AN ACT PUNISHING ONLINE SEXUAL


ABUSE OF EXPLOITATION OF CHILDREN
PENALIZING THE PRODUCTION, DISTRIBUTION, POSSESSION AND
ACCESS OF CHILD SEXUAL ABUSE OR EXPLOITATION MATERIALS

The law aims to provide special protections to children from all forms of
sexual violence, abuse, and exploitation, particularly those committed
using information and communications technology (ICT).

It emphasizes the importance of protecting the rights and well-being of


children and providing them with safe access to digital technologies.

AMENDING REPUBLIC ACT NO. 9160, OTHERWISE KNOWN AS THE "ANTI-MONEY


LAUNDERING ACT OF 2001", AS AMENDED AND REPEALING REPUBLIC ACT NO. 977,
OTHERWISE KNOWN AS THE "ANTI-CHILD PORNOGRAPHY ACT OF 2009"
CHILD SEXUAL ABUSE OR EXPLOITATION
MATERIAL OR CHILD SEXUAL
ABUSE MATERIAL

refers to any representation, whether offline, or by, through or with


the use of ICT, by means of visual, video, audio, written, or any
combination thereof, by electronic, mechanical, digital, optical,
magnetic or any other means, of a child engaged or involved in real or
simulated sexual activities, or depicting acts of sexual abuse or
exploitation of a child as a sexual object. It shall also include materials
that focus on the genitalia or other private body parts of a child.
ONLINE SEXUAL ABUSE OR
EXPLOITATION OF CHILDREN
refers to the use of ICT as a means to abuse and/or exploit children
sexually, which includes cases in which offline child abuse and/or
exploitation is combined with an online component. This can also include,
but is not limited to, the production, dissemination and possession of
CSAEM; online grooming of children for sexual purposes; sexual extortion
of children, sharing image-based sexual abuse; commercial sexual
exploitation of children; exploitation of children through online
prostitution; and live-streaming of sexual abuse, with or without the
consent of the victim.

AN ACT PROMOTING FOR STRONGER


PROTECTION AGAINST RAPE AND
SEXUAL EXPLOITATION AND ABUSE
INCREASING THE AGE FOR DETERMINING THE COMMISSION
OF STATUTORY RAPE

The law increased the age for determining statutory rape to 16 years
old to provide more protection for young people against sexual
exploitation and abuse.

The law also introduced amendments to the provisions on qualified


seduction, child prostitution and other sexual abuse, child trafficking,
obscene publications and indecent shows, and other acts of neglect,
abuse, cruelty or exploitation and other conditions prejudicial to the
child’s development.
CONDITIONS AND DETAILS
Provided, that there shall be no criminal liability on the part of a person having carnal
knowledge of another person under 16 years of age when the age difference
between the parties is not more than three years, and the sexual act in question is
proven to be consensual, non-abusive, and non-exploitative: Provided, further, that if
the victim is under 13 years of age, this exception shall not apply,

Under the new law, rape is committed by a person who shall have carnal knowledge
of another person “when the offended party is under 16 years of age or is demented,
even though none of the circumstances mentioned above be present.”
CONDITIONS AND DETAILS
As used in this act, non-abusive shall mean the absence of undue influence,
intimidation, fraudulent machinations, coercion, threat, physical, sexual,
psychological, or mental injury or maltreatment, either with intention or through
neglect, during the sexual activities with child victim, the law said.

On the other hand, non-exploitative shall mean there is no actual or attempted


act or acts of unfairly taking advantage of the child’s position of vulnerability,
differential power, or trust during sexual activities.

AN ACT INCREASING THE MATERNITY LEAVE PERIOD TO
ONE HUNDRED FIVE (105) DAYS FOR FEMALE WORKERS
WITH AN OPTION TO EXTEND FOR AN ADDITIONAL
THIRTY (30) DAYS WITHOUT PAY, AND GRANTING AN
ADDITIONAL FIFTEEN (15) DAYS FOR SOLO MOTHERS,
AND FOR OTHER PURPOSES

Under this law, female employees, regardless of their civil status, are
entitled to 105 days of paid maternity leave, granting them ample time
to recover and bond with their newborn.

To be eligible for maternity leave benefits in the Philippines, a female


employee must have worked for her current employer for at least 12
months, with at least 6 months of continuous service before the expected
date of delivery. The law mandates that pregnant employees receive 100%
of their average daily salary credit, maternity benefits, and other related
allowances.
