Blue Bamboo Center for the Arts/Blue Bamboo Music Inc

Performance Contract

This is an agreement to hold a ticketed event at the Blue Bamboo Center


for the Arts, located at 1905 Kentucky Ave, Winter Park, FL 32789.
Blue Bamboo Center for the Arts and Blue Bamboo Music Inc, herein
referred to as “venue” shall provide the location named above for the
performance to be held on the dates and times specified herein,
according to the terms and conditions specified herein. By signing this
agreement, Nashir Janmohamed herein referred to as “artist” is
agreeing to its terms, conditions, and house policies. Please sign the last
page and initial the rest.

Event title: Blue Bamboo Jazz Festival 2023: Septessence

Event Date: September 15, 2023


Event start time: 9:15pm

Event end time: 10:15pm

Event description: 1 set (1 hour)

Load in/Sound check time: 6:00pm

Doors: 7:15pm

Ticket Price: $20 per person General Admission (chair only); $30 per
person VIP table seat; $16 per person student/military

Capacity: 100

Compensation: $800.00

Terms:

Artist agrees to appear and perform at the stated times and dates.
Unless other terms are stated, compensation shall be by company check
at the time of the performance.

Artist must provide W-9 form for taxation purposes.

Cancelation:

Artist is responsible for the content of the performance, but venue


reserves the right to cancel performance at any time, without
compensation, in the event of objectionable behavior such as profanity,
nudity, racist or intolerant remarks, or violation of house rules.

Artist shall not exceed volume levels of 94db. Venue may cancel
performance at any time, without compensation, if artist fails to comply.

Venue reserves the right to cancel any event, without payment to artist,
where less than 10 tickets have been sold by 24 hours prior to the event.

Venue reserves the right to cancel any event, without payment to artist,
due to inclement weather (including but not limited to a lightning storm,
tornado, hurricane), force majeure, power failure, or "acts of God". For
all events where Venue elects to cancel the event, Venue shall refund
previously purchased tickets for the cancelled event. The same
conditions apply to artist regarding cancellation due to Force Majeure.

Definition of Force Majeure - force ma·jeure /ˌfôrs mäˈZHər/ noun LAW

- unforeseeable circumstances that prevent someone from fulfilling a


contract.

In the event of a force majeure cancelation, both parties shall make every
good faith effort to reschedule the event.

Confidentiality:

The details of this agreement are confidential and are not to be shared
with a third party, or in a public forum.

Important information

COMPLIMENTARY TICKETS

Artist may have 1 comp per band member, if he/she desires.


Venue asks Artist to use the comp tickets sparingly. If Artist
wishes to have more than 1 comp per band member, then he/she
will compensate venue for its share of the ticket price for any
additional comps. Artist will provide a list of comps to Venue at
least one week prior to event date.

INPUT LIST

A comprehensive 24 channel max input list and stage plot must be


provided at contract signing. Our stage dimensions are 12’ x 20’
with an 8’ extension on stage right, which is where our piano is
located. There is another small platform on stage left also which
should be avoided for lighting purposes. For most situations plan
your use for the 12x 20 area in the center, and should you require
additional space you may utilize the extension on stage right.
Please see attached diagram and mark as needed. Performances
must take place on the stage. IMPORTANT - The input list and
stage plot allow our tech staff to place the monitors and mics in
the proper locations, and test everything PRIOR to your arrival.
This saves everyone a lot of time.

AUDIO EQUIPMENT

We use a 32 channel, digital/analog sound system, offering 4


separate monitor mixes. There is one, in house, wireless device. If
additional wireless mics or devices are important to your
presentation you must provide them, or we can arrange rentals.
Equipment rental fees will be deducted from your fee if applicable.
There are a total of 4 direct boxes in house. Our technician will go
over your input list requirements and discuss any changes that are
necessary. In most cases we can provide what is needed, but in
some cases, you may desire to bring something special. This
should be coordinated with our technical staff beforehand. We also
have 8 Manhassett style music stands, stand lights, chairs as
needed, mic stands, and guitar stands.

GUEST ENGINEERS

Since our system is a complicated, (hybrid recording/live rig), we


prefer our technicians handle the technical operations, but we will
do our best to interface and collaborate with your engineer to make
sure your needs are met. Our staff is extremely knowledgeable and
qualified to mix and record any show and know the unique aspects
of the room and equipment. If there is a problem, they can usually
solve it quickly. In the event of a dispute with multiple engineers,
our staff shall be empowered to make the deciding call. If a
recording is being made, the work is only guaranteed if our staff
performs the work.

PROJECTOR

There is a 10’ projector screen in 16x9 aspect ratio format and


projector. During the show, artist’s logos can be projected onto
screen if desired. We can also create a graphic if needed at no
charge. Please email logos and projector art to

EVENT STRUCTURE

Unless other arrangements have been made in advance, the event


will unfold according to the following guidelines:

1. Load in/set up/sound check: (up to 2 hours)


2. Doors: (45 minutes prior to show time)
3. Set 1: (45 - 50 minutes)
4. Intermission: (15 - 20 minutes)
5. Set 2: (30 minutes)
6. Tear down, cleaning: 30 minutes

The intermission is mandatory, both for selling purposes, but also


to provide a break to the technicians in the booth. Unless special
arrangements have been made in advance, no activity requiring
lighting or sound technicians will take place during the
intermission. The projector screen will feature our sponsors,
accompanied by appropriate background music. Venue shall
approve background music.

