La Constitució espanyola de 1976 neix del consens entre els actors polítics de
diferents ideològics per tal de dotar Espanya d'una Constitució que trenquen amb
l'antic règim dictatorial i que converteix en la societat espanyola en una societat
sobirana, moderna i lliure d'escollir el futur.
Constitució va ser ratificada majoritàriament pels ciutadans en referèndum celebrat
el 6 de desembre de 1978.
Espanya es constitueix així com un Estat social i democràtic de dret que propugna
com a valors superiors:
• La llibertat: Atorga a la ciutadania per poder actuar i pensar sense por de patir-hi
represàlies.
• La Justícia: creació d'un marc Jurídic en què tots, ciutadans i ciutadanes,
empreses, organismes públics, etc., estan sotmesos a la llei i la justícia.
• La igualtat: perseguir la igualtat entre els ciutadans i ciutadanes, garantint per a
l'accés a les oportunitats.
• El pluralisme polític: permetre l'existència de diferents corrents ideològics, sense
que això suposi un problema social; al contrari, hauria d'enriquir el panorama polític.
La societat necessita sentir-se segur sota un paraigua legal estable per tenir certitud
i tranquilitat. Dos vies:

● Determinar la constitucionalitat o no de les lleis i normes amb rang de llei
● Resolució de conflictes entre Estat i comunitats autònomes.

● Resolució de conflictes entre els òrgans constitucionals de l'Estat.
- Normativa reguladora: Constitució Espanyola i llei orgànica del Tribunal
constitucional.
Les Corts Generals són l'òrgan de representació del poble espanyol, i són elegides
per sufragi universal. Les seves característiques són:
- Durada del mandat de diputats i senadors: Una legislatura de 4 anys
- Qui pot elegir diputats i senadors: Espanyols majors de 18 anys, excepte
condemnats per sentència judicial ferma a la pena principal.
Les cambres i la seva elecció els Espanyols elegim cada 4 anys els nostres
representants al Congrés dels Diputats i el Senat.
A. El Congrés dels Diputats: Els candidats van en llistes tancades i cada elector
tria una llista.
B. El Senat: Candidats a senadors apareixen a llistes obertes, i els electors poden
triar fins a 3 candidats de totes les opcions.

- Sessions ordinàries: dos períodes de sessions(1r a setembre i 2n de febrer a juny)

- President: Elegit per la majoria absoluta de la Cambra. És el portaveu de la
Cambra i representant a tots els actes oficials.

És una entitat territorial formada per una o diverses províncies que té capacitat
d'autogovern la qual està limitada per les seves competències i regulada per la
constitució

Una entitat territorial local amb personalitat jurídica pròpia composta per l'agrupació
de municipis i amb capacitat per al compliment dels seus fins
Organització
● Ple; Constituït pel president i diputats, Les seves funcions són aprovació
ordenances i pressupostos i control del govern.
● President i vicepresident; És elegit entre els diputats, s'encarrega de dirigir el
govern i l'administració.
● Junta de govern: Integrada pel president i no més de ÿ dels diputats.
Assisteixen al president i realitzen totes les activitats delegades.

4. ELS MUNICIPIS.
Una entitat territorial bàsica amb personalitat jurídica i capacitat per al compliment
dels seus fins Depèn del volum de població del municipi entre d'altres coses.
Organització
OBLIGATORI per a tots els municipis
● Alcalde: Dirigeix el govern i l'administració municipal
● Tinent d'alcalde
● Ple: controla òrgans de govern i aprova i modifica pressupostos i
competències cedides per les administracions públiques.
● Comissió especial. Examinar, estudiar i informar dels comptes municipals
+ 5000 Habitants
● Junta de govern local: Assistir a l'alcalde i gestionar les tasques delegades
FINANÇAMENT:
● TAXA: Tribut que s'exigeix als ciutadans per aprofitar un servei públic.
● CONTRIBUCIÓ ESPECIAL: Contribució per l'increment del valor d'un bé.
● IMPOSTOS: ( IBI, IAE, IVTM, Etc. )
