SECTION II – PARTICULAR CONDITIONS

These provisions are intended to modify, amend, supplement, or supersede as noted the language of FIDIC
General Conditions, Construction for Building and Engineering Works Designed by the Employer, First Edition
1999. Unless otherwise stated, the remaining language of the General Conditions remains in full force and effect.

Sub-Clause 1.1.1.1 Contract

Delete the Sub-Clause in its entirety and replace with the following:
““Contract” means the documents listed in Article 3 of the Contract Agreement."

Sub-Clause 1.1.1.4 Letter of Tender

Delete the Sub-Clause in its entirety.

Sub-Clause 1.1.1.9 Appendix to Tender

Replace definition with the following:
““Appendix to Tender” means the contract data set out in the Conditions of Contract”.

Sub-Clause 1.1.1.11 to 1.1.1.13 - Additional Definitions

Add the following definitions:
“1.1.1.11 “Record” means a written document, item of correspondence, file drawing or other piece of information
or part thereof or confirmation of an addressee, recipient, the time or date of an action and other data recorded
by the document control system and produced or reproduced by the document control system in any form.”
“1.1.1.12 “Document Control System” means the web based electronic document management system as
specified by the Employer to be used for the Project.”
“1.1.1.13 “Particular Conditions” means this part of the Conditions of Contract including the Annexes of the
Particular Conditions.”

Sub-Clause 1.1.2.2 Employer

Insert “and permitted assignees of” after “in title to”.

Sub-Clause 1.1.2.4A Engineer's Representatives

Add the following definition:
“1.1.2.4A “Engineer's Representatives” means any person or entity to whom the Engineer may delegate any
of its powers and authorities in accordance with Sub-Clause 3.2 below”.

Sub-Clause 1.1.2.6 Employer's Personnel

Delete the existing word “assistants” and substitute by “Engineers’ Representative”.

Sub-Clause 1.1.2.9 DAB

Delete this Sub-Clause in its entirety.
