MUNICIPAL ADMINISTRATION DEPARTMENT To Sri M.Manohar Reddy, Advocate, Municipal Standing Counsel, Flat No.0010., A-Block, Siva Capital Green's Apartment, Tadepalli, Guntur District Sir, It is to submit that the petitioners Sri Gutla Samuel S/o, Prabhudas and Gulta Chinni S/o, Prabhudas have filed W.P.No.3890/2023 and the Hon'ble High Court of A.P. has issued orders in W.P. No. 3890/2023 on 16-02-2023 as follows. “The Write Petition is disposed of with a direction to the petitioners to treat the impugned provisional order as a show cause notice issued to then and submit their explanation to the 3" respondent i.e. Municipal Commissioner, Akiveedu Nagarpanchayat with in 2 weeks from the date of receipt of a copy of this order. After explanation of the petitioners is submitted, the 3° respondent shall consider the same and pass appropriate orders on it, according to law. If the Petitioners fail to submit their explanation within two weeks, as ordered supra, the respondents are at liberty to proceed further according to law.” Submission of few points to the Municipal Standing Counsel for raising to the Hon'ble High Court of A.P. in W.P.No.3890/2023 and Present W.P.No.5122/2024"filed by Kadithala Deevenamma, Wio. Late Adam Thiophilus. It is humbly submitted that as per the orders of the Hon'ble High Court in W.P.No. 3890/2023, a Hearing Notice was issued on 16-08-2023 to Sri Gutla Chinni & Sri Gutla Samuel to attend for a personal hearing before the Commissioner, Akiveedu Nagarpanchayat on 12-09-2023 at 11-30 AM along with necessary document evidence. The petitioners have attended on 12-09-2023 and they have requested to give 5 more days to submit the required documents evidence. After that a final notice was issued on 01-11-2023 to remove the unauthorized construction, since no evidence is submitted to the Municipal Commissioner, Akiveedu Nagarpanchayat. Further, it is submitted that before taking further action in the mater, the Tahsildar, Mandal Revenue Office, Akiveedu has requested vide this office letter Roc. No.10/2024/G1, Dated. 15-02-2024 to appoint Mandal Surveyor for submission of survey report, since to identify owner of the dispute site. (Copy enclosed) Further, itis submitted that the Mandal Surveyor, Akiveedu has issued survey Notice to the Smt. Kadithala Deevenamma, Sri Gutla Samuel and Sri Gutla Chinni to attend on 24-02-2024 at 9.00 AM. and co-operate for the survey. (Copy enclosed)But, the Smt. Kadithala Deevenamma and her sons have not co-operated with the surveyor for conducting survey. Further, it is submitted that immediately they have filed another W.P. No. 5122 of 2024 in the Hon'ble High Court of A.P. |n this connection, | humbly submit that Smt. Kadithala Deevenamma and her sons have approached the Hon'ble Collector, West Godavari District in Spandana on last Monday 26-02-2024, and the District Collector, West Godavari has informed to them to co-operate for survey because it seems to be a civil dispute and also instructed the Municipal Commissioner, Akiveedu don't allow further construction on the disputed building until the land dispute is finalized. In view of the above, the Tahsildar, Mandal Revenue Office, Akiveedu has requested vide this office letter Roc.No.10/2024/G1, Dated.02-03-2024, once again to appoint Mandal Surveyor for submission of survey report, as per oral instructions of the Hon'ble Collector, West Godavari District (Copy enclosed) Further, itis submitted that the Mandal Surveyor, Akiveedu has issued survey notice once again to the Smt. Kadithala Deevenamma, Sri Gutia Samuel and Sri Gutla Chinni to attend on 07-03-2024 at 9.00 AM. and co-operate for the survey. (Copy enclosed) But, the Smt. Kadithala Deevenamma and her sons have not attended to the ‘Survey and not co-operated with the surveyor for conducting survey. Further the Mandal Surveyor, Akiveedu has submitted his report stating that * The Tahsildar, Mandal Revenue Office, Akiveedu has requested vide their office letter Roc.No.10/2024/G1, Dated. 02-03-2024, once again to appoint Mandal Surveyor for submission of survey report. Following the above letter again on 07-03-2024 notices were issued to attend the survey. However, she has not attended survey and no one is attended on behalf of Smt. Kadithela Devanmma. Smt. Kaditala Deevenamma and her neighbors Sri Gootla Samuel and Sri Gootla Chinni and others residing at Aakiveedu Revenue Village in R.S.No.470 and area as per FMB in R.S.No.470 is Ac.152.28 Cents. The Mandal Surveyor as reported that no subdivision has been done in the Government records in respect of the above land and as per BSO 344, Para 20 (a) itis not possible to determine the boundaries without consent of both the parties and hence the occupation of the above land cannot be established as stated in his report on 11-03-2024”. Its further submitted that an Endorsement was given through Register Post to the Both parties ie., Sri Gootla Samuel S/o. Prabhudasu, Sri Gootla Chinni S/o. Prabhudas and Smt, Kaditala Deevenamma, Akiveedu vide this office Endorsement Roc.No.10/2024/G1, Dated. 12-03-2024 duly informed to them to co-operate with the ‘Mandal Surveyor for conducting the survey with in 15 days, since itis a civil dispute and if the both parties are not co-operate the Survey, the same matter will be submitted to the Hon'ble High Court.Further It is submitted that, there are no sanctioned posts in the Newly Constituted Akiveedu Nagarpanchayat and One Municipal Commissioner is Appointed in Full Additional Charge, One Manager on deputation and One TPO is deputed for Election purpose as AERO, Akiveedu Nagarpanchayat and the Municipal Commissioner, Manager, and TPO are entrusted to 60-Undi Constituency Assembly General Elections in the O/o Returning Officer.
