1.0 Purpose

The purpose of this policy is to establish and communicate BorgWarner’s zero-tolerance


towards threats, threatening behavior, or acts of violence conducted by or against
employees or third-parties while on Company property, including its facilities and
parking areas, or while off property and conducting Company business.

2.0 Applicability

This policy is applicable to employees, temporary and contract workers, customers,


suppliers, and visitors of BorgWarner Inc. and to its subsidiaries and affiliates; and will
be enforced consistent with applicable local law and collective bargaining agreements.

3.0 Responsibility

To help maintain a safe workplace, employees are responsible for following the
protocols below if threatening or violent action is witnessed on Company property or
while conducting Company business off property.

• If the issue involves an immediate threat to life or property, the employee


should follow the site emergency notification protocol.
• If an employee witnesses or receives any threats, or if the employee has been
told about a threat a co-worker has witnesses or received, the employee is to
notify his/her Manager and/or Human Resources representative immediately.

It is important that all violence or threats be reported regardless of the relationship


between the individual making the threat or threatening behavior and the person who
was threatened or was the focus of the threatening behavior (e.g., husband and wife,
two co-workers, supervisor and employee, employee and vendor). Employees with
knowledge of a violation or suspected violation of this policy are required to promptly
report the information to their Manager and/or Human Resources representative. The
manager and/or Human Resources representatives are to report violation of this policy
to the Critical Event Management Team at +1-248-254-6441.

4.0 Definitions

The term “Company Property” is defined as property owned, leased, rented, and/or
otherwise being used for official Company purposes, to include buildings,
structures, land, and means of transportation.

The term “Weapons” is defined as firearms (including air-pistols and air-rifles), knives
not required for one’s job, explosive materials, chemicals, and dangerous objects that
are carried, stored, and/or used in a dangerous manner or for the purpose of injuring or
intimidating others. Objects, such as tools used for the repair of machinery, equipment
and parts produced and assembled in a plant, that have been designed or constructed
for official purposes and are used in an offensive or aggressive manner are deemed
dangerous objects for the purposes of this policy.

The term “Zero-Tolerance” means every workplace threat or act of violence, which
includes the Prohibited Conduct listed below, will be investigated, and appropriate
disciplinary action will be taken up to and including termination of employment
consistent with any applicable law or collective bargaining agreement.

5.0 Prohibited Conduct

Prohibited conduct on Company property and/or while conducting business on behalf


of the Company includes, but is not limited to, the following examples:

• unless contrary with applicable laws, the possession, use, and/or storage of
Weapons;
• damaging property, personal or Company, as a result of violent acts;
• abusive or threatening language or behavior, including verbal or written threats,
harassing phone calls, texts, emails, messages, social media postings, and
stalking; and
• unwanted physical contact, by way of example: hitting, fighting, pushing, or
throwing of objects

6.0 Exceptions

Plant Managers are only authorized to allow exceptions to the possession and
storage of Weapons portion of this policy when the item is required for an official
purpose. Local weapons policies must reflect authorized exceptions, and those
exceptions must comply with federal, state, provincial law.

This policy is not applicable to public law enforcement, licensed armored courier
services, military armed forces personnel, or other officials engaged in the performance
of official duties.

7.0 Restraining Orders

Employees who have applied for or have a protective/restraining order that lists
Company locations as protected areas, must provide a copy of the following items to
local Human Resources:

• the petition and declarations used to seek the order;


• a copy of any temporary protective/restraining order which is granted; and copy
of any protective /restraining order that is made permanent. Human Resources
will involve the appropriate Security/Management personnel.

Due to the sensitive nature of these circumstances, information will be handled on a


“need to know” basis and efforts made to respect individuals’ privacy.

8.0 Sanctions

Employees who violate this policy will be subject to disciplinary action up to and
including termination of employment. Temporary and contract workers, customers,
suppliers, and visitors who violate this policy may be removed from BorgWarner
property and barred from returning to Company property at BorgWarner’s discretion.

Upon being informed of an allegation of prohibited conduct, the Company shall


investigate the matter and will take corrective or preventative action accordingly. Any

conduct on Company property will be removed from the premises as quickly as safety
permits and may not return unless authorized by the Company.

9.0 Law Enforcement

A violation of this policy is to be immediately reported to law enforcement authorities


when an act of physical violence has occurred, an imminent danger exists, or a violation
of local, state, provincial, and/or federal law occurs.
