NOTES:
● Hon’ble Judges sitting in Hon’ble Division Benches after exhausting their lists may sit singly
for taking up Single Bench cases.
● Hon’ble Special Benches will be taken up on all Fridays or as per date given by the Hon’ble
Special Division/Single Bench itself. All the freshly registered applications will also be listed
before Hon’ble Special Division/Single Bench only on Friday.
● Mentioning of Cases:
(i) Mentioning of cases to be listed before
(ii) Hon’ble Bench presided over by Hon’ble the Acting Chief Justice and the cases on the
board of Hon’ble the Acting Chief Justice will be made only before Hon’ble the Acting
Chief Justice.
In case, Hon’ble the Acting Chief Justice is not available, the mentioning of cases
to be listed before Hon’ble Bench presided over by Hon’ble the Acting Chief Justice will
also be made before Hon’ble the Senior Judge of Hon’ble Division Bench-II.
(iii) Mentioning of Civil Writ Petitions and Civil Cases (except cases to be listed before
Hon’ble Bench presided over by Hon’ble the Acting Chief Justice and the cases on the
board of Hon’ble the Acting Chief Justice) will be made before Hon’ble the Senior Judge
of Hon’ble Division Bench-II.
In case, Hon’ble the Senior Judge of Hon’ble Division Bench-II, hearing the
mentioning of Civil Writ Petitions and Civil Cases (except cases to be listed before
Hon’ble Bench presided over by Hon’ble the Acting Chief Justice and the cases on the
board of Hon’ble the Acting Chief Justice) is not available, the mentioning of such cases
which is required to be made before Hon’ble Division Bench-II, will be made before
Hon’ble the Senior Judge of Hon’ble Division Bench-III and so on, as per the availability.
(iv) Mentioning of Criminal Cases will be made before Hon’ble the Senior Judge of Hon’ble
Division Bench-III.
In case, Hon’ble the Senior Judge of Hon’ble Division Bench-III, hearing the
mentioning of Criminal Cases is not available, the mentioning of such cases which is

required to be made before Hon’ble Division Bench-III, will be made before Hon’ble the
Senior Judge of Hon’ble Division Bench-II and so on, as per the availability.
(v) However, the application(s) in which main case(s)is/are already decided/pending listed in
Urgent/Ordinary/Regular hearing before any Hon’ble Bench as per current roster, the
mentioning regarding the same will be made before the same Hon’ble Bench.
● Cases upto the year 2000, cases relating to Senior Citizens, Crime against Women, Differently
Abled persons, Juveniles, Marginalized Sections of society, Prevention of Corruption Act, cases
in which proceedings before lower Courts have been stayed and remand cases, from Hon’ble
the Supreme Court, will be taken up on priority basis.
● Ordinary filed RSAs upto the year 2021 wherein notice of motion is yet to be issued will be
shown in Urgent Cause List.
● All the cases upto the year 1993 will be listed in the Urgent Motion Cause List. The Case(s)
which is/are pending in motion/regular hearing for less than 30 years but connected/ordered to
be heard with a case pending for more than 30 years will also be listed in Urgent Motion
Hearing alongwith the cases upto the year 1993.
● Admitted cases from the year 1994 to 2000 will be listed in the Ordinary Motion Cause List.
● The application(s) for placing on record the document(s) without any further prayer except
exemption from filing certified copy(ies), in pending case(s) will be listed on the date when the
main case is to be listed.
● The application(s) for recalling/modification/correction/clarification/rectification/waiver of
costs etc., in the pending case unless specifically styled as Review Application, will be listed as
per Roster.
The application(s) for vacation of order of interim bail/vacation of stay in pending
criminal case/petition shall also be listed as per roster.
● Application for revival in decided Contempt Petitions will be listed as per roster before Hon’ble
Bench.
