RESOLUTION

This is a case for Murder against the respondent, Charleston Tiu, a


resident of Brgy. 2, Ablan, City of Batac.

As per evidence of the complainant, the victim and the respondent are
both public utility tricycle drivers operating within the city.

According to Kervin Mejia, another tricycle driver, on 18 December 2017,


at about 12:30 in the evening, they, Andrei “Bingo” Mariano, Charleston Tiu and
him, were driving, in that order, their tricycles for hire. As they were then in front
of the Imelda Cultural Center, he noticed Andrei “Bingo” Mariano and Charleston
Tiu having heated verbal arguments. Then, Andrei “Bingo” Mariano, the victim,
suddenly stopped his tricycle in front of respondent. Immediately alighted
therefrom and approached Charleston Tiu. As he was approaching the
respondent, Andrei “Bingo” Mariano repeatedly boxed the latter. After that, he
went back to his tricycle. As he was walking away, respondent took a bolo from
the sidecar, and used it to hack the victim, hitting the latter at his head and right
hand.

The victim brought himself at the Mariano Marcos Memorial Hospital and
Medical Center for treatment but due to the gravity of his injuries, he died due to
"massive subdural hematoma, left fronto-parietal area," hacking.

Respondent despite due notice, as of this even date, failed to controvert


the material allegations against him. Hence, he is deemed to have waived his
right to adduce evidence in his favor. With the uncontroverted evidence, there is
a probable cause to indict the respondent for the crime of murder with the
attending qualifying aggravating circumstance of treachery.
WHEREFORE, above premises, let the necessary information for the
crime of Murder with the qualifying aggravating circumstance of treachery be
filed against the respondent, Charleston Tiu at the proper court in due time.

SO ORDERED.
