Ithas come to the attention of the Port Authority that Cabana Live has been operating as an event venue with parties going until late at night (or early the following morning). The parties have been so large that the Seminole County Sherif?s Office office has reported that vehicles are overflowing the parking lot, Included with this letter is a call log from the Seminole County Sheriffs Office. In addition, multiple people were shot at this weekend's event. The Port Authority has also been notified by Seminole County that Cabana Live has been exceeding its permitted occupancy limit. There may be a host of other problems associated with this business operations, but the foregoing information are the facts that the Port Authority is currently aware of. BASIS FOR DEFAULT: Marinas, LLC is in breach of the following provisions of the Lease: ARTICLE ONE, Section B: States, in pertinent part, as follows: This Lease is made subject to: 2. Zoning ordinances of the County of Seminole, State of Florida, now existing or which may hereafter exist by reason of any legal authority, during the term of this lease. ARTICLE TEN, Section C: States, in pertinent part, as follows: “Lessee covenants that during the Primary Term and any renewal term hereof it will conform to and observe, and at its sole expense, comply with all laws, ordinances, rules and regulations of the United States, State of Florida and County of Seminole...” The actions of Cabanas Live in operating these large parties/events and likely exceeding occupancy limits is a violation of Seminole County regulations, Additionally, the nighttime operations that result in fights, shootings, and other illegal activities constitute a nuisance, as that term is defined by Section 832.05, Florida Statutes. There may be a host of other regulations that are violated by virtue of these activities, and nothing in this notice should be deemed to mean that the specifically listed violations are the only laws or regulations being violated by the actions of Cabanas Live.Seminole County ort Authority SCOPA NOTICE OF DEFAULT AND DEMAND TO CURE: Pursuant to ARTICLE SIX of the Lease, you are hereby notified that Marinas, LLC is in default of the Lease for the reasons hereinabove set forth, Should Marinas, LLC fail to cure the default within forty-five (45) days of the date of this letter, the Lease will be deemed terminated, However, this default can be cured in less than forty-five (45) days and it is imperative that the parties or other events being hosted at Cabanas Live stop immediately. For decades, a bar/restaurant business has operated without any significant incident at the Seminole County Port Authority. In November of 2022, the marina operator, which is a tenant of the Port Authority, had a new restaurant operator sublease the restaurant, Cabana Live. While that operator obtained all the proper licenses and permits for its bar/restaurant, unbeknownst to the Port Authority, the operator began conducting late-night parties in 2023. In response, the Port Authority issued on April 30, 2024, a default notice to its tenant, the marina operator, as is legally required under the terms of its lease. The marina operator has advised the Port that these late-night events will no longer take place, and that the restaurant/bar will operate as a family friendly establishment appropriate to a marina operation.
