Be it known to all by these presents that I, Bashir Ahmad
Bhat S/O Abdul Aziz Bhat R/O Bagh Mehtab Srinagar (Herein after referred to as “the Executant/ Principal) do hereby appoint, nominate and constitute: Majid Bashir Mintoo S/O Dr Bashir Ahmad Mintoo R/O Ward No 4 Malipath Kishtwar (Hereinafter referred to as “the Attorney” as my true and lawful attorney. Whereas, a plot No 298 measuring 32x48 feet in the Bagh- i-Mehtab Housing Colony Srinagar was originally allotted to one Mohammad Yousuf Dar S/O Abdul Ahad Dar R/o Alai Kadal Srinagar ORDER NO BM/73/274 dated 17/12/1983, by J&k Housing Board. The said allottee had executed a General Power of Attorney in favour of executant herein on 20/07/2007 empowering him to do all or any of the things or acts and to deal with the said plot.
Whereas, pursuant to the permission granted by Housing
Board, the construction of boundary wall was raised and also parking space was constructed.
Whereas, acting upon the powers so conveyed to the
Principal/ Executant herein by the original allottee,the executant/ Principal, appoints, nominates and constitutes above named Majid Bashir Mintoo my true and lawful attorney in respect of plot No 298 situated at Bagh-i-Mehtab Housing Colony Srinagar bestowing him with the following powers:- 1. The Attorney is entitled to seek the Ownership rights of the said plot in his own name or transfer/extension of leasehold rights in his favour or in favour of another other person and to complete and submit all the requisite documents before the Housing Board or any other office. 2. To maintain, look after, manage the affairs of the plot, use, enjoy and utilize the same peacefully and receive the usufructs of the said property of land. 3. To raise any other construction over the property and for that purpose if any permission is required to be obtained from the Board, Municipal Authorities or from any other Department/ Agency, the attorneys can apply for the same and can make and file the application, affidavit and the statement thereof in the matter and can obtain the permission. 4. That the attorney can also make, execute and register any other document of said property which may be required at relevant point of time for its preservation and protection.
5. That if, either any litigation is required to institute and
defend qua the plot in such eventuality the Attorney is authorised to institute/ defend the same and in this regard, sign the pleadings, make the statement, withdraw and compromise the cases and to deposit or withdraw any amount and appoint any counsel for said litigations.
6. The Attorney has been conveyed the possession of the
property who has entered into the peaceful possession and he shall have every right to utilize the property as the original allottee thereof in every manner he may deems fit.
7. That all or any of the above acts done by the Attorney
herein shall be binding on the Executant and the allottee including their heirs, successors and the administrators in interest, and that the attorney can get executed all or any of the above acts by any other person(s) of his choice and can execute the further sub-attorney.
8. The attorney is empowered and authorised to appoint sub
attorney/ sub agent of the plot bestowing him all the powers conveyed to the attorney hereto before.
9. That original documents of title of the property have
been handed over to the attorney and he is authorised to demonstrate the same as and when need arises.
10. In case, the property is required by any public
purpose, the attorney is entitled to receive the compensation.
11. The attorney is also authorised to deposit the taxes,
charges and premium of the property with board, agency, department etc. 12. The Attorney is also authorised and empowered to do all other things, deeds and acts with respect to plot which though not specifically mentioned heretobefore, but if need arises for the attorney to exercise such powers, he is authorised fully to exercise those powers.
13. That the Attorney can represent the executant and
the allottee before the Housing Board for any purpose that may require for the preservation, protection and proof of title of the plot. 14. On the strength of this document, the Attorney can obtain electric connection, water connection or any other facility from any department what so ever.
15. For the interest of Attorney, this power of attorney
shall be irrevocable in nature and cannot be revoked or cancelled in any case.
