AFFIDAVIT ON BEHALF OF THE COMPLAINANT IN COMPLIANCE

OF THE SECTION-65 B OF THE INDIAN EVIDENCE ACT, 1872.

I, Nikhil Nikam, S/o Rajan Nikam, aged about 38 years, Authorized

Representative (“AR”) of Syngenta India Private Limited, having its registered
office at Survey No - 110/11/3, Amar Paradigm, Baner Rd, Baner, Pune,
Maharashtra 411045, presently at New Delhi do hereby solemnly affirm and
declare as under: -

1. I am the Authorized Representative of the Complainant company in the

captioned matter and therefore I am well versed with the facts of the case
and as such competent to depose this affidavit.

2. I state that I have been given the e-mail Id nikhil.nikam@syngenta.com

by the Complainant for use in connection with its business.

3. I state that the Complainant herein has relied upon electronic records
pertaining to the present case.
4. All electronic records annexed by the Complainant along with the
accompanying Complaint have been accessed by me from my aforesaid
e-mail id on my Computer system/laptop having model name - HP
Elitebook, Device ID: 3CB6C3FF-4A3E-4CB7-8E44-3F6508161519
(“My Laptop”). My Laptop has been used regularly by me to store and
process the electronic information/records for the purpose of the business
of the Complainant.

5. That My Laptop has been used regularly by me to store data and access
electronic information/records for the purposes of the business of the
Complainant. I further state that the printouts of the electronic records
have been taken from the printer RIOCH having Model No. PCL6 V4
Driver for Universal Print, that is attached with My Laptop. I have
verified the contents of the aforesaid electronic records placed on record
on behalf of the Complainant and certify that the same are true and
correct reproduction of their respective originals.

6. I state and confirm that the printouts of the electronic evidences being
placed on record were produced by my laptop and during that period my
Laptop was used regularly by me to store or process information in
ordinary course of business. My laptop was under my lawful control and
was functioning normally during all the times relevant for these
proceedings.

7. Accordingly, I am submitting this Certificate to certify that the print-outs

of electronic records placed on record by the Complainant are “true
copies”/ reproduction of the electronic record which was fed
into/transmitted through My Laptop in the ordinary course of business. I
further state that at all times My Laptop was operating properly and there
 is no distortion in the accuracy of the contents of the print outs of
electronic record being placed on record.
I say that the statements made above are true and correct to my knowledge
based on my experience and information obtained from the records.

CERTIFICATE UNDER SECTION 65B OF THE INDIAN EVIDENCE
ACT, 1872

This is to certify that the electronic records pertaining to the matter produced
herein are the printouts from the record maintained in the laptop used by me in
its regular course of business. It is further stated that the printer from which the
printouts have been taken is connected to the said Laptop and the same are
under my direct control. The said Laptop is being operated regularly by me or
on my behalf, in the ordinary course of business activities.
