Terms and Conditions:

1. Coverage of the named vehicle will begin on the initiation date stated on the first page of this
Agreement and upon the issuance of the Warranty Authorization Number, the receipt of this signed
Agreement and/or fulfillment of payment terms as agreed. Ensurall reserves the right to cancel this
Agreement and/or refuse a claim in the event of non-payment, or if a payment plan is in place, and
payments are not current.
2. Ensurall reserves the right to refuse coverage if a breakdown is to occur within the first thirty (30)
days, or within the first 1500 kilometers traveled, following the purchase of this warranty.
3. The Warranty Holder hereby certifies that the information contained in this Agreement is true and
correct as of the initiation date stated on the first page of this agreement. The Warranty Holder
further certifies that the named vehicle is in proper operating condition as of the initiation date
stated on the first page of this Agreement. In the event that any information is determined incorrect
or misleading, this Agreement shall be deemed void and any monies obtained will be returned to
the Warranty Holder less the cost of the vehicle inspection (if performed) and an administration fee
of $99.00.
4. Subject to the Terms and Conditions as contained herein, Ensurall warrants that it will cover the
warranty holders named vehicle and all reasonable costs Covered by this Agreement during the
term of the warranty, when a Mechanical Failure or Breakdown has occurred. For the purposes of
this Agreement, a Breakdown or Mechanical Failure means: the failure of a Covered Part under
normal service. A Covered Part has failed when it can no longer perform the function for which it
was designed solely because of its condition and not because of the action or inaction of any non-
Covered Part.
5. Maximum Liability for the Full Term of the Policy: The total liability for this Agreement cannot
exceed the retail value of the named vehicle at the point of repair.
6. Maximum Per Claim Liability: The maximum liability limit per claim cannot exceed the retail value
of the named vehicle at the point of repair.
7. Vehicle Eligibility: Excluded vehicles: Any vehicle with over 200,000 kilometers; Vehicles used
partially or exclusively for the following purposes: taxis, courier vehicles (including passenger
vehicles used for courier use), chauffeured vehicles, Ride-hailing or Ride-Sharing Services; delivery
vehicles; snowplows or vehicles for which a snow plow is attached; tow-trucks; vehicles used for
racing (professional or non-professional); police vehicles; ambulances and mobile canteens trucks;
Warranties on vehicles that fall under any of the above-excluded categories will be canceled and any
monies received will be returned to the Warranty Holder.
8. Maintenance Requirements: In order to maintain eligibility for coverage, the Warranty Holder must
perform fluid changes on their vehicle according to the manufacturer’s requirements, including any
special instructions (i.e. special oil, or increased frequency, for vehicles that have a high portion of
short journeys (city driving) or operate in severe weather conditions). Engine oil and filter must be
changed every 10,000 kms or once a year (whichever comes first) or according to the
manufacturer's guidelines if frequency is more. “Do-it-yourself" maintenance is not accepted under
any circumstance. Required maintenance documentation must include: The name and contact
information of the licensed repair or service facility; Date and work order number and/or invoice
number; Warranty Holder’s home address and phone number; the vehicles VIN, make, model and
year and current kilometers; a description and breakdown of maintenance performed and
associated costs; proof of payment is required by credit card or debit card receipt (cash not
acceptable). The required maintenance documentation may be requested before claim approval.
Ensurall reserves the right to refuse claims based on negligence to perform the required
maintenance services and failure to present the required documents to substantiate such required
maintenance.
9. Deductibles: A $100 deductible applies to all repairs, unless the $0 option has been selected and
paid for and is indicated on the first page of this contract.