Venue is not liable for specific results re: social media [e.g. likes,
retweets, shares, posts, favorites, friend/follower requests, etc.],
traditional media [e.g. stories run, covered, shared, written, etc.], and/or
event attendance figures.

Artists/Performers agree to assist with the promotion of their respective


event(s). Artists/Performers are responsible for their own respective
outreach to media outlets, including, but not limited to, press releases,
media contact list, etc.

Venue does not guarantee that a particular number of seats can or will
be sold for your event.

NO DISCRIMINATION

Artist/Performers shall not be discriminated against due to race, color,


religion, gender, national origin, age, disability, or marital status.

HOUSE RULES:

CONDUCT - No loitering or congregating in the parking lot prior to,


during, or after the event. Smoking areas are provided.

Alcoholic beverages are not permitted outside of the building.

Exits are not to be blocked in open position. Locked doors are to


remain locked.

Guests must respect authorized use postings and avoid private


areas unless they have been given specific access to those areas.

Physical violence will not be tolerated and will be cause for


immediate expulsion.

Performers and guests shall use the premises in a considerate


manner at all times.

IMPORTANT: No outside alcoholic beverages of any kind are


permitted in the theater or green room/dressing room. Hard
liquor is prohibited at all times.

Green room/dressing room facilities are to be kept clean and neat.


Artist is responsible for ensuring the green room/dressing facilities
are kept clean. Artist is responsible for cleaning up after
him/herself and his/her band members at the end of a
performance, before loading out. A $200.00 fine will be assessed
to Artist if the green room/dressing room facilities are not
clean upon his/her departure.

The green room/dressing room is for performers only. No guests


are allowed in the green room/dressing room at any time. Artist is
responsible for any damage to green room/dressing room and
contents.

Performers may use green room/dressing room exits, but please


re-lock doors upon re-entry, and do not leave unlocked doors
unsupervised. This is for your protection and ours. The safety of
artists is very important to us.

Locked exit doors are to remain locked, except in an emergency.
Do not block exterior exit doors in an open position, except for
loading and unloading purposes.

LIVE STREAM TO BLUE BAMBOO’S YOUTUBE CHANNEL

As part of Blue Bamboo Center for the Arts’ (BBCFA) non-profit


mission to provide free access to events, regardless of economic
status, we live-stream our events on our YouTube channel. The
resulting recordings are the sole property of Blue Bamboo Center
for the Arts. You may purchase the recordings if you wish, but
there is no obligation to do so. We offer very reasonable prices to
cover the basic cost of capturing the material and preparing it for
transfer.

By signing this agreement, you are granting permission for BBCFA


to record your performance and make it available to the public on
our YouTube channel, and you are granting exclusive ownership of
the resulting digital recordings to Blue Bamboo Center for the Arts.

Usage: BBCFA will not monetize the recordings in any way


without Artist’s written consent. The only authorized uses are for
BBCFA to make the performance available to the general public,
advertise future events, and solicit charitable donations. Any other
usage would constitute a violation of this agreement. Artist will not
make unauthorized copies of the recordings to distribute to the
general public or advertise future events without Venue’s written
consent. To do so would be a violation of this agreement.

At Artist’s request, Venue will remove the recordings from public


view after the live show has taken place. In the absence of any
such request, Venue may continue to share the performance
publicly according to the stated terms.

Blue Bamboo Center for the Arts is a registered 501(c)(3) charitable


corporation. Registration #: CH46010. We have 3 primary
purposes -
1. Provide affordable, family friendly music, spoken word, and
visual arts.
2. Provide an income to artists.
3. Serve our community through the arts.

AUDIO/VIDEO RECORDING

We are a full-service audio/video soundstage. Artist’s self-


recording of the shows are not permitted, but we offer broadcast
quality recording, with a wide range of affordable options
depending on your needs. Those include multi-track audio
capability, multiple HD camera angles, and full post-production
options. It can be as involved as a major motion picture, or as
simple as a single camera or microphone. We do hourly or flat rate
pricing and offer a range of all-inclusive package deals and
discounts. We are also available for closed recording sessions.

With so many options it can be challenging but Chris Cortez will


carefully explain all the options available, pricing, and translate
the technical jargon if necessary. Please contact Chris at

to record your event.

Full payment of the recording fee entitles the artist to use the name
of the venue in any subsequent release of the recordings., such as
“Live at Blue Bamboo.”

Still photography, and short video clips by audience members are


permitted, unless artist specifies otherwise.

In the event of any dispute, venue shall be in Orlando, Orange County,


Florida, and the prevailing party shall be entitled to its attorney's fees
and costs.
