PLATIFFS AND THE DEFENDANTS 8 TO 10 AND 30TH DEFENDANT BEG TO
STATE AS FOLLOWS:
1. That the plaintiffs filed the above suit for partition of the suit schedule
properties.
The defendants 8 to 10 filed an application for dismissal of the suit as
the same is
barred under Proviso to Section 6 of Hindu Succession Act in respect of portions
of
Iten No.4 to 6 of the suit schedule properties, so far as related to the properties of
the defendants 8 to 10. The said application is pending for consideration
.. 2.
During pendency of the above suit ahd the application, the plaintiffs, the
defendants 8 to 10 and 30th defendant, at the intervention of their brothers, friends,
well-wishers and middiemen, settled the disputes between them amicably in full and
final settlement of all their clains in respect of portions of Item No.4 to 6 of the suit
schedule properties belongs to the defendahts.8 to 10 in the following manner:

I. That the plaintiffs and defendant No.30, admit and concede that defendant

No.8 was the absalute owher in possession and enjoyment of 3 Acres of land
in Sy.No.78, i.e., portion of Item No.6 of the suit schedule property, having
purchased the same under the registered sale deed Dt: 21-10-1993,
registered as Document No2460/1993-94, of Book-I, Volume 3776 at pages
55-65, registered in the sub-registrar, Bangalore South Taluk and that the 4th
plaintiff is also signatory to the same. The sale is in accordance with law. That
the 8 the defendant in turn sold the same to Smt. Lakshmi Prakash and the
defendant No.9 under two different sale deeds DT: 30-08-2005 and 29-08
2005, registered as Document No.7102/2005-06 and Document
No.7103/2005-06 respectively.

That the plaintiffs and defendant No.30, admit and


concede that
defendant No.9 is the absolute owner in possession and enjoyment of 1
Acres
of land in Sy. No.77, i.e., portion of Item No.5 of the suit
schedule property,
having purchased the same under the registered sale deed DT: 21-10-1993,
,registered as Document No2453/1993-94, of Book-I, Volume 3776 at pages
48-55, registered in the sub-registrar, Bangalore South Taluk. The sale is in
accordance with law. The 4h plaintiff is also signatory to the samel.
That the plaintiffs and defendant No.30, admit and
concede that
defendant No.10 is the absolute owner in possession and enjoymènt of 1
Acres 09 Guntas of land in Sy.No.72, i.e., portion of Item No.4
of the suit
schedule property, having purchased the same under the registered sale
deed DT: 20-10-1993, Registered as Document
No2458/1993-94, of Book-I,
Volume 3776 at pages 153-162, registered in the
sub-registrar, Bangalore
South Taluk. The sale is in accordance with law. The 4h
plaintiff is also
signatory to the same.
IV. In termns of the settlement, the plaintiffs agrees to withdraw the above
suit in full and final settlement of all their claims, title and interest in respect of
portions of Item No.4 to 6 of the suit schedule properties i.e., in respect of the
properties scheduled to this compromise petition and they have also agree to
modify/amend the schedules of Item 4 to6 of the suit schedule properties.
V. And on the request of the plaintiffs and the defendant No.30, the
defendants 8 tò 10 agree to give 5.5 Guntas of land i.e., 2 Guntas of land in
Sy.NO.77 and 3.5 Guntas of land in Sy.No.78 on the eastern side of Item 5
and 6 of the schedule propertles to the plaintiffs and defendant No.30, which
is shown in green and yelloW color in the sketch annexed to this compromise.
The annexed sketch may be treated as part and parcel of this compromise.

3. In view of the above understanding, 'the plaintiffs and defendant No.30


withdrawing their claim in respect of portions of.tem No. 4 to 6 of the suit schedule
properties without any demur or reserving any manner of rights in them in full and
final settlement their claim, the plaintiffs have absolutely no manner of right, title or
interest in respect of the properties of the defendants 8 to 10. In view of the dispute

having been amicably settled between the parties as
aforesaid, the plaintiffs
unconditionally withdraws all their allegations made in the suit
against the
defendants and in respect of the
compromise petition schedule properties.
4 That the plaintiffs and the defendant No.30
have no objection for the defendants
8 to 10 in getting podded their
lands and further the plaintiffs and
here in shall not in any manner interfere with the rights or
defendant No.30
possession of the
defendants 8 to 10 in respect.of compromise a) to c)

entered into between the parties without any
Coercion, undue influence or threat from any angle, The
interest of both the parties. The compromise is in the best
contents of the compromise is

parties. They have understood the
contents of the compromise and felt that the
compromise is at the best interest of the plaintiffs and the

parties have understood the contents of this reasonable. Both the
compromise to the language known to
them by explaining the contents of the same through
their Advocates.
6 It is agreed between the plaintiff and
the defendants that in view of the
aforesaid compromise they have no claims whatsoever against
each other.
WHEREFORE, the plaintiffs the defendánt No.30 and the defendants 8 to 10
pray that this Hon'ble Court be
pleased to dispose off the above suit in terms of the
compromise in the interest of justice and equity.
