any of the statements/ particulars furnished by you to the Institute are found to
be false or misleading or your work performance falls short of the minimum standards required by the
Institute, the Institute shall have the right to terminate your services, without any notice period,
notwithstanding any other terms and conditions stipulated herein.
• You shall not, directly or indirectly, at any time during the term of your employment with the Institute
and for a period of two years thereafter, for any reason, either on your own account or for any other person
or entity, solicit, interfere with or Endeavour to entice away from the Institute or any of its affiliates, any
person who to your knowledge is a client, customer or employee of, in the habit of dealing with the
Institute or any of its affiliates.
• All disputes arising between yourself and the Institute arising hereunder shall be settled under the
provisions of the Indian Arbitration and Conciliation Act 1996 or any statutory modification or reenactment
thereof for the time being in force. You agree (i) that the arbitration proceedings will be conducted in Kota;
and (ii) the panel of arbitration shall consist of three (3) members, one (I) each appointed by yourself and
the Institute and the third appointed by the nominee arbitrators by consensus. You agree that this letter
shall be construed and enforced in accordance with the laws of Republic of India, without giving effect to the
conflict of law provisions thereof. Subject to the terms of this letter, the courts at Kota, Rajasthan shall have
exclusive jurisdiction to entertain any suit, dispute, litigation or legal proceedings in respect of or under this
letter.