10. Warranty Coverage: Only the parts and applicable labour time described below are covered in the
event of a mechanical failure or a breakdown. Diagnostics are covered if the claim is covered by this
warranty (Maximum Diagnostic Time deemed reasonable is 1 hour). Software updates or
programming is only covered when a covered part is replaced.
a) Engine: (Parts and Labour) Internally lubricated parts when damaged from within including
but not limited to: Head gasket, engine block; cylinder heads; crankshaft and main bearings;
crankshaft gears; connecting rods and bearings; camshaft and bearings; camshaft gears;
push rods; pistons; rings and pins; intake and exhaust valves; valve springs and retainers;
guides; lifters; rocker arm; shafts and pivots; harmonic balancer and pulley; timing chain; oil
pump and shaft; ring gear; oil separator; valve cover; variable valve timing motor; intake and
exhaust vanos solenoids; oil pan.
b) Turbocharger and Supercharger: (Parts and Labour) Internally lubricated parts when
damaged from within; including but not limited to: Housing; Wastegate actuator; Wastegate
controller; Compressor valves.
c) Automatic Transmission: (Parts and Labour) Internally lubricated parts when damaged from
within including; but not limited to: torque converter; valve body; gear sets; main and
intermediate shafts; clutches and bands; oil pump; flywheel; Ring gear.
d) Manual Transmission/Transaxle: (Parts and Labour) Internally lubricated parts when
damaged from within including but not limited to: Housing; Main and intermediate shafts;
Gear sets; Synchronizer rings; Shifter fork; bearings.
e) Differential (front and rear): (Parts and Labour) Internally lubricated parts when damaged
from within including but not limited to: carrier gear and case; drive pinion and pinion gear;
differential cover; bearings; mounts.
f) Transfer Case: (Parts and Labour) Internally lubricated parts when damaged from within
including but not limited to: housing; main shaft; gear group; sprocket and chain; bearings;
shims.
g) Driveline: (Parts and Labour) Drive Shaft, Drive Axle and Universal Joints.
h) Seals & Gaskets: (Parts and Labour) Gaskets and oil seals that leak from Covered Parts
components. Minor leaks/seepage or fluid oozing are considered normal and are not
covered.
i) Power Steering: (Parts and Labour) Rack-and-pinion gear; Power Steering Pump; Tie rod
ends.
j) Electronic Ignition Systems: (Parts and Labour) Starter; Starter solenoid; Ignition electronic
module.
k) Brakes: (Parts and Labour) Master cylinder; brake booster; wheel cylinders; brake split valve;
disc brake calipers; flexible hydraulic brake lines and fittings; oil seals; combination valve;
Vacuum assist booster pump; Parking brake linkage and cables.
l) ABS Brakes/Traction Control System (TCS): (Parts and Labour) ABS/TCS pressure regulator;
Pump pressure accumulator; Hydraulic pump; Hydraulic pressure valves.
m) Front Suspension: (Parts and Labour) Ball joints; upper and lower suspension arms;
bushings; links; hub and wheel bearings (excluding shock absorbers and air suspension
n) Rear Suspension: (Parts and Labour) Ball joints; upper and lower suspension arms; bushings;
links; hub and wheel bearings (excluding shock absorbers and air suspension).
o) Airbag Electronics: (Parts and Labour) Airbag module; Airbag cable/contact coil; Clock
spring; On/off switch.
p) Cooling Systems: (Parts and Labour) Water pump; Radiator; Heater radiator core; Coolant
overflow tank; Oil Cooler (excluding lines); Thermostat.
q) Air Conditioning Systems: (Parts and Labour) Compressor, clutch, clutch assembly and
pulley, condenser and evaporator, orifice tube, lines, accumulator, dryer, high and low
pressure cut‐off switches, Gas filling and other refrigerating products are covered only when
a covered part is repaired.
r) Emission System: (Parts and Labour) Air induction system; Air pump; Canister purge
solenoid; Deceleration valve; EGR/EFE thermal vacuum switch; EGR/EFE valve; Engine oil fill
cap; Fuel fill pipe and cap; Fuel fill neck restrictor; Fuel receptacle; Fuel tank pressure control
valve; Idle air control valve; Intake air resonator; Intake manifold; Oil/air separator; Positive
crankcase ventilation valve (PCV; Secondary air injection system and throttle body assembly
(MFI); Diesel Fluid Additive heater and pump (excluding lines).
s) Fuel Injection Systems: (Parts and Labour) Fuel injectors; Fuel pump and metal fuel links;
Fuel tank and fuel gauge; Fuel pressure regulator and fuel rails.
