How the era of AI change compliance

1. Introduction: general problem overview and aim of the research

We live in the age of digitalization and digital technologies that is very much developing
artificial intelligence and machine learning, which in turn affects the continuous development
of technologies and products. Artificial Intelligence is fundamentally changing the approach of
compliance in companies. With the help of machine learning algorithms and natural language
processing, artificial intelligence systems, companies can simplify processes in which large
amounts of data are analyzed, patterns are identified, and similar or different factors are
identified from certain standard algorithms or procedures. The impact of Artificial Intelligence
on compliance will be particularly significant in areas such as monitoring, risk assessment and
fraud detection. Artificial Intelligence will help compliance teams automate manual tasks,
reduce human error, and optimize resource allocation.
At the beginning of 2024, an important trend shaping the future of Artificial Intelligence
is Artificial Intelligence legislation. The rapid development of artificial intelligence
technologies has not only captured our imagination, but also attracted the scrutiny of global
policymakers. Countries around the world, including the United States and the European Union,
are on the verge of introducing revolutionary Artificial Intelligence regulations. At the same
time, the adoption of the long-awaited legislation and active discussion of Artificial Intelligence
regulation does not mean that it was not used in the compliance area before the adoption of the
regulation. Active usage of the Artificial Intelligence (AI) tools has been announcing in new
releases by Serious Fraud Office on April 10, 2018 stated that: “Today, the Serious Fraud Office
announced a significant upgrade to its document analysis capability as artificial intelligence is
made available to all of its new casework from this month.
By automating document analysis, AI technology allows the SFO to investigate more
quickly, reduce costs and achieve a lower error rate than through the work of human lawyers,
alone.
Able to process more than half a million documents a day, a pilot “robot” was recently
used to scan for legal professional privilege content in the SFO’s Rolls-Royce case at speeds
2,000 times faster than a human lawyer. Building on this success, ‘Axcelerate’ a new AI
powered document review system from OpenText, is now being rolled out alongside the robot,
and will enable SFO case teams to better target their work and time in other aspects of

Companies will always have a need to implement both software products that improve
compliance with the necessary regulatory requirements and integrate artificial intelligence into
their own systems to obtain an effective compliance system. The use of artificial intelligence
and machine learning in companies significantly improves the performance of automated
repetitive tasks, in turn, allocating time for strategic issues of solving compliance problems. An
important part of the integration of artificial intelligence into the company's systems can be
used to identify risks and implement risk management processes, build certain algorithms to
predict consequences, analyze current transactions and decisions with the calculation of
financial losses, which allows companies to identify potential inconsistencies that may affect
the stability of the company.
Thus, it is obvious that the use of artificial intelligence has been going on for quite some
time; artificial intelligence is used for decision-making by both authorized state bodies and
companies, and therefore can have both negative and positive impact on the activities of any
company. That is why in this research the role of artificial intelligence in compliance will be
explored both in terms of positive and potentially negative impact on the company's operations’
activity. The goal is to foster responsible and balanced development of the AI and how the
development of the AI influence on the change of compliance risk assessment in companies.

2. Objectives
The potential impact of artificial intelligence in all sectors of the economy is critical to
affecting the operations of any company, even if it does not use artificial intelligence or
language models in its own operations. This requires determining what risks companies expect
in the business environment in connection with the active development of artificial intelligence
and its further use by any companies or individuals. The integration of artificial intelligence
into business operations is a game-changer for companies, driving them toward innovative
change. While artificial intelligence offers significant opportunities for efficiency gains, it also
creates a number of risks for companies.
Many companies are implementing an AI audit policy to understand the specific risks to
the AI tool and identify options to mitigate the risks. Understanding and managing compliance
risks associated with AI can be challenging, as assessing such risks must include the ability to
anticipate or account for developments in AI technology and the use of a sufficient database.
The essay aims to investigate two issues regarding the development and impact of
artificial intelligence on the company's compliance system, which is to study the external
factors caused by the development of AI on risk assessment and approaches to risk assessment
within the company depending on such external factors; as well as the use of AI in determining
such risks and building a reliable automated system for assessing the risks of the company's
operating activities when compiling a compliance risk matrix.
The essay aims to explore two issues: the first one relates to the development and impact
of artificial intelligence on a company's compliance system which is to examine the external
factors that are caused by the development of AI on risk assessment and approaches to risk
assessment within a company depending on such external factors; from other side - the use of
AI in identifying such risks and building a reliable automated risk assessment system for a
company's operations in compiling compliance risk assessments and risk audits.
The essay explores how the development of new language models and the development
of artificial intelligence affects the stability of a company's operations and plays a key role in
building a compliance risk management system in any industry. AI is a valuable tool for risk
management through the use of advanced algorithms and data analysis to improve risk
assessment and mitigation strategies. Whether or not it is applied in many industries, the
contribution of AI is changing the way we assess potential risks and address them. Thus, the
positive impact and prospects for further development of technologies in the qualitative
construction of business processes and business operational decision-making are being
investigated. At the same time, the essay touches upon the topic of increasing and, in fact,
creating additional risks that have arisen due to the development of artificial intelligence and
exist regardless of whether the affected company implements artificial intelligence in its
business processes or activities.
These impacts and factors will be explored without focusing on legislative regulation,
with an understanding of the basic requirements of European artificial intelligence legislation

