The petitioner’s grievance is that respondent No. 5 Zamir Ahmed whose nomination
papers have been accepted in respect of Ward No.2 T.C Khipro however he belongs to
Ward No.05 and according to learned counsel for the petitioner the nomination papers of
Zamir Ahmed have been illegally accepted as a person can only contest from the Ward in
which he is registered and not from the other Ward. This position has already been
confirmed by this Court at Sukkur Bench in Constitutional Petition No. d-585 OF 2022
vide order dated 31.05.2022

Notice was served upon respondent No.5 Zamir Ahmed and he was also
informed by Mr. Abdullah Hanjra, Senior Law Officer and Ghulam Mustafa, Returning
Officer Town Committee, Khipro however, respondent No.5 has preferred to remain
absent.

The respondent No.5’s nomination papers reveal that he is from Ward No.5 and not
from Ward No.2 Mr. Ghulam Mustafa, Returning Officer Town Committee, Khipro
present with record also confirms that respondent No.5 Zamir Ahmed is a registered voter
at Ward No.5. Under these circumstances, the nomination papers of Zamir have been
accepted contrary to law and as such this petition is allowed
