Notice Inviting Tender (NIT)

Dear Sir/ Madam,

Name of Work: Architectural Consultancy Services for BPCL Mumbai Locations and other HRS West
Projects.

1. About The Company:

Bharat Petroleum Corporation Ltd. (BPCL) is a Fortune 500 Maharatna Oil Refining and Marketing company
in India. The company produces a diverse range of products, from petrochemicals and solvents to aircraft
fuel and specialty lubricants and markets them through its wide network of Petrol Stations, Kerosene
Dealers, LPG Distributors and Lube Shops.

The HRS Entity is engaged in the creation, maintenance and upkeep of Offices and Residential Complexes for
Staff located across the country.

2. Objective of the Tender enquiry:

Bharat Petroleum Corporation Limited (BPCL) intends to engage a party Architectural Consultancy Services
for BPCL Mumbai Locations and other HRS West Projects. through Government e-Marketplace (GeM)
Portal.

The job includes Survey of the property, preparing the schematic proposal for project execution, preparation
of the final 2D presentation drawings in consultation with BPCL and 3D view of proposed development,
preparation of Working Drawings, Specifications and Schedule of Quantities, RCC consultancy which also
includes material specifications like sourcing of light fixtures, upholstery, sanitary ware, ironmongery, floor
and wall finishes and artwork (sample selection).
It also includes assistance in execution of projects, certification of measurements & invoices and submission
of as build drawings to BPCL after completion of the projects and site visit.

Any future Corrigendum/ Addendum shall be published in Government e-Marketplace (GeM) Portal only.

3. Contract Period:

The period of both the Contracts shall be Three Years from date of issue of LOI / Award of Contract whichever
is earlier.

4. Tender due date:

Tender bid submission duration will be 21 days from the date tender is floated on GeM portal.

5. Tender evaluation Methodology:

This Tender is invited through Open (Domestic) Tender enquiry as a two-part bid: Techno commercial and
Price Bid.

 Techno-commercial bid covers following criteria:

BQC (Bid Qualification Criteria) : The bidders will be shortlisted as per the minimum criteria mentioned
in the BQC.

Only bidders, who are qualifying all the bid qualification criteria shall be evaluated as per the technical
evaluation criteria.

 Price Bid.

Price bid of only those bidders shall be opened who are qualifying all bid qualification criteria. In the price
bid section, the bidder will be required to quote as per Bill of Quantity (BOQ). Successful bidder will be
evaluated on an overall L1 basis. Contract is non-divisible.

7. EMD :

An EMD amount as stated below will be collected from all the bidders.

As detailed above Original Demand Draft / Bank Guarantee needs to be sent to the Ch. Mgr. Admin Fac.
(HRS), West at BPCL, New Office Block, ‘A’ & ‘K’ Installation, Sewri Fort Road, Sewri (East), Mumbai before
the due date & time of the tender .

The bid of the bidders whose original DD/BG is not received within the due date and time of tender opening
is liable to be rejected.

However, exemption will be granted as per statutory/company guideline for MSE vendor. All the bidders
quoting as Micro and Small Enterprise, shall have to upload scanned copy of TPIA verified MSE doc. i.e., valid
“Udyam Registration Certificate” as provided in the Udyam Registration portal along with scanned copy of
CA certificate with stamp of TPIA mentioning as "verified from original", failing which such bid will be treated
as bid received without EMD and will be rejected. TPIA Certification is not required if the CA Certificate in
original is submitted at the EMD stage to Ch. Mgr. Admin Fac. (HRS), West at BPCL, New Office Block, ‘K’
Installation, Sewri Fort Road, Sewri (East), Mumbai. Successful bidder will have to submit a hard copy of CA
certificate before award of the job. The CA certificate should be dated after the date of floating of tender
enquiry and shall be specific to the tender enquiry for which bid is being submitted. The format of the CA
certificate will be attached in the tender enquiry and bidder needs to submit certificate strictly in the said
format. Else bid shall be rejected. CA certificate shall mandatorily include the Unique Document
Identification Number. CA Certificate issued/ attested without UDIN of practicing-chartered accountant in
India shall not be considered for evaluation. In case CA certificate is not submitted, bidder shall not be
considered as MSE.

