SPILL RESPONSE CONTRACT CERTIFICATION

National Response Corporation (NRC) certifies that REEDEREI JENS & WALLER
GMBH & CO. KG, as (Owner/Operator) in accordance with the Oil Pollution Act of
1990 (OPA 90) has “ensured, by contract or other approved means, the availability of
private personnel and equipment necessary to respond, to the maximum extent
practicable, to a worst case discharge” and separately certifies that Owner/Operator in
accordance with the California Code of Regulations Title 14 has ensured by contract the
availability of the required personnel and equipment capable of responding to an oil spill
within the required response times and in the specific Geographic Regions to a worst case
discharge for the below named Entered Vessel (s). NRC agrees that Owner/Operator has
the right to name NRC and its resources, including those within its Independent
Contractor Network (ICN) for OPA 90 and California Code of Regulations Title 14
coverage for the below named Entered Vessel (s) on the U.S. East, West, Gulf Coasts,
Great Lakes, and the U.S. Caribbean and Hawaii and California, respectively. NRC
reserves the right to rescind this authorization in the event of termination of its
contractual arrangements with the Entered Vessel (s).
