Prologue

The decision to issue this White Paper is to reflect the deep concerns shown by the
public at large in Pakistan about their stolen mandate and international level serious
observations pertaining to blatant abuse of democratic norms and values which were required
to take roots on strength of ballot. The opportunity to bring political stability has once again
been lost due to meandering and manipulation of Election Results.

The White Paper is a collection of detailed information from national and international
electronic and print media and records provided by our lawmakers who contested election
and were a witness to ground realities and various abuses demonstrated by ECP in stealing
the public mandate.

The reporting of international and national watchdogs, NGOs and human rights
organizations was given special space to authenticate the situation prevalent in Pakistan in
relation to atrocities, inflicted to PTI workers and leaders leading up to and on day of poll and
post-poll including managing the election results as per pre-planned rigging strategy.

The data collected based on Form-45 of all snatched national and provincial
constituencies was fed to an Analysis Cell comprising experts and analysts for collation,
interpretation and transforming it into cognizable material evidence to prove the corruption
and corrupt practices committed by the ECP staff and ROs. The analysed data was also
subjected to third-party audit for its correctness and authenticity.

To this end Pakistan Tehreek e Insaf finds it as a sacred responsibility, being majority
federating Political Party, towards people of Pakistan who came out and voted or supported
(being abroad); to ascertain the truth, fair play and transparency of General Elections 2024.

On
Pakistan General Elections 2024

Part-1-Structure of Elections
1. Enshrined under Article-218 of Constitution of Pakistan Election Commission of Pakistan
(ECP) as an independent Constitutional Body is established to conduct elections to all
public offices as specified by the law. ECP consists of four members who have been Judges
of a High Court from each Province and a Chairman. The duty of Election Commission shall
be to organize and conduct election honestly, justly, fairly and in accordance with laws and
that corrupt practices are guarded against.

2. Duties of Commission are preparation of electoral rolls for election to the National and
Provincial Assemblies, Senate, appointing Election Tribunal and holding of General and
local government elections.

3. ECP performs the duties of Returning Officers (ROs), appoints enumeration staff and
prepare proposals for Deputy and Assistant to ROs.

4. Form 45. On conclusion of polling the presiding officers (POs) in the presence of all polling
agents counts the ballot papers and issues it to the polling agents and is publicly displayed
outside each polling station. The form is authenticated by the senior most Assistant PO
and also by PO with signatures and thumb impression.

5. Form 47. Form-47 aggregates the results of entire constituency based on Form-45 results.
This form consolidates the data from all signed Form 45s received from POs in presence
of contesting candidates or their representatives and is attested by the RO. The total of
Form-47 must match with Form- 45 vote count.

6. The rigging with impunity by changing the Form-45 or in certain cases Form-47 by the RO
at stage of compilation was committed.

7. Presiding Officer is the highest authority at polling station responsible for smooth running
of the affairs and he reports to a RO. He ensures security of ballot boxes and related
material and everyone follows ECPs code of conduct. He takes Form-45 to his RO and
ensures it is duly received.

8. ROs are generally judges by profession, contrary in Elections 2024, executive officers were
deputed these duties. ROs receive nomination papers, scrutinize them as per the law,

appoint polling staff, supplies election material, collect Forms-45 and consolidate results
of whole constituency.

9. The returning officer prepares provisional consolidated statement of results of the count
of the constituency under Section 92 of Elections Laws. The RO announces the same in the
presence of the candidates or elections agents or authorized observers as may be present
and shall affix a copy of such results in his office.

10. The Election Act, 2017 Section 13(3) binds RO to communicate the scanned copy of the
Form-47 to ECP electronically on or before 02:00 am the day immediately following the
polling day and in case of delay reasons to be submitted in writing along with the result.
The provisional results must be sent as soon as compiled but not later than 10:00 am.

11. As per Election Act ,2017 Section 90, Presiding Officer gives signed results to each polling
agent and as per Section 95 RO provides consolidated result to each candidate or to his
agent or authorized representative.

12. Election observers as per Section 238 of Election Act 2017 are the organization's tasks to
monitor various phases of elections for greater transparency and fairness in Elections.