DD/BG should be sent by Registered Post/ Courier to the following address so as to reach on or before the
due date & time of the tender opening.

BPCL will not be responsible for non-receipt of instrument(s) due to postal delay/ loss in transit etc. A bid
received without the EMD is liable to be rejected.

Bidder to upload EMD photocopy / CA certified MSE certificate. (CA certificate shall mandatorily include
the Unique Document Identification Number should reached at Sewree Office before the due date of the
tender else upload with certification from TPIA.)

EMD of the unsuccessful bidders shall be returned after the finalization of the award of the contract. No
interest shall be paid on the EMD amount.

EMD FOREFEITURE: EARNEST MONEY DEPOSIT WILL BE FORFEITED IN THE EVENT OF:

(a) Withdrawal of offer while the offer is under consideration during the validity period.
(b) Tenderer not accepting our Purchase Order, if placed without prejudice to our rights to recover damages
on account of breach of contract.
(c) Non-confirmation of acceptance of order within the stipulated time after placement without prejudice to
our rights to recover damages on account of breach of contract.
(d) Any unilateral revision made by the tenderer during the validity period of the offer.

8. Security Deposit:

Performance Security deposit will be collected from the successful bidder at the rate of 10% of the annual
contract value (excl. taxes) which shall be in the form of Demand Draft or Bank Guarantee in the prescribed
format. The validity of DD or BG shall be for a period of 3 years + claim period of 6 months.

No interest shall be payable on the EMD /Security Deposit/ Bank Guarantee.

9. Payment Terms: Payments shall be made in parts based on the progress achieved. (Details mentioned
in scope of work.)

10. Penalty: A penalty of Rs.1000/- per day / per project will be imposed for any delay in providing
Architectural Services.

11. The bidder must have an Office in Mumbai/ Navi Mumbai/ Thane area for easier coordination & visits to
BPCL Mumbai locations.

BPCL has set up a Business Process Excellence Centre (BPEC) for Vendor Invoice processing. BPEC will
function as a payments factory to receive, digitize, and process vendor invoices in a timely and accurate
manner. In addition, the centre will receive and account for Performance Bank Guarantees (PBGs) and
Bank Guarantees (BGs). ORIGINAL COMMERCIAL INVOICES (IN TAX INVOICE FORMAT) will need to be sent
to BPEC including Supporting Documents for Payments.

12.Assumptions/Presumptions/modifications:

BPCL would like to state that any assumptions, presumptions, modifications, terms, conditions, deviation
etc., which the bidder includes in any part of the Bidder’s response to this tender enquiry, will not be taken
into account either for the purpose of evaluation or at a later stage, unless such assumptions, presumptions,
modifications, terms, conditions deviations etc., have been accepted by BPCL and communicated to the
bidder. The bidder at a later date cannot make any plea of having specified any assumption, terms,
conditions, deviation etc. in the bidder’s response to this tender document. No offer can be modified or
withdrawn by a bidder after submission of Bids.

13.BPCL reserves the right to accept any offer in whole or part or reject any or all offers without assigning
any reason. BPCL is also not bound to accept the lowest Bid.

14.If BPCL is unable to evaluate any offer for want of information, such an offer will not be considered.

15.BPCL reserves the right to change the quantity (increase/decrease) tendered.

16.Bidders serving any Holiday Listing orders issued by BPCL or MoPNG debarring them from carrying on
business dealings with BPCL / MoPNG shall not be considered for evaluation and ordering. Quotations
received from such Bidders, shall be rejected.

17.BPCL’s decision on any matter regarding short listing of Vendors shall be final and any applicant shall not
enter any correspondence with BPCL unless asked for.

18.Your online bid should be submitted on or before the due date of this tender enquiry. E-proc site will
automatically close on the due date and time and bidders will not be able to submit their bids after the
closing time. Bids not in the prescribed format are liable to be rejected. BPCL does not take any responsibility
for any delay in submission of online bids due to connectivity problem or non-availability of site and/or other
documents/instruments to be submitted in physical form due to postal delay. No claims on this account shall
be entertained.

19.Based on the information and documents submitted, the parties who are found to be techno
commercially eligible shall qualify for the next round of the tender viz. price bid.
