CONTRACT OF SERVICE
-and-
GERLY A. SALANATIN, of legal age, Filipino and with residence at Barangay Tagburos,
Puerto Princesa City, hereinafter referred to as the “SECOND PARTY”,
WITNESSETH that:
1. GENERAL PROVISIONS
a. The SECOND PARTY hereby possess the education, experience, special or
technical skills for the position which falls under General Administration
and Support Services (GASS);
b. The FIRST PARTY is in need of services of the SECOND PARTY who shall
perform work not performed by the personnel of the FIRST PARTY but not
of the functions of vacant regular plantilla positions or those functions
which are declared redundant or no longer relevant;
c. The SECOND PARTY has signified his/her intention, to which the FIRST
PARTY has accepted to provide the service needed by the latter;
d. The PARTIES hereto understood that this Contract of Service does not
create an employer-employee relationship between the FIRST and the
SECOND PARTY for the services that the latter shall deliver, perform, or
accomplish within a specific period but not beyond the budget year, and is
not considered government services, thus he/she is not entitled to
government benefits or grants enjoyed by regular personnel of the FIRST
PARTY such as Personal Economic Relief Allowance(PERA), Additional
Compensation Allowance(ACA), and Transportation Allowance(TA);
e. The SECOND PARTY is required to have complete knowledge of
Department of Education’s vision, mission, goals, and working familiarity
with priority program, project and activities (PPAs) to be able to effectively
contribute to its accomplishment;
f. Programs, projects, and activities, processes, functions, and services are to
be carried but with due diligence and efficiency, and in conformity with
appropriate administrative, financial, technical, economic, engineering
practices, sound social and environmental standards, and in conformity
with the principles, policies and guidelines set forth by the Code of
Conduct and Ethical Standards (RA 6713 and IRR), Anti-Red Tape Act (RA
No.9485) and the Vision and Key Result Areas laid down by Executive
Order No. 43 s. 2011;
2. WARRANTIES
The SECOND PARTY hereby attests that:
a. He/She is not related within fourth degree of the consanguinity or affinity to
the hiring authority and/or representative for the FIRST PARTY;
b. He/She has not been previously dismissed from government service by reason
of an administrative offense;
c. He/She has not already reached the compulsory retirement age of sixty-five
(65);
d. He/She demonstrates the following qualities:
Sharp observation skills;
Good reading and writing skills;
Physically fit;
Honesty;
Integrity;
Courtesy;
C. EMPLOYMENT CONDITIONS
a. The SECOND PARTY shall report to work, perform his/her functions at a
time and schedule as maybe required by his/her school head which shall not be less
than eight (8) hours a day. In the exigency of public service, he/she maybe required
to work during weekends, holidays and render overtime services;
b. The SECOND PARTY shall be required to log his/her attendance in a
logbook/biometric for the purpose and shall be required to submit a Monthly
Accomplishment Report to the school head who shall issue a Certificate of Services
Rendered (CSR) for all individuals serving under her. The CSR shall include the
number of deductible days, if any. The CSR shall serve as the individual or job
provider’s time record and shall officially be transmitted to the Accounting Office not
later than every 3rd day of the following month for the preparation of payroll;
c. The SECOND PARTY is expected to be at the workplace or station everyday
except for the official breaks. Tardiness and leaving the workstation without
permission shall not be tolerated which shall be taken up as a day’s absence when
committed in three instances;
d. Absences may be excused at the discretion of the school head which shall
not be more than twenty (20) days for the duration of the contract. Absences during
work on weekends or holidays required by the school head, and three (3) instances of
tardiness which shall be treated as day’s absence, shall be included in the
computation of the allowable allowances;
e. The FIRST PARTY shall automatically terminate the services of the SECOND
PARTY without prior notice when he/she incurred three (3) absences a month, and
not more than a total of fifteen (15) absences for the duration of the Contract;
f. Should the SECOND PARTY desires to renew his/her contract of service,
he/she must undergo performance evaluation through the school head via a
performance evaluation instrument. The performance evaluation result shall be
attached to the request of renewal of the contract and shall be primary basis of
his/her renewal.
3. FUNDING
a. Funding for this contract shall be charged to School Maintenance and Other
Operating Expenses and payment will be subject to accounting and auditing rules
and regulation.