Part-2-Pre-Poll Rigging

1. Overstepping of Constitutional Limits of 90 Days


a) Punjab and KP Assemblies were dissolved on 14th and 18th Jan 2023 respectively and
under Article 58 of the Constitution elections were to be held within 90 days.
b) Supreme Court on petition of PTI ordered to hold elections of Punjab Assembly on
May 14th, but due to delay in issuing the notification by the Governor, elections could
not be held.
c) Similarly, Governor of KP also did not give any date of election by design and hence
election went over the 90 days limit.

2. Illegal Extended Tenure of Caretaker Set Up


a) PM Shehbaz Sharif led PDM Government dissolved assemblies few days prior to
completion of its tenure which allowed caretaker Government to hold election within
90 days instead of 60 days (had assemblies been allowed to complete their tenures).
b) In contravention to constitution of Pakistan the caretaker cabinet illegally continued
well beyond the mandated period of 90 days till general elections on 8th February
2024.

3. Partial, biased and well planted Federal and Provincial Caretaker Setups to favor PDM
a) The caretaker cabinet included members with strong political affiliations naming few
Mr. Fawad Hassan Fawad, who served as PS to two former PMs of PMLN, Nawaz Sharif
and Shahid Khakan Abbasi, Umar Saif who served under Shahbaz Sharif as Minister in
Punjab, Mr. Sarfraz was senator of PPP and Jalil Abbas Jilani cousin of former PM of
PPP, Yousaf Raza Gillani. All others had also political affiliations and lineage towards
PDM in one form or the other.
b) These caretakers already involved inflicting atrocities to PTI during PDM Regime
continued with their nefarious fascist designs unabated rather at intensified level
during their tenure till election.
c) The open abductions, torture, harassment, destruction of property and a general
crack-down on people supporting the PTI, remained dark side of caretaker setup.

4. The London Plan and Assassination Attempts


a) The horse trading to overthrow the PTI Government, the ban on media, two murder
attempts including one of physical armed assault where former PM Imran Khan got
bullet injuries, atrocities on PTI leadership, frivolous and baseless cases and
punishments all are termed as "Part of London Plan”, to subdue PTI and prepare
grounds for reinstating PDM-2.

5. False Flag Operation of 9th May and Post PTI focused Operations
a) The former PM Imran Khan was forcibly abducted on 9th May 2023 from within the
premises of Islamabad High Court. This barbaric abduction sent waves of shock and
anger of manhandling of Pakistan most popular leader.
b) Abduction was done by the persons in Rangers uniform, a force commanded by
uniform Army Officers, it was hence presumed to be act of Military Establishment.
Crowds gathered at distant points from the prohibited areas like cantonments etc.
were instigated to move towards various Army Centres to voice their protests. It
included corps commander residence Lahore, GHQ Rawalpindi and few other places
in Peshawar and Faisalablad.
c) It was public at large and not PTI response only which was accurately anticipated and
precisely utilized to exploit the situation against the PTI.
d) Documentary by BBC and other notable media have proven this was a pre planned
operation, created so as to instigate and then guide and lead the public to move to a
particular point.
e) The false flag operation was used to abduct thousands of men and women of PTI,
leaders, workers and supporters and to this day final references have not been filed in
the courts.

6. Judicial Inquiry Demand of PTI on 9th May


a) Chairman PTI and its leadership condemned the incident and asked for judicial inquiry
to meet the requirement of justice and fair play.
b) Not acceding to the request of judicial inquiry has caused deep shadow over the
conduct of inquiries, investigations and subsequent trials of 9th May against PTI
leaders and workers.

7. Murder of Zille Shah and Death of incarcerated PTI leader Ibad Farroq's Son
a) Ammar son of Ibad Faroooq already suffering from a mental illness could not bear the
shock of repeated raids harassment and arrest of his father and died in hospital.
b) Zille Shah a handicapped PTI supporter was picked up, killed in Police custody and was
thrown on roadside pretending to be a road accident. PMIK was implicated in this
murder on baseless charges.

8. Major Offices of PTI Sealed


a) The PTI offices were closed across the country and even when re-opened on Court
orders, they were resealed under one pretext or the other.

