Worksheet

1) Does Bob Jones have a right to file a lawsuit against Mr. Smith? Give an example of what type of
cause of action Bob could file

Yes, Bob Jones can take legal action against Mr. Smith due to intentionally detaining him and denying his
freedom. This could be an element of a lawsuit for false imprisonment or IIED.

3) What type of lawsuit would Mr. Jones file?

In case of wrongful detainment, Mr. Jones can take legal action against Mr. Smith in a bid to get paid
back and compensated for all that he has been through.

4) What type of evidence does Mr. Jones have to present to a court of law?

For Mr. Jones case, he will have to produce some evidence of what happened including witness
statements from Mary Crabtree and John Wilson; any tangible objects or papers seized at the arrest
time and also hospital documents evidencing any injuries resulting from the act of false imprisonment.

5) Could Mr. Jones ask for a monetary or other form of compensation judgement from the judge for
damages? Yes/No, briefly explain why you chose your answer.

Yes, Mr. Jones is entitled to claim compensation in the form of a monetary judgment for undergoing
wrongful incarceration, from the judge. The reason for this is that he underwent emotional torture,
which could cost him some money because he was kept in the wrong hands of Mr Smith.

There are other ways in which Mr. Jones might seek reparation but be careful what you wish for. For
example, will the court require Mr. Smith to say sorry or make a public admission that he has gone
against the law with regard to Mr. Jones and vice versa; and will it also include a decree ordering Mr.
Smith not to communicate with or approach Mr. Jones in any manner after this?
