We have been informed that the VISHAL & RADCO Group hereinafter referred to as "the candidate")
has responded to your call for tender number 08 / CMD / MPME / SOMAGAZ / 2020 for the
construction of a 3300 m³ LPG sphere, the rehabilitation and requalification of two LPG spheres of
2000 m³ each, the rehabilitation of the LPG network, and the upgrading of the fire-fighting system of
the NOUAKCHOTT filling center and submitted its offer to you dated 08/03/2021 ( Hereinafter
referred to as "the offer")

Under the provisions of the tender documents, the tender must be accompanied by a tender
guarantee.

hereby undertake, without reservation and irrevocably, to pay you, at first request, without the need
for a formal notice or from any legal proceeding, any sums of money that you could claim up to the

Your request for payment must be accompanied by a declaration certifying that the candidate has
not fulfilled one of the obligations to which he is bound by virtue of the tender or has been the
subject of a sanction within the framework of the procurement procedure. market :

a) If he withdraws the offer within the validity period specified in the letter of submission of the offer;
or

b) Having been notified of the acceptance of his offer by the Contracting Authority during the period
of validity as indicated in the letter of submission of the offer or extended before the expiration of
this period:

i. If he does not accept the corrections made to his offer during the evaluation and comparison of
offers; or

ii. If he doesn't sign the contract; or

iii. If it does not provide the guarantee of proper performance of the contract as provided for in the
instructions to candidates.

c) If it has been the subject of a sanction by the disciplinary commission of the regulatory authority
for public contracts or a competent court, having as its object the confiscation of the guarantee that
it has provided within the framework of this contract,
This guarantee expires: (a) if the contract is awarded to the candidate, when the latter provides the
performance guarantee issued on your behalf or (b) if the contract is not awarded to the candidate,
on the earlier of the dates following: (i) when we receive a copy of your notification to the candidate
of the rejection of his offer or (ii) of the publication of the final contract award notice and or (iii)
thirty (30) days after expiration the period of validity of the offer.

Any request for payment under this guarantee must be received by this date at the latest.
