Conditions for Paying the Holding Deposit for «Property_Address_H»

Thank you for your payment of [amount of holding deposit] which shows your serious intentions to proceed
with the renting of the above property (subject to contract and satisfactory references) with effect from
«Tenancy_Start_Date» at a rental of [rental amount] per calendar month.
We will hold this sum pending the successful execution of the tenancy agreement and whilst reference and
right to rent checks are carried out. It will then be offset against the first rental payment due under the
tenancy agreement.
If there is any part of this receipt you do not understand, please take your own legal advice or contact the
Citizens’ Advice Bureau. If you wish to see a sample tenancy agreement before making payment, let us
know and we will be happy to provide a copy.

Please note that:


 this payment does not commit the landlord to granting a tenancy, or constitute an offer of a tenancy
 this payment does not oblige our client to let this, or any other above property to you;
 this payment is not held as part of the security deposit for the tenancy
 interest will not be paid on this payment
 the property status will be changed to ‘under offer’ on our register and website

The holding deposit will not be refunded to you if:


 the tenancy does not proceed due to your references or supporting documents not meeting our or
the landlord’s criteria,
 you are unable to provide evidence of your right to rent a property in England
 you have given misleading or incorrect information
 you or any proposed joint tenant change their mind and/or withdraw for any reason
 you fail to take all reasonable steps to enter into the tenancy agreement by the above date

However the holding deposit will be refunded to you if:


 the landlord decides to withdraw for any reason, or is unable to enter into the tenancy,
 the landlord fails to enter into the tenancy agreement by the above date

We will process your personal data for the purposes of the tenancy (hereafter ‘transaction
data’). Transaction data will be processed by us in order that we may fulfil our contractual obligations and
for the purposes of supplying our services. The legal basis for this processing is for the purposes of taking
steps at your request to enter into an agreement to which you are a party.

process. Your personal data will only be used in accordance with our Privacy Policy which can be found at