t) Electric Systems: (Parts and Labour) Automatic temperature control/programmer-display
unit; Heater blower switches; Main dashboard digital display cluster; Power door locks:
switches, door control module and solenoid; Power window Switches, motors and
regulation gearing; Power seats: switches, motors and regulation gearing; Power rear-view
mirror motor; Heater Blower; Alternator; Windshield washer pump; Rear window washer
pump; Front and rear wipers: motors, switches, regulation gearing; Side-view mirrors:
switches, motors and regulation gearing; Power sunroof: switches and motor; Headlights:
Switches; Headlamp: switches; Turn signals: switches; Daytime running lights: module;
Emergency warning flashers: Switch; Climate control seats; Rear window defroster: switch;
Trunk: actuator; ECM/PCM; Cameras; Cruise control components.
u) Sensors (Parts and Labour) O2 sensor; NOX sensor; turbo-compressor sensors; Automatic
transmission electronic control sensors; Electronic Ignition sensors; Daytime running lights
sensors; Headlight sensors; Adaptive cruise control sensors; External sensors (excluding paint
to match); Air fuel ratio sensor; Anti-knock sensor; Barometric pressure sensor; Fuel sensor;
Intake air temperature sensor; Fuel temperature sensor; ABS electronic wheel sensor;
Manifold air pressure (MAP) sensor; Mass air flow sensor; Airbag Sensor(s).
v) Entertainment System: (Parts and Labour) LCD screen; RF module; Digital video disc player;
Power invertor; CD player; CD changer; Speakers.
w) Navigation System: (Parts and Labour) Navigation display unit; Navigation control module;
Navigation system wiring harness;
x) Phone system: (Parts and Labour) Installed only by the manufacturer: Bluetooth module;
Microphone; Speakers.
y) Convertible Components: (Parts and Labour) Motor, switch.
z) Hybrid/Electric Vehicle Components: (Parts and Labour) Battery Control Module, Hybrid
Vehicle Control Module, Inverter/Converter; Battery charger; Electric Motor; Generators;
High voltage cables; Power controller.
aa) Rental Allowance: A rental vehicle allowance of $40.00 per day including applicable sales
taxes, per day, for a maximum of five (5) days per claim repair occurrence will be granted,
upon receipt from a rental establishment or a licensed repair shop. A rental vehicle is only
covered if the Breakdown or Mechanical Failure is covered by this Agreement. The Covered
Vehicle must be immobilized for more than 24 hours and a valid receipt must be submitted
for reimbursement.
bb) Trip Interruption Allowance: A maximum of $100.00 per day including applicable sales taxes
for a maximum of five (5) days will be reimbursed for lodging expenses at a hotel or motel
when a Mechanical Failure or Breakdown is covered by the Agreement. The registered
vehicle must be immobilized for a period of more than 24 hours and be more than 250
kilometres away from the Warranty Holder’s address indicated on the first page of this
Agreement for such coverage hereunder to be authorized.
11. Claims Procedure:
a) The Warranty Holder should contact Ensurall 1.800.358.8164 immediately to initiate the
claim process;
b) The Covered Vehicle may be taken to any licensed mechanic of the Warranty Holder’s
choice. Ensurall reserves the right to refuse any repair estimate and/or has the right to
request a second opinion at an alternative repair facility if a repair estimate is judged
suspicious and/or unreasonable;
c) Ensurall may request the Warranty Holder to produce documentation to substantiate
maintenance requirements have been met as per “Maintenance Requirement” section of this
Agreement.
d) In some cases, claims adjusters will be required for onsite assessment(s). The amounts paid
by Ensurall for parts and labour are determined by the average similar repair costs or by the
MITCHELL GUIDE. The liability of Ensurall under this warranty will extend only to repairs
which have been duly authorized by Ensurall. Pre-Authorization is only granted when the
Terms and Conditions set out in this Agreement have been met and this Agreement remains
in force and the cost estimate is satisfactory to Ensurall. A Claim Authorization Number is
only valid for a period of thirty (30) days and only as applicable to the repair shop identified
therein;
e) Ensurall may at its sole discretion replace failed parts with OEM, aftermarket, used, rebuilt or
remanufactured parts of same or similar quality.
f) If this Agreement expires, is cancelled or terminated by Ensurall (as permitted herein) prior
to the work being completed, the repairs will not be covered by this Agreement.