countries. The purpose is to research, evaluate, and disclose insights into the requirements of
artificial intelligence regulation and the basic requirements for building a compliance system,
standards for building compliance systems, security, risk management, and internal audit,
revealing the opportunities and issues arising from the use and development of artificial
intelligence and language models, regardless of the existence and development of regulatory
legislation for their technological development.
The research involves identifying gaps and ambiguities, particularly in the context of
safety, liability, products, intellectual property, data protection, etc. The impact of the
development of artificial intelligence on the development of not only the tech industry, but any
industry is impressive, especially with regard to security issues and fairness or reasonableness
in decision-making. The essay will critically assess the current situation with negative attitudes
or actual ignoring of the development of artificial intelligence by companies, or the application
of artificial intelligence in their own activities without implementing or developing appropriate
necessary processes to engage in risk assessment related to artificial intelligence and large
language models. This research also aims to identify how artificial intelligence can change risk
assessment, focusing on its application to build a comprehensive risk assessment and improve
risk assessment mechanisms.
This analysis can serve as a basis for discussions within business associations or
companies on improving the risk management system and rethinking the risk assessment system
in building a sustainable business.

Methods
To achieve the comprehensive analysis of the discussed objectives, a diverse range of
research methods will be employed, each offering a unique window into this complex
landscape.
An extensive literature review of existing academic research, articles, and reports
pertaining to artificial intelligence, technology, risk management, data protection, and ethical
considerations will be conducted. A critical component of this research involves evaluating the
existing frameworks and consequences of developing of the AI in compliance risk assessment
system. This will include a general overview of relevant legislation and methods of AI
appliance in day-to-day compliance system of the company that can generate, evaluate or
influence on possible risks in business operation system.
Qualitative data, including statistical data, quantitative analysis, and market research, will
be sourced from open surveys and market research results. This qualitative data will be analyzed
to identify trends, emerging issues, and public sentiments related to the use of AI in compliance
and risk management. These methods will provide a comprehensive understanding of the
current state of AI technologies in risk assessment and the legal and ethical challenges they
present.
In addition, the research will include interviews with experts and panel discussions to
gain a deeper understanding of the practical challenges and opportunities that AI presents in the
compliance space. This approach will provide a more detailed understanding of how AI
technologies are currently being implemented and their impact on legal and ethical frameworks
in different jurisdictions.
Together, these methods will provide a comprehensive understanding of the current state
of artificial intelligence technologies in compliance risk assessment and the complex legal and
ethical issues they pose. The research aims to offer actionable recommendations for
policymakers, lawyers, and industry leaders to effectively address these challenges.

3. Findings
Compliance programs face increasing challenges as regulations become stricter, sanctions
become more severe, and threat landscapes rapidly evolve. To effectively ensure compliance,
compliance leaders need a proactive and strategic view of the risks in their organizations. While
basic risk assessment techniques provide a basic capability, it is now necessary to utilize
advanced techniques to provide the accuracy and foresight required in an environment of
greater uncertainty and higher stakes.
As artificial intelligence has become an important driver of innovation across industries,
its application to improve risk management processes is both promising and risky. Risk
assessment, an important component of any compliance program and sustainable business, has
traditionally relied on non-automated processes to assess, identify, analyze and mitigate risks.
However, the integration of artificial intelligence into this process is having an impact on the
effectiveness of the risk assessment process and system. Artificial intelligence can be used for
risk assessment by transforming traditional risk management approaches. The integration of
artificial intelligence into risk assessment paves the way for better risk identification, analysis,
and management in a variety of contexts. While the efficiency and complexity of AI-driven
processes are notable advantages, challenges related to data dependency, complexity, and the
need for human oversight remain. As artificial intelligence technology continues to evolve, it is
expected that its application in risk management will become more sophisticated.

Phishing: Phishing involves the use of fake links, emails, and websites to gain access to
a consumer's sensitive information - usually by installing malware on the target system. This
data is then used to steal other people's identities, gain access to valuable assets, and overload
email inboxes with spam. During elections, phishing emails can be disguised as donation emails
that encourage a citizen to click a link thinking they are donating to a candidate, but are actually
playing a bad actor's game.
Robotic calls, impersonations, and AI-generated voice or chatbots: As seen in New
Hampshire when an automated caller impersonated President Biden urging citizens not to vote,
the election season will see an increase in impersonations of pollsters or political candidates to
falsely gain trust and obtain sensitive information.
Deepfakes: With the advancement of artificial intelligence, deepfakes have become
incredibly realistic today and can be used to imitate your boss or even your favorite celebrity.
Deepfakes are videos or images that use artificial intelligence to replace faces or manipulate
facial expressions or speech. Many of the deepfakes we encounter on a daily basis will be in
the form of a fake video showing a person saying or doing something they may never have
done. This is expected to be especially prevalent this election season with the risk of diplomats
