Respected Mam,
I Amit Swaika, son of Shambhu Dayal Swaika, residing at Hanuman Enclave, 21/3, Arbindo
Road, Salkia, Flat No. – B 1, 7th Floor, Near Bazar, Kolkata, Howrah – 711106 want to inform
you that I was having a property of Hanuman Enclave, 21/3, Arbindo Road, Salkia, Flat No. –
B 1, 7th Floor, Near Bazar, Kolkata, Howrah – 711106 which was mortgaged before the
financial institution Shriram Housing Finance Limited. We entered into a Loan Agreement on
2020 for about 7 years at a monthly EMI of Rs. 35789/- and also paid amount to bank
regularly But suddenly 2nd wave of covid 19 pandemic raised and market completely closed, we
have faced huge amount of losses which we till now not completely recovered from market but
somehow we managed and paid amount to NBFC Official As per our ability till now we are
paying monthly amounts before the Bank. And Bank officials assures us they will restructured
The Loan if we paid some amounts on every month till March 2024, the new equated monthly
installments will be started from April, 2024.
Suddenly, 06.02.2024 I came to know that when I received a letter from NBFC my loan A/C
declares NPA earlier by the NBFC and they got a under Sec- 14 Sarfaesi Act Order from Ld.
District Magistrate of Howrah. I am trying to contact NBFC officials but they denying our
requests and also forgetting their promises.
In this regards I would request you to please allow me to give my submission in the matter if
any pending in front of you so that I can also get justice from yours end & request you not to
take any action in the above mentioned matter as I am in the physical possession in the same
from last 3 years and Also prays before you that not to proceed any further order under Section
14 of Sarfaesi Act 2002.
