(i)- Maintainability of Modified or Additional Claims: (Paras- 25-33, 41)

Held:

The claimant is not bound to restrict his claims to those already raised by him in the arbitration
notice. Further, unless the arbitration agreement specifically refers to certain disputes, the
parties are entitled to make any claim or counter-claim as also to amend or add to the concerned
claims; provided that the said claims or counterclaims are arbitrable in nature and within the
statutorily defined period of limitation. Furthermore, respondent has the choice of raising
disputes by way of counterclaim in pending arbitration proceedings.

(ii)- Commencement of Period of Arbitration (Paras 15 to 17):

Held: The object behind section 21 is to determine date of commencement of arbitration


proceedings for the purpose of deciding whether claims are barred by limitation or not. Section
21 supplies omission in section 3 of the 1963 Act to state date of institution or commencement
of arbitration proceedings. Any claim made beyond the statutory period of limitation would be
barred by limitation and would be rejected by the Arbitration Tribunal.

(iii)- Period of Limitation in case of Additional Claims (Para 18 and 19):

Held- (Limitation Period for Claims- Para 18)- In such cases, the date of amendment by
which additional claim is sought to be introduced would be construed as the relevant date.

Limitation Period for Counter Claims- Para 19- The date on which counterclaim is made
by the respondent before arbitrator will be date of its institution. It was further observed by the
Hon’ble Bench that section 21 is not relevant/applicable to counter-claims.

(iv)- Reference of Disputes to Arbitration-(Para 35 and 36):

It was observed that the Chief Justice or his designate shall not ordinarily consider the issue of
limitation. However, in certain appropriate cases, the Chief Justice or his designate may
consider whether an application was on face of it so hopelessly barred by time, that it is already
dead/stale claim which did not deserve to be resurrected and referred to arbitration.
