 PROHIBITION ON HAZING:

Nullity of Waiver and Consent (Section 12, RA 11053)

 PERSONS LIABLE:
1. Liable as Principals

Hazing 1. All persons who actually planned OR participated in the conduct of the

2. All incumbent and former officers, nonresident members, or alumni
of the fraternity, sorority or organization who are actually present during the
hazing;

3. The adviser of the fraternity, sorority or organization who is –

a. Present when the acts constituting the hazing were committed; and
b. Failed to take action to prevent the same; or,
c. Failed to promptly report the same to the law enforcement
authorities, if such adviser or advisers can do so without peril to their
person or their family. Penalties (Section 4, RA 11053)
 PERSONS LIABLE:
1. Liable as Principals (cont’n);

Hazing 4. Officers or members who knowingly cooperated in carrying out the
Act of hazing by inducing the victim to be present thereat;

5. Members who are present during the hazing when they are intoxicated
or under the influence of alcohol or illegal drugs;

6. Any person who shall intimidate, threaten, force, or employ, or administer

any form of vexation against another person for the purpose of
recruitment in joining or promoting a particular fraternity, sorority, or
organization.

 PERSONS LIABLE:
1. Liable as Principals (cont’n);

Hazing 7. Owner or lessee of the place where hazing is conducted, when he has

to their person or their family;

8. Parents if held in the home of one of the officers or members of the

fraternity, group, or organization, when they have actual knowledge, the hazing
conducted but failed to take any action to prevent the same OR failed to
promptly report the same if they can do so without peril to their person or their
family.

 PERSONS LIABLE:
1. Liable as Principals (cont’n);

Hazing 9. any person present, even if such person is not a member of the fraternity,

2. promptly reported the same to the law enforcement authorities if they can
do so without peril, to their person or their family.

10. The incumbent officers of the fraternity, sorority, or organization

concerned shall be jointly liable with those members who actually participated in
the hazing.

1. Liable as Accomplice;

a) They have consented to the hazing; or
b) Have actual knowledge, but failed to take any action to prevent
the same; or,
c) Failed to promptly report the same if they can do so without peril to their
person or their family.
