APPLICATION ON BEHALF OF D.H. FOR ISSUANCE OF FRESH

WARRENTS OF ATTACHMENT OF MOVABLE PROPERTIES OF J.D.’s
WITH POLICE ASSISTANCE AND UN-LOCK THE LOCKED SHOP OF THE
J.D.’s, IF FOUND LOCKED FOR THE PROCEEDING OF WARRANT OF
ATTACHMENT IN ABOVE SAID EXECUTION.

Most respectfully showeth:-

1. That the above said execution petition is pending before this

Hon’ble court and fixed for today.

2. That the last date of hearing this Hon’ble Court had appointed
Sh.Vinod Sharma, Bailiff for the execution of warrant of
attachment in the above said execution.

3. That on dated 28/08/2019, Sh. Vinod Sharma, Bailiff and Smt.

Manju Gupta, Prop. of M/s Gupta Glass along with the labors and
Tempo visited the shop of J.D.’s at Plot No. 3, opposite Ashirwad
Nurshing Home, Vikas Nagar, Ranhola Road, Uttam Nagar, New
Delhi for execution of warrants of attachment where the shop
was found open and Sh. B.P. Singh, Owner/Proprietor of M/s
New India Glass, J.D.No-1, herein, was present there. Sh. Vinod
Sharma, Bailiff briefs the warrants of attachment in above said
execution petition and asked to pay the decreetal amount to
D.H. but he refused to pay the same .Thereafter DH tried to take
the goods from the shop of the JD’s in respect of warrants of
attachment but JD strongly opposed and obstructed with his
associate one person.

4. That during the execution proceedings Sh. B.P. Singh has given
his undertaking in writing that he shall settle the decreetal
amount before this Hon’ble Court on 13/09/2019 to D.H., Hence
this application.
 Prayer:-

It is therefore most respectfully prayed from this Hon’ble Court

pleased be passed an order for the recovery of payment in the
above said execution from the J.D.’s by fresh warrant of
attachment of the property/stock/material/articles lying in the
shop of the J.D.’s and the same attached and the sold in public
auction and sale proceedings thereof be paid to D.H. in
satisfaction of the deceetal amount, with the assistance of the
police assistance and un-lock the shop of J.D.’s ,if found locked,
in the interest of justice.

AFFIDAVIT

I, Manju Gupta W/o Sh. Ram Tokh Gupta , aged about ……years ,R/o
D-160, Bhagwati Vihar, Uttam Nagar, New Delhi-59, and Owner/
Proprietor of M/s Gupta Glass, Plot No. 84, Kh. No. 31/25, Matiala
Extn., New Delhi -110059 , do hereby solemnly affirm and declare as
under:-

1. That I am the D.H. in the above noted execution petition and

being well conversant with the facts and circumstances of the
case am competent to swear this affidavit.

2. That the accompanying application for police assistance and

unlock the shop of J.D.’s, if found locked for the proceeding of
warrant of attached in the above said execution petition has
been drafted by my counsel under my instructions and the
contents of the same are true and correct to my knowledge.

3. That the contents of the said application are not being repeated
herein for the sake of brevity, however, the same may kindly be
read as part and parcel of this affidavit.