g) Ensurall will pay repair costs directly to the mutually agreed upon licensed repair shop by
Credit Card after a Claim Authorization Number is given in writing; after repairs are
completed; after the final invoice is signed by the Warranty Holder and such is received by
Ensurall. The Registered Owner will only have to pay the deductible plus taxes, if applicable,
and other miscellaneous non-covered items directly to the licensed mechanic.
h) In special circumstances only, Ensurall will reimburse the Warranty Holder for pre-authorized
repairs. The Warranty Holder will have to present Ensurall copies of the repair documents
including the payment receipt within ten (10) days of paying for the repair to substantiate
the reimbursement. Any repair completed outside of the Province of Ontario will be
evaluated as per the standards of the Ontario automobile industry. All covered repair costs
will be reimbursed in Canadian funds. The Warranty Holder will have to present documents,
including the payment receipt, to substantiate any rental allowance or trip interruption
reimbursements, within ten (10) business days of paying for those services.
12. Warranty Coverage Exclusions:
a) When the responsibility for repair is covered by; an insurance policy; valid warranty from the
manufacturer including extended drivetrain, major component or full coverage warranties; a
repairer’s guarantee/warranty; or failures, for which the manufacturer has announced its
responsibility through any means, including recall campaigns and factory service bulletins in
Canada or The United States of America.
b) Batteries; Shock absorbers; Air-suspension systems; Manual transmission clutch assembly;
Friction clutch disc & pressure plate; Throw out bearing; Manual and hydraulic linkages;
Glass; Lenses; Sealed beams; Bulbs; Brake pads; Brake shoes; Brake rotors & brake drums;
Weather strips; Exterior body parts; Ornamentation; Paint; Upholstery & carpet; Tires;
Wheels/rims; Muffler; Catalytic converter; Exhausts pipes; Resonator; Spark plugs; Glow
plugs; Distribution cap; Ignition rotor; Hoses; Drive belts; Wiper blades; Manual Transmission
clutch; liftgate and door latches; struts; Anti-theft systems; plugs.
c) Maintenance and adjustment services and parts described in the Vehicle’s Owner’s Manual
as supplied by the manufacturer and other normal maintenance services and parts including,
but not limited to: Alignment; Wheel balancing; Tune-ups; Engine oil filter change; Wiring
repairs (unless indicated as a covered component); Cabin air filter; Cleaning fuel lines/hoses
or fuel injectors.
d) Any component not covered by the vehicle manufacturer for the full term of the vehicle
warranty is excluded.
e) Any failure resulting from: Collision; Internal or external fire; Theft; Vandalism; Riot;
Explosion; Lightening; Earthquake; Freezing rain; Rust or corrosion; Windstorm; Hail; Water
or flood; Acts of God; Environmental damage.
f) Any failure caused by misuse; abuse; negligence; maintenance neglect required by the
manufacturer’s maintenance schedule for the named vehicle; servicing by an unlicensed
mechanic; sludge build-up or not maintaining proper levels of fluids/lubricants/coolants; or
not protecting the vehicle from further damage when a failure has occurred.
g) Any failure where supportive maintenance or servicing has been falsified.
h) Any repair or replacement of a covered part if a failure has not occurred or if the wear on the
part has not exceeded the field tolerances permitted by the manufacturer.
i) If any alterations have been made to the vehicle or if the vehicle has been used in a manner
not recommended by the manufacturer, such as (but not limited to): the failure of any
custom or add-on part; frame or suspension modifications; or modifications to the engine;
emissions or exhaust systems.
j) If the odometer of the named vehicle has failed and repairs to the odometer have not been
immediately made; the odometer has been altered or modified in any way; or if the vehicle’s
true mileage cannot be determined.
k) Any liability for property damage; for injury to or death of any person arising out of the
operation, maintenance or use of the vehicle whether related to the part(s) covered or not.