9. Role of Judiciary
a) Petitions of various grievances submitted before the Courts were either not
entertained or were put to pending.
b) Petitions like role of caretaker beyond 90 days, their illegal status, and dispensations
(against constitution) were intentionally not persued by SCP.
c) Overall SCP remained in area of wanting in protecting the Constitution of Pakistan.

10. Electoral Rolls and Polling Schemes Rigging
a) Constituencies where PTI had secured a large number of votes were changed/ altered.
The rule was amended where administration boundaries could be ignored in forming
the Constituencies. Free and Fair Election Network (FEFEN) has made its observations.
b) Registration of New Voters
i) NADRA was involved in pre poll rigging by allotting polling stations to newly
registered voters at far away locations. Most of the young voters were
believed to be PTI supporters.
c) Deletion of Names from Electoral Rolls
i) Large number of votes were deleted from the voters list, which created
huge problems and shortage of PTI vote bank.
d) Stoppage of information available through 8300 by NADRA
i. For several weeks prior to election the facility of 8300 providing the
details of votes was discontinued and got re-activated one week close
to election date causing it to stall under heavy traffic.

11. Media Censorship and Harassment of Journalists


a) In August 2022 PEMRA (Regulatory Authority on Media) imposed ban on broadcasting
live speeches of PMIK. On 5th June 2023 ban was imposed on even taking name or
showing picture of PMIK on electronic media which continues to date.
b) Kashif Abbasi anchor ARY after taking name of PMIK apologized publicly and
backtracked to his statement. Hamid Mir revealed to Guardian `that he was unable to
take PMIK name on Pakistan TV.
c) Almost all PTI spokespersons were banned to appear on mainstream TV channels.

12. Snatching of Nomination Papers


a) Police and persons in plain clothed laid ambushes and established lookout posts to
snatch nomination papers from PTI candidates or from their attorneys.
b) About 37 incidents in Punjab were reported and many more could not get media
reporting.
c) Mrs. Pervaiz Elahi was mistreated while submitting nomination papers and 74 years
old mother of Usman Dar was physically abused and harassed during raid on her
home.

13. Targeting PTI Women Politicians


a) Continued imprisonment of women associated with PTI since May 9th 2023 to date
raised additional red flag. Those women who subdued and gave video statement
under coercion or joined other political parties were relinquished from all charges and
declared innocent.
b) The democratic fabric of the nation was eroded which was built by PTI in bringing
women folk in mainstream politics. Few to name are Sanam Javaid whose papers were
rejected without any cogent reasons, Zartaj Gul stayed with Peshawar High Court till
late night to get her protected bail, Yasmeen Rashid a cancer survivor 74 years old is
in jail since almost now one year.
c) The other PTI workers women prisoners suffering for unforeseeable length of time are
Ms Alia Hamza (since 11 May 2023), Ms Tayyaba Ambreen (17 May 23), Ms Fahmida
Begum (3 June23), Ms Robina Jamil (Since 24 June 2023), Ms Afsha Bibi (6 July 2023),

Ms Samaya Asad (10 July 2023) Ms Arena Naeem (15 July 23), Ms Sadia Naz (6 Aug 23)
Ms Tasneem Akhtar (6 Aug 23), Ms Farkhanda (Aug 23) and Ms Aysha Bhutta (12 Aug
23).

14. Underhand Methods to deter Candidates from Filing Nomination Papers


a) Abduction of candidates to prevent them from submitting nomination papers,
campaigning, and competing became rampant after issuance of election schedule.
b) Proposers / Seconders were abducted/ arrested to deny verification of nomination
papers of PTI candidates.
c) Torture of candidates and their families and relatives was also experienced to keep PTI
out of poll process by demoralizing the potential law makers.
d) Raiding and ransacking homes, businesses and properties of candidates and their
family members, friends, supporters were done without any legitimate cause,
warrants or reasons. The primary objective remained to spread terror in the hearts of
PTI leaders, voters and supporters.

