of August 2013, in between (1) Ms. Hunny D/o Sh. Prem Wadhwa R/o A-14, Hathi Khana, Delhi-06, hereinafter called the first party.
AND
Manoj Kumar S/o Late Sh. Ram Chander R/o S-133-134,
Gandhi Vihar, Delhi-9, hereinafter called the second party.
Which expression shall mean and included unless
repugnant to the context, heirs, legal representatives, executors, administrators, successors and assigns of the parties above named.
Whereas the 1st party is having a shop bearing
no.A-43, Akhara Kutub Road, Delhi-06 in which 1 st party running her business of Decoration articles etc being its sole proprietor.
Whereas the 2nd party has approached to 1st
party and shown his desire to run the said business at the said shop of 1st party on contract basis.
And on the following terms and conditions has
been settled in between the parties:
NOW THIS AGREEMENT WITNESSETH AS FOLLOWS:-
1. The 2nd party shall operate/run the said
business of 1st party from the said shop of the 1st party and for this 2nd party shall pay Rs.1000/- (rupees one thousand only) per day to 1st party against receipt. 2. The daily expenses of the shop that i.e. electricity, water, tea, rent etc etc shall be borne separately only by the 1st party. 3. That the 1st party shall have no concerned whatsoever of any nature with purchase and sell of business items or its profit and loss by 2 nd party and the 2nd party shall pay rupees one thousand only daily without committing any default. In case of three consecutive default of 2nd party in making daily payment as stated above, the 1st party shall have every right to cancel/terminate the above said contract and 1st party shall take over the said business under her charge/hand and 2nd party shall not raise any objection upon it. 4. That above said contract is only for a limited period of 11 months which has been started from August 2013 and end by 30.06.2014. Any party to this agreement can cancel/terminate present agreement/ contract by sending one month advance to other party of the present agreement. 5. That any dispute in between in the parties shall be referred to the sole arbitrator namely Sh.Ram Kumar Dua, who has been appointed by both the parties mutually with their own free consent. 6. That the present agreement have been read over and explained to both the parties of the present agreement in vernacular and both the parties after fully understanding the same put their hands out of their sweet will, without any pressure, duress, coercion, undue influence from any concern. In witnesses whereof all the parties of the present agreement have signed and thumb marked this agreement on the date and time mentioned above in presence of the following witnesses:-