● Pursuant to the observations made by the Hon’ble Supreme Court of India in judgement dated
15.05.2023 passed in Criminal Appeal No. 1503 of 2023 arising out of SLP(Crl) No. 3241 of
2023 titled as “Pradhani Jani V/s The State of Odisha”; judgement dated 12.12.2023 passed in
SLP(Crl) No. 15585 of 2023 titled as “Rajpal V/s State of Rajasthan” and judgement dated
19.01.2024 passed in Criminal Appeal No. 303 of 2024 titled as “Kusha Duruka V/s The State
of Odisha” arising out of SLP(Criminal) No. 12301 of 2023, Hon’ble High Court of Punjab &
Haryana has been pleased to issue the following instructions:
1. All the Bail matters arising out of same FIR/Complaint shall be listed as per roster before
one Hon’ble Bench, except:
(i) The Subsequent Bail Application(s) filed under section 102 of Juvenile Justice (Care and
Protection of Children) Act, 2015 filed in the form of Criminal Revision(s), under section
14A(2) of Scheduled Caste & Scheduled Tribes (Prevention of Atrocities) Act, 1989, as
amended by the Amendment Act, 2015 and under section 21 of the National Investigation
Agency Act filed in the form of Criminal Appeal(s) and the Subsequent Bail
Application(s) under section 438 & 439 Cr.P.C. as well as Application(s) for Interim
Bail(s) shall be listed before the same Hon’ble Bench, who had earlier decided (on merit

or disposed of/ dismissed as withdrawn for non-prosecution/not pressed) any of the bail
application arising out of the same FIR/Complaint, irrespective of the subject matter
assigned to the said Hon’ble Bench.
(ii) Subsequent Application(s) for Suspension of Sentence under section 389 Cr.P.C. shall
also be listed before the same Hon’ble Bench, who had earlier decided (on merit or
disposed of/ dismissed as withdrawn for non-prosecution/not pressed) any of the bail
application arising out of the same FIR/Complaint, irrespective of the subject matter
assigned to the said Hon’ble Bench.
(iii) Application(s) for Cancellation of Bail under section 439 (2) Cr.P.C. shall be listed before
the same Hon’ble Bench, who had earlier decided (on merit or disposed of/ dismissed as
withdrawn for non-prosecution/not pressed) any of the bail application arising out of the
same FIR/Complaint, irrespective of the subject matter assigned to the said Hon’ble
Bench.
In the event the said Hon’ble Bench is not available on account of transfer or
superannuation or recusal etc., the said Subsequent Bail Application(s) shall be listed as per
roster before available Hon’ble Bench.
All the Subsequent Bail Application(s) as well as Subsequent Application(s) for
Suspension of Sentence filed by the same accused or Application(s) for Cancellation of Bail
listed before the same Hon’ble Bench in view of the aforesaid directions will deemed to be
listed as per roster.
2. In case any Subsequent Bail(s) in a particular FIR/Complaint is pending before any
Hon’ble Bench sitting/not sitting in roster, then all the other matters arising out of the
same FIR/Complaint shall also be listed before the same Hon’ble Bench where
Subsequent Bail Application(s) is pending being the lead case, till the pendency of the
said Subsequent Bail(s).
● In case any Revision, Appeal, Quashing Petition and Direction Petition or any other case is being
listed prior to listing of Bail Application, then the said case will also be listed before the same
Hon’ble Bench where Bail Application is being pending/decided, if available in roster.
● Special Division Benches presided by Hon’ble First Judge of the Regular Division Benches will
be taken up at 10 a.m. i.e. before meeting of respective Regular Division Benches on the given
date or Friday as the case may be.
In case, there are two or more Special Division Benches with Hon’ble First Judge of the
Division Bench as a member, the Special Division Benches will be taken up as per the Seniority
of Hon’ble Second Judge.
● The case(s) which is/are pending in motion hearing and ordered to be listed along with admitted
case(s), without passing order to the effect of their admission, will be listed in motion hearing
along with admitted case(s) before concerned Hon’ble Benches.
● The case(s) which have been kept as ‘Part-Heard’ by the Hon’ble Bench, the said order shall be
given effect to only for a month from the first date of passing the said order by the Hon’ble
Bench for the purpose of listing.