15. Rejection of 90% of Nomination Papers and 90% reversal of ROs decision by the Courts
a) About 90% of nomination papers were rejected by the ROs of PTI candidates on flimsy
grounds and contrary 90% ROs decision were reversed by the Courts. The executive
officers already involved in committing atrocities to PTI appointed as ROs gave
repeated performance.
b) The Human Rights Commission documented a litany of legal oblongs by PTI including
fake FIRs and rejection of nomination papers raised suspicions of manipulated
electoral process.
c) Human Rights Pakistan says PTI being dismembered in a systematic manner and
election process is being engineered as 90% of their nomination papers have been
rejected.

16. Blockade of Access to Internet during virtual gathering


a) The blockade started from May 2022 when PMIK was holding mass rallies and online
speeches and interviews. Such interruption continued even in 2023 at an intensified
level.
b) The PTI virtual fund raising on 7th Jan 24 was subjected to complete media blackout.
c) According to Alp Toker, director of net block, targeting political activities on such a
large scale through social media across is highly uncommon. The suspension affected
ecommerce, online services and ride hailing apps to a great extent.
d) Virtual election rallies organized by PTI were blocked which curtailed ability of Party
to communicate effectively with its voters.
e) The Human Rights Council condemned these actions being violations of constitution
and law of the land.

17. Blockade of PTI Virtual Rallies
a) Virtual rallies of 17 December 23 and 20th Jan 24 were disrupted nationwide.
b) According to Live Metrics provided by internet tracking agencies these disruptions
raised concern about freedom of expression.

18. Illegal Arrests and Forced Statements


a) After 9th May large number of PTI workers and leaders were abducted or illegally
arrested and subsequently produced before the TV channels for admission of quitting
politics or PTI or announced joining of other political parties.
b) These press conferences exonerated all of them without any court relief, this
demonstrates a state within a State effectiveness and helplessness of judicial system
of the country.

19. Appointment of Bureaucrats as ROs


a) Mother of all rigging plan was appointing executive officers as ROs who had been
instrumental in inflicting all types of atrocities with impunity to PTI supporters and
leaders.
b) PTI made an appeal to Lahore High Court which was intercepted by SCP before its
hearing stage and ECP was ordered by SCP to issue election schedule alongside
training of executive ROs by midnight of the day order was passed.

20. Denial of Election Campaigning to PTI


a) The imposition of Section 144 across Punjab curtailed PTIs ability to hold peaceful
assemblies during critical days from 25 Jan to 12 Feb 2024.
b) Amnesty International expressed grave concerns on widespread restrictions on
peaceful assemblies of PTI and PTM (Pashtun Tahafuz Movement).

21. Taking Away of symbol of Bat


a) ECP dishonestly held back decision on PTI Intra Party Election for one and a half year.
b) PTI went to Peshawar High Court and obtained order for immediate issuance of
pending decision. In response ECP rejected Intra Party Elections and ordered PTI to
hold elections within twenty days.
c) PTI completed Intra Party Elections within twenty days but were declared null and void
by ECP and resultantly it took away Bat symbol. PTI went in appeal to Peshawar High
Court and got order of ECP reversed. ECP went in appeal to SCP who against Article-
17 favored ECP and maintained its order of taking away of Bat symbol from PTI.
Contrary even not holding intra party elections ANP was just levied with the fine and
allowed to contest the elections.