Time loss, profit, inconvenience or any other loss that results from a failure.
l) Repairs to seized or damaged engines due to continued operation without sufficient
lubricants or coolants. The Warranty Holder is responsible for making certain that the
warning lights/gauges in the main dashboard are functioning properly. The Warranty Holder
must pull over to the side of the road immediately and discontinue vehicle operation when
warning light indicates inadequate protection or performance.
m) Salvaged title, or similar titled vehicles, i.e rebuilt, insurance write-off.
n) If the vehicle has over 200,000 km on the odometer.
o) When the responsibility for repair is covered by; an insurance policy; valid warranty from the
manufacturer including extended drivetrain, major component or full coverage warranties; a
repairer’s guarantee/warranty; or failures for which the manufacturer has announced its
responsibility through any means, including recall campaigns and factory service bulletins.
p) If named vehicle is used for towing a trailer or other object or vehicle without being quipped
with a factory installed or authorized tow package, or is used for commercial purposes,
including, but not limited to: rental; taxi; limousine; livery or shuttle; commercial towing;
road repair; construction; farming or agricultural purposes; job site activities; hauling; police
or emergency services; principal off road use; racing; competitive driving; snow removal;
route-work; service or repair. Note: recreational towing is permissible.
q) Any failure occurring prior to the contract purchase date, or if information provided by you
or a repair facility cannot be verified as accurate or is found to be deceptively inaccurate.
r) Any failure occurring outside of Canada or the United States or America.
s) Damage caused by pre-ignition detonation, pinging, improper/contaminated fuel or
improper engine adjustments.
t) Any pre-existing conditions.

13. Cancellation: This Agreement may be cancelled within 30 days of the purchase date by the
Warranty Holder or by Ensurall. The warranty may also be canceled by Ensurall upon receiving the
Inspection Report. A cancellation notice must be given to Ensurall by the Warranty Holder in writing
indicating the date of cancellation. Any monies received will be returned to the Warranty Holder
less the cost of the vehicle inspection (if performed).
14. Transfer: If all the Terms and Conditions of this Warranty Agreement have been met, any remaining
benefits may be transferred to a subsequent owner. This warranty cannot be transferred to another
vehicle. Ensurall must be notified within 10 days with the new Warranty Holder’s information (refer
to PERSONAL INFORMATION on the front section of this Agreement), and a copy of the vehicle
registration. A copy of the bill of sale must also be provided. A transfer fee of $100.00 plus taxes will
apply, without exceptions.
15. Dispute Resolution: Most disputes or disagreements between Ensurall and the Warranty Holder
arising under this Agreement can be resolved quickly by contacting Ensurall at the address noted on
the first page of this Agreement. In the event Ensurall is unable to resolve a dispute with the
Warranty Holder after attempting to do so informally, the parties to this Agreement agree to resolve
such disputes through binding arbitration in accordance with the rules of the Canadian Arbitration
Association. The party that intends to seek arbitration must first send to the other party, by certified
mail, a written notice of dispute (“NOD”). The NOD should be addressed to other party and contain
(a) the nature and basis of the claim or dispute; and (b) set forth the specific relief sought. If the
parties do not reach a settlement within thirty (30) days of receipt of the NOD, either party may
commence an arbitration proceeding. Unless otherwise agreed to mutually by the parties, the
arbitration process will take place in the Province of Ontario.
16. Right to Recover: If the Warranty Holder has a right to recover funds that Ensurall has paid under
this Agreement against another party, the Warranty Holders rights against said third party shall
become Ensurall’s rights. The Warranty Holder agrees to provide reasonable assistance to help
Ensurall to recover these funds.
17. Personal Information: The Warranty Holder hereby agrees that any personal information provided
to Ensurall during the purchasing of this Agreement, the provision of a payment plan, processing
and payment of claims hereunder, and/or the cancellation or transfer of this Agreement, is hereby
consented to. Please note that Ensurall may use third party data storage providers outside of
Canada and may also need to facilitate claims repairs outside Canada. The Warranty Holder hereby
consents to the collection, use, storage and disclosure of their personal information for the
purposes outlined herein.
18. This Agreement is backed by a Surety provided to Veri-Cheque Ltd, O/A Ensurall, by Unica Insurance
Inc.; 7150 Derrycrest Drive, Mississauga, ON, L5W 0E5.
19. This Agreement constitutes the entire Agreement between Ensurall and the Warranty Holder and
supersedes and extinguishes all previous drafts, agreement, arrangement and understandings
between them, whether written or oral, related to this subject matter. This Agreement shall be
governed by the laws of the province of Ontario.
