P E T I T I O N

COMES NOW petitioner and to this Honorable Office

respectfully alleges:

1. That petitioner is of legal age, Filipino Citizen, and

with address at No. 82 Kamuning Road corner K-D Street,
Kamuning, Quezon City, Metro Manila, Philippines.

2. That petitioner is one of the two children and one of

the heirs of the late LEONIDA APOSTOL FORTUNA, who is
the registered owner of the property covered by Transfer
Certificate of title No. 004-RT2010006442 (313718) of the
Registry of Deeds of Quezon City.

3. That on ________________________, petitioner registered

an Affidavit of Adverse Claim before the Registry of Deeds of
Quezon City, which was given due course by the Register of
Quezon City.

4. That the ground adhered to in the filing of the adverse

claim -- non settlement of the estate of the late Leonida
Apostol Fortuna -- by petitioner has been rendered moot and
academic by petitioner’s execution of the Affidavit of

Adjudication of the estate of the Late Leonida Apostol Fortuna

and estate of the late Celia Apostol Fortuna, petitioner’s co-
heir, who died intestate on September 7, 2019.

5. That this petition is filed within the periods prescribed

by law.

6. That this affidavit is being executed to attest to the

veracity of the foregoing facts and for all legal intents and
purposes.

P R A Y E R

WHEREFORE, premises considered, it is respectfully

prayed that the adverse claim annotated at the back of
Transfer Certificate of title No. 004-RT2010006442 (313718) of
the Registry of Deeds of Quezon City mentioned in this petition
be cancelled.

Petitioner prays for such other relief just and equitable

under the premises.

Deeds of Quezon City pending in any other court, tribunal or
quasi-judicial agency; and

Should there be one, she shall report that fact within five
(5) days to this Honorable Office.