22. Exclusion of Top Leadership of PTI from General Election
a) Following cases of PMIK former Federal Minister Mr. Shah Mehmood Qureshi and
former First Lady Bushra Bibi were hurriedly concluded (3 Cases within 5 Days) and
punishments were handed down to keep them out of election and to deter voters not
to vote to a convict, morally and financially corrupt leader. The TURN OUT, on 8 Feb
proved other way round.
I. Iddat Case
After framing of charge, twelve and eighteen-hours hearing were conducted
on two consecutive days and seven years punishment was given to PMIK and
Bushra Bibi. The critique says that in last fourteen hundred years of Islamic
history, a man was first time punished in performance of Sunnah of “Nikah”.
II. Tosha Khana Case of NAB
PMIK was awarded 14 years imprisonment under the baseless allegations of
taking away gifts from Tosha Khana by under invoicing and also bypassing the
official channel. Case was tried in jail where defence witnesses were not
allowed, prosecution witnesses not permitted to be crossed examined and
plea of accused went missing. All these steps being essential milestones of fair
trials were denied to accused person PMIK. It was one sided biased and unjust
trials with utter abuse of criminal laws procedures and practices.
III. Cypher Case
a. Ten years sentence was awarded to PMIK and former Finance Minister Mr.
Shah Mehmood Qureshi on the allegations that disclosure affected the
bilateral relationship, compromised national security and disturbed
diplomatic communication channel.
b. The Act of 1923 amended in Aug 2023 retrospective applied was illegal.
c. Defence was not allowed to cross examine witnesses.
d. FIR instead getting registered by MOF was lodged by MOI.
e. As per rules departmental inquiry on misplacement/ loss of cypher and based
on the inquiry police investigation to recover or establish the crime of its
recovery from on illegal unauthorized recipient was not established.
f. PM Oath binds him to reveal issues of public interest hence there was no
violation of oath.
g. Cypher down classified by highest executive authority i.e Cabinet lost the
security status.
IV. Tosha Khana Misdeclaration case of ECP
a. ECP forwarded Tosha khana gifts mis-declaration case for trial where PMIK
was awarded three years imprisonment alongside disqualification to keep him
out of election.
b. Same property, same set of accused with crime committed in a same timeline
cannot be put to trial twice. In this case punishment was awarded by District
& Session Judge (3 Years) and as well as by Special Judge Accountability (14
Years).

c. It was maximum an Income Tax case that too civil in nature.
d. During trial defence star witness MS to PM and accountant were not
permitted to appear.
b) Apart from above referred white collar crime related cases, around 200 police cases
of different nature were registered mainly under terrorist act against PMIK and PTI
Leadership.

Part-3: Poll Day Rigging and Result Manipulation

1. The Communication Blockade


a) Despite announcing that communication would not be blocked and being warned by
Access Now, the government implemented country wide shutdown of communication
just before commencement of polling on 8th Feb.
b) This disrupted much needed coordination by the staff, political parties, and voters to
seek location of their polling stations by sending message on 8300.
c) The HRCP issued a stern call for immediate reinstatement of communication and to
take punitive action against PTA authorities in violating government earlier orders, but
all in vain.

2. Denial of Entry of PTI Polling Agents


a) In several constituencies reported up to 66 in total, with 46 from Punjab, PTI polling
agents were not allowed to sit in violation of election laws.
b) In Nawaz Sharif, Shahbaz Sharif and Maryam constituencies PTI polling camps were
even removed and agents were denied entry into polling stations.

3. Refusal of Issuance of Form-45/Early Results Reports by Media


a) The PTI polling agents in various constituencies of Punjab, Balochistan and Sindh were
not provided with Form-45.
b) The mainstream media at 3 am reported, PTI Independents as per Form-45 had
surpassed the simple majority by attaining 154 clear wins, followed by PMLN, PPP,
MQM and JUI. These numbers were reported by Hum TV and Geo TV along with other
mainstream media channels.
c) When many constituencies neared completion of the results the update was stopped.
The ROs as per law were required to communicate results by 2 am were not allowed
to do so.

4. Comparative Reports on Discrepancies in Form-45 and 47


a) The Intercept reported that results were tampered using Form-47, which is sum of all
Form-45.
b) Few results positions reported by “The Intercept” are mentioned here:
I. NA-47 Shohaib Shaheen (PTI) Vs Tariq Fazal (PMLN)
The polling score was 46307 Vs 19536. Tariq was declared success full and
unsetting trend was repeated in NA-48 and NA-49, Islamabad despite lead
of 14396 and 18467 votes. Subsequent results accrued from Form-45
established lead 40000 and above in each constituency by the PTI
Independents.
II. NA-55 Basharat Raja (PTI) Vs Malik Abrar (PMLN)
As per Geo report Raja was cruising to victory with impressive tally of
76380 to 36618 but final outcome defied these results and he lost the
contest.
III. NA-57 Ms Seemabia (PTI) Vs Danyal (PMLN)

