Dear Valued Customer,

In response to your request, we wish to provide the following information concerning the INEOS Styrolution
America products Lustran® ABS and ABS Elite HH, Guardian® ABS and ABS Elite HH and Triax®
brand names, manufactured by INEOS ABS (USA) at Addyston:

The publication of the “SVHC Candidate List” according to Article 59(1) of Regulation EC No. 1907/2006
(REACh) triggers a number of obligations for the European market.

Article 31(1) REACH requires among others the supplier of a substance included in the “SVHC Candidate List”
to provide the recipient with an EU REACh safety data sheet.

Furthermore, Article 33 REACH requires the supplier of an article containing a SVHC substance in a
concentration above 0.1 % (w/w) to provide the recipient in the EU with, as a minimum, the name of that
substance.

Please be advised that based on the information available to us from our raw material suppliers, the current
products offered in the product lines listed above do not contain as intentionally added additives or ingredients
any of the Substances of Very High Concern (SVHC) above a concentration of 0.1 % w/w of the SVHC
Candidate List, article 59 (1, 10) as published by ECHA on January 23, 2024 (240 chemicals).

Please note that these substances have not been banned from use. Listing on the SVHC list only indicates
that these substances may become subject to authorization.

The European REACh regulation on the Registration, Evaluation, Authorization and Restriction of Chemicals
(Regulation (EC) No 1907/2006) is complex and there are only certain parts to which we can respond. It is
important that you know that it is the basic chemicals used to produce our polymers that are being targeted
by REACh. These chemicals are reacted to form our polymers or may be used with them as additives or
colorants. Any of these ingredients in an amount > 2% by weight are affected by this regulation. Our finished
polymers themselves are exempt from REACh. All additives and colorants are also potentially subject to
REACh registration.

The REACh regulation is written such that the company that imports chemicals into Europe is responsible for
compliance. INEOS ABS (USA) Addyston does not directly import chemicals into Europe. As such, INEOS
ABS (USA) cannot register chemicals under REACh.

For customers who are molding parts and shipping them to Europe, it is our understanding that importation
of parts (called “articles” in the regulation) will not have to pre-register or register chemical substances
contained in the articles unless those chemicals (total quantity over 1 metric tonne/year) would be released
from the article during normal or reasonably foreseeable conditions of use. If the article contains an SVHC
chemical, then the importer of the article or their “Only Representative” would have to notify the European
Chemicals Agency and the recipient as indicated in the REACh regulation.

If you are purchasing our products and modifying them (i.e. coloring or blending) before sending them to
Europe, there may be REACh obligations that you will need to investigate.

We hope this information is helpful in working on your REACh requirements.
