Description Commercial port management company that overseas transportation in the


maritime industry. It is forty one percent owned by the Fiji Government, thirty
nine percent owned by Fiji National Provident Fund, and twenty percent owned
by Aitken Spence.

ii. Legal The Health and Safety at Work Act of 1996, Part II, Section 17(1), grants the duty
requirements of holder the right to designate health and safety representatives to conduct workplace
hazard inspections at any time, with or without prior notice, in order to detect potential
identification
hazards and guarantee worker safety. They can also be present for health and safety-
related interviews, go along with inspectors on inspections, and look into complaints
pertaining to occupational health and safety. According to the duty holders'
responsibilities under HASAWA 1996, this makes it possible to effectively identify
and manage workplace hazards.

iii. Legal Under the Health and Safety at Work Act of 1996, Part II, Section 9(2), employers
requirements of are responsible for ensuring the health and safety of their workforce by offering safe
risk control workspaces and work procedures, plant and substance safety arrangements,

information and training, safe access and working conditions, a safe working
environment with welfare facilities, and a health and safety policy created in
collaboration with employees. These responsibilities, which are a part of the risk
control procedure, are meant to reduce risks and safeguard workers.

v. Regulatory Employers in Fiji are required by Regulation 66 of the Health and Safety at Work
requirements of Regulations to identify workplace hazards in order to protect their employees. This
hazard implies that they need to identify potential hazards and develop mitigation strategies.

In order to protect their employees and other people at work, employers need to
evaluate the risks and implement safety and health precautions. In the end, it's critical
for Fijian employers to identify workplace risks and ensure the health and safety of
their staff.

vi. Regulatory Where traffic control is involved, employers are required by Regulation 58 of the
requirements of Health and Safety at Work (General Workplace Conditions) Regulations 2003 in Fiji,
risk control to manage risks related to traffic in the workplace. This includes enforcing medical

fitness and licensing requirements for drivers, putting traffic control measures into
place, and reducing risks through the use of safety systems, signage, and barriers.
Workers in locations where there is a risk of accidents should dress in bright colors.
For a safe working environment, enclosed areas where vehicles are operated need to
have enough ventilation.

viii. Best Practice: According to Regulation 7 of the Maritime (Fiji Maritime Code) Regulations 2014,
Hazard employers whose ships are longer than fifteen meters are required to undergo surveys

x. Best Practice: All materials used in the risk control process need to be of the highest caliber, adhere