Pervasive nature of electoral fraud was experienced where PTI candidate
emerged with staggering lead of over 50,000 was undermined through
Form-47 result manipulation, and she ultimately was declared runner up.
IV. NA-58 Ayaz Amir Vs Major (R) Tahir Iqbal (PMLN)
In Chakwal Ayaz Amir despite securing substantial victory by a wide
margin found himself on a receiving end of an unexpected outcome.
V. NA-64 Qaisra Elahi (PTI) Vs Salik Hussain
The initial lead was of 35000 votes of Qaisra Elahi wife of Pervaiz Elahi
when results declaration based on Form-45 stopped. Based on Form-45
Qaisra Elahi has staggering lead of 130,000 which was manipulated by RO
through Form-47 and opponent Ch. Salik was declared winner.
VI. NA-171 Ms Rehana Dar (PTI) Vs Khawaja Asif (PMLN)
With the commanding lead of 49000 votes, Khawaja was declared winner
and Rehana total count was reduced to 31434 as of 131,615 votes.
VII. NA-128 Barrister Salman (PTI) Vs Aun Chaudhry
With the surge lead of 100000 votes over the second best candidate,
within a day Raja found himself trailing and Aun Chaudhry was declared
the victorious.
VIII. NA-151 Mehr Bano (PTI) Vs Syed Ali Moosa Gilani (PPP)
In NA-151, Form 47 revealed as startling number of over 16000 rejected
votes casting doubt on the validity of the final tally. The vote count based
on Form-45 presents a contrasting narrative, with Meher Bano Qureshi
emerging as the clear victory with a substantial lead of 5000 votes.
IX. NA-163 Shaukat Basra (PTI) Vs Muhammad Ejaz ul Haq (PMLN)
PTI candidate Shaukat Basra was leading, however overnight, the PMLZ
candidate who was at number three position was declared winner. As per
Form-45 Basra bagged 96,710 votes followed by PMLN with 74333 and
Ijaz Ul Haq with 58822 votes (declared winner).
X. NA-236 Alamgir (PTI) Vs Hassan Sabir (MQM-P)
Alamgir who won 2018 by election; as per Form-45 claimed to have
100,000 votes in his favour but in officially declared results got reduced
to margin just over 1000 votes.
XI. NA-238 Haleem Adil (PTI) Vs Sadiq Iftikhar (MQM-P)
Initial reports from Sama News indicated Haleem leading in the polls by a
margin of about 9000 votes, in official declaration he lost the election.
Based on actual Form 45s Haleem Adil Sheikh secured 81,023 votes vs
10,164 votes secured by Sadiq Iftikhar, giving PTI a lead of 70859 votes.
However this lead was flipped and Sadiq Iftikhar was declared the winner.
XII. NA-241 Khurram Sher Zaman (PTI) Vs Mirza Baig (PPP)
Khuram faced similar ordeal; based on Form-45 he had 78044 votes to his
credit against 7297 votes by Mirza Ikhtiar Baig who was declared winner
denying Khuram the victory.

5. PTI contesters Barred in consolidation Process


In almost all snatched constituencies, PTI contesters were not allowed to participate
in consolidating Form-47. Barrister Salman was expelled from the premises of RO

office in Lahore, and his assistant was subjected to physical assault. Ayaz Amir was
forced out of the ROs office and then RO was forced to sign the doctored results.

6. Confessional Statement of Commissioner Rawalpindi Liaqat Ali Chattha On 17 Feb


Commissioner Rawalpindi Liaquat Ali Chatha admitted that rigging in election was
committed by him and lead of up to 50 thousands was cut down to defeat of PTI
candidates. He resigned and presented himself to Police for arrest under criminal breach
of trust charges.

7. Testimonial of other Parties Contesters So far around fourteen political figures of other
parties admitted the win of PTI and either surrendered their constituencies or gave
testimonial statement regarding manipulation of results. These concerns were echoed by
TLP and JI Candidates with the acknowledgement that PTI candidates received the highest
number of votes and supported the contention of irregularities in the electoral process.

