Dear Mr. Ford:

The Office of the Secretary (OST) received and reviewed your letter dated February 6, 2023
requesting approval to amend JTA’s 2018 BUILD paper grant agreement (PGA) adding certain
special condition language.

OST understands that the proposed special condition would allow JTA to shift federal funds
budgeted for autonomous vehicles to other eligible activities prior to the expenditure deadline of
September 30, 2025 and purchase federally compliant autonomous vehicles with non-federal funds
after the expenditure deadline. OST does not approve JTA’s request to amend the 2018 BUILD
paper grant agreement with this special condition.

Please submit a whitepaper outlining JTA’s alternative option for advancing the Bay Street
Innovation Corridor project within the allotted time constraints.
