MOTION FOR CLARIFICATION

COMES NOW William Carrington, Defendant pro se, and files this motion for

clarification as follows:

1. On December 4, 2023 Defendant filed a motion to dismiss.

2. On March 5, 2024 both parties attended a hearing regarding the Defendant's Motion to

Dismiss (Motion10), and the Plaintiff's Cross-motion for Summary Judgment (Motion

11).

3. Judge Knipel wrote an order on March 7, 2024 which stated “Both Motions and Cross

Motions are denied. See decision of appellate division 11/8/2023. File a Note of Issue

within 30 days and proceed to trial.” A copy of this is attached hereto as Exhibit A.

4. During the hearing the Plaintiff was told the reason why their summary judgment was

denied was for lack of standing in accordance with the appeals decision.

5. During the hearing the Defendant was not told the reason why his motion to dismiss

was denied.

WHEREFORE Defendant respectfully asks the judge to provide a clarification as to the

reason why the motion to dismiss was denied.