8. Rejection of Reserved Seats and its Distribution to other Parties


a) ECP rejected petition of SIC for reserved women seats and minorities and allocated
the prescribed number to other political parties over and above of their authorized
quota as per seats they won on ground.
b) The PTI tags this a post poll manipulation and rigging by ECP, against the dictates of
Constitution.

9. International Media Reporting


a) Time Magazine. Pakistan’s military used every trick to sideline Imran Khan-and failed.
b) France 24. The general election in Pakistan turned against the military.
c) CNBC. Pakistan’s Ex PM Nawaz declares victory in fraught election.
d) Financial Times. IK loyalists win shock victory in Pakistan’s election.
e) CBC News. IK Party defied the odds in Pakistan.
f) The Guardian. Attempt to ignore IK and his supporters may trigger further unrest and
instability.
g) Bloomberg. The independents strong performance points to IK enduring popularity.
h) The New York Times. The success of IK upended the decades-old political playback
governing Pakistan.
i) Washington Post. Despite all hurdles, voters over willingly turned out across the
country to cast vote in favor of IK’s cause.

10. Reports of International and National watchdogs


a) United States Institute of peace
I. Verdict of the people. The victory of PTI backed candidates defies the
expectations of political pundits in Pakistan. Military establishment seen to be
blocking IK and backing PMLN attempt was not supported by the people of
Pakistan.
b) Excerpts from the Report of the Commonwealth Observers Group
Report raised concerns about the restrictions placed on internet access particularly
it’s shutting down on elections day, which curtailed freedom of speech, ease of
communication and other political rights. Party symbol denial to a main political party

effected candidates to conduct election effectively. They also conveyed concerns that
members of the affected party would not be eligible for reserved seats.
c) Report by Free and Fair Election Network (FAFEN)
FAFEN reported that its observers were not allowed in 135 constituencies out of a
total 260 by the ROs. All provisions on Election Laws 2017, like consolidation for Form-
47 provision of Form-48 under section 95 (9), and Form-49 (final consolidated results)
were not adhered to. ROs in 65 constituencies prohibited candidates from
participating in the tabulation process.
d) PILDAT Report on General Elections 2024
I. Considerable delay in scheduling of the election.
II. Suspension of communication on polling day compromised EMS and restricted
participation in electoral process.
III. Delay in announcement of results cast shadow over the election process.
IV. Widespread allegations of discrepancies in Form-45 and 47.
V. Failure to publish Form 45, 46, 47, 48 and 49 on ECP website within 14 days
questioned integrity of election results.
VI. Delayed decision of allocation of reserved seats, to SIC or otherwise.
VII. Way Forward
a. Decision by Election Tribunals within 180 days and increasing their number to
the level of Election 2018 where Punjab had 8 now there are two.
b. Election inquiry Commission on the form of Election 2013 to ensure
accountability of electoral process for fair play and merit.

11. Reserved Seats Denied to SIC


a) On March 4th ECP gave ruling on technical grounds that SIC backed by PTI can’t get
reserved parliament seats.
b) SIC challenged the decision in Peshawar High Court and met unfortunate fate of
dismissal of petition.
c) PTI Legal Team plans to go to SCP and maintains opinion that seats as per the
Constitution got to have a definite proportion to the constituencies won on strength
of ballot and not otherwise.
12. By- Elections 21 April 2024
a) By- Election were announced by ECP for Six NA, Twelve Punjab, Two KP, Two
Baluchistan and One for Sindh Assembly.
b) By- Elections were plagued even worse than the General Elections with rigging from
pre-poll to poll day and subsequent result manipulation. Following observations were
made:
i) Restricted freedom to campaign by PTI contesters.
ii) PP- 36 candidate house was raided and PS- 80 contester under extreme coercion
withdrew from candidacy.
iii) NA- 8 Bajur returning officer reported through letter ransacking his office and
physical assault and beating of DEO MR. Hazratullah by ISI officers.
iv) Signatures of POs were taken in advance on Form- 45.
v) NA- 196 and 207 (against Asifa Zardari) nomination papers were rejected.
vi) Shutdown of cellular services on Election Day.

vii) Stuffing of ballot papers and misconduct during consolidation.
viii) Manhandling of media reporters and harassment.
c) PATTAN has reported massive rigging in by elections including ballot stuffing and
fraudulent practices of advance signing of Form-45 prior to beginning of election.
Polling stations were changed, polling agents of SIC were not allowed to sit, 40%
exiting voters claimed to vote for SIC, and 25% for PMLN. Popularity of PTI since 8th
February as per report has not changed.
d) Intelligence agencies blamed by PTI in manipulating elections including IB, ISI, Special
Branch, Field Intelligence Unit and MI are demanded to be questioned.

