ORDER

As per Criminal Information dated ________, the accused is charged with


the crime of Violation of Batas Pambansa (B.P.) 22, AN ACT PENALIZING THE
MAKING OR DRAWING AND ISSUANCE OF A CHECK WITHOUT SUFFICIENT
FUNDS OR CREDIT AND FOR OTHER PURPOSES, wherein the penalty fixed is
“imprisonment of not less than thirty days but not more than one (1) year or by a
fine of not less than but not more than double the amount of the check which fine
shall in no case exceed Two Hundred Thousand Pesos, or both such fine and
imprisonment at the discretion of the court (Section 1, B.P. 22).”

This case is thus covered by the Revised Rule on Summary Procedure


in conjunction with A.M. No. 08-8-7-SC, RULES ON EXPEDITED
PROCEDURES IN FIRST LEVEL COURTS.

Although a bail bond is recommended in the Criminal Information


presupposing the necessity of an arrest, the Court, however, is prohibited by
Section 4 of the above Rule from issuing a warrant for the arrest of the accused
in criminal cases governed by the Rule on Summary Procedure, except for
failure to appear despite notice, whenever required.

Accordingly, accused ___________ is hereby required to submit to this


court a judicial counter-affidavit and the judicial affidavits of his or her witnesses,
as well as any other evidence in his or her behalf, within fifteen (15) calendar
days from receipt of this order. Attached herewith are copies of the resolution
of the investigating officer and the judicial affidavits and other evidence submitted
by the prosecution.
Except on rebuttal, no witness shall be allowed to testify unless his or her
judicial affidavit was submitted in compliance with this order.