1) Out of National Assembly House of 266, PTI has 158 NA seats with 60 to 100%
of actual Form-45 held and analyzed.
2) With winning proportion established at 59% and below based on original Form-
45, PTI has a total of 173 NA seats; four less than 2/3rd majority i.e. 177.
2. The petitions filed before Election Tribunals list of 72 NA PTI candidates with supported
Form-45 is appended below. This number of constituencies has prosecutable evidence
supported with Form-45 and Tribunals under the law if dispense decisions within
stipulated period of 180 days; the National Assemble position will shift to 94+72= 166

6. Analysis of KP Assembly
a. PTI in KP assembly at present has 92 seats out of 115 constituencies’ strength in
total. A total of Fourteen PTI contesters with Eight having more than 95% of original
Form- 45 has gone to Election Tribunals with the prayers for decision based on Form-

PTI DEMANDS
The Whitepaper issued by PTI containing material evidence bears testimony that the
General and By-Elections 2024 were manipulated and rigged starting from the Pre-Poll Phase
to the culminating point of the Government Official Gazette Notification. The testimonial
statement of Commissioner Rawalpindi involved in rigging and a letter of NA-8 , RO
pertaining to manhandling of his staff added to the PTI position and claim of corrupt
practices where whole election scheme was managed with impunity. In By-Election advance
signing on Forms- 45 by polling agents under duress was reported by PATTAN.
The surrendering of constituencies by the winning candidates in favour of PTI speaks
volumes about the integrity icons we have in the arena of politics but also cast dark shadow
over the unfortunate decay of our institutions in the realm of their integrity, fair play and
justice in accordance with the Constitution of Pakistan.
The mandate of the public at large and the people of Pakistan have been subjected to
blatant robbery in broad daylight, putting them in a state of dismay and helplessness against
the hope of bringing change through the strength of the ballot. PTI demands following as a
pathway towards true democracy:
● All institutions should connect under the given dictates of Constitution of Pakistan to
navigate through the impasse created by the General Election - 2024 by reverting to
actual and true mandate of public bestowed in PTI based on Form- 45 vote count.
This will bring much-needed political stability warranted for economic stability, State
badly needs at this point of time since its coming into existence.
● The Supreme Court of Pakistan should exercise the vital power vested in it by the
Constitute of Pakistan under Article 184 (3) to guard the Constitution by exposing the
systematic and countrywide electoral fraud.
● Independent judicial commission be formed to investigate the whole process of
election’s fraud and those involved in heinous crime of social injustice, corruption
and corrupt practices of cheating the public mandate especially Election Commission
of Pakistan if found guilty be charged under the dictates of law. Commission should
have access to the reports prepared by various independent observers including the
EU Mission, PATTAN, PILDAT, FAFEN, Common Wealth Observers Group, US Institute
of Peace etc. and should have power to summon any person for recording his/her
statement.

● Judicial Commission may also be tasked to recommend appropriate electoral reforms
for bringing transparency, fair play and merit in the election system so that
opportunities of manipulation are brought to minimum as is demonstrated in
developed democratic countries.
● Imran Khan should be released immediately, and all politically motivated cases
against him and other PTI leadership, and supporters should be withdrawn. Those
responsible for instigating these baseless cases should be held accountable for
undermining the integrity of justice.
The democracy loving people of Pakistan call upon the International Community to support
them in their struggle for democratic processes marred and abused since over five decades
and the request is based on equality of rights for all in accordance with the Constitution of
Pakistan, regardless of ethnicity, religion or gender.
